DISMANTLING THE MULTI-LEVEL MARKETING SCHEME OF HERBAL MEDICINES: BETWEEN CONVENTIONAL REGULATIONS AND SHARIA PRINCIPLES

The practice of Multi-Level Marketing (MLM) of herbal medicines is increasingly rife in Indonesia and there is the potential for fraud that often occurs in this practice. This study aims to dismantle the MLM scheme of herbal medicine from the point of view of conventional regulation and sharia principles. The methodology used includes literature study, legal analysis, and interviews with experts. The results revealed that there is an herbal medicine MLM scheme that violates conventional regulations and sharia principles. The conclusion of this study is the importance of strict supervision of herbal medicine MLM and the need to educate the public about legal and sharia MLM schemes. The practice of Multi-Level Marketing (MLM) of herbal medicines is increasingly widespread in Indonesia. MLM herbal medicine is a marketing system where members get a commission from selling products and recruiting new members. This shows the need for research to dismantle herbal medicine MLM schemes and uncover potential frauds that occur. In addition, there are also sales of illegal products that do not have official permission from the Food and Drug Supervisory Agency (BPOM). Pyramid schemes are also one of the findings of this study, where many herbal medicine MLM players jointly profit by recruiting new members without making substantial product sales. These findings point to the need for close supervision of herbal medicine MLM practices to protect consumers and prevent potential violations of sharia laws and principles. After conducting this research, it can be concluded that herbal medicine MLM needs to get close supervision. Research findings show violations of conventional regulations and sharia principles in herbal medicine MLM practices. Therefore, it is necessary to educate the public about legal and sharia MLM schemes so that they can understand the rights and obligations as smart consumers. In addition, there is also a need for increased regulations to monitor the practice of herbal medicine MLM in order to protect consumers and maintain the integrity of the MLM business in Indonesia.

Adoption of Persuasion Communication of Young Mothers in Multi-Level Marketing (MLM) Business Development

Business competition has given birth to a network marketing system or what is commonly referred to as Network Marketing. The utilization used in Network Marketing, or what we currently know as MLM (Multi-Level Marketing), uses a network system where interpersonal communication is required both between MLM members and communication between members, customers, and prospective consultants. The interpersonal communication of consultants determines MLM business. How do they apply persuasive communication to persuade consumers or other consultants to join their network? This research uses a case study method. The results illustrate three important things young mothers do when running an MLM business to build the household economy. First, a trustworthy communicator will build credibility. Second, I need to understand how to convey messages in the MLM trading system; third, I need to choose communication channels that follow the objectives.

Financial Freedom in PAYTREN Multi Level Marketing Practice

Financial freedom is a process to obtain passive income, cancellation, receipt and sale of goods or services, then there is someone who is involved in the Multi Level Marketing business. One company that provides passive financial freedom with a Multi Level Marketing system as PT. Veritra Sentosa Internasional by creating a product called PayTren. PayTren is a mobile transaction application created.The purpose of this study is to find out how the forms and ways of obtaining financial freedom in the practice of Multi Level Marketing PayTren and know the review of the theory of maṣlahah and mafsadah on the forms and ways of obtaining financial freedom Multi Level Marketing PayTren. This research uses descriptive qualitative method. Data sources are taken from primary and secondary data. The acquisition and form of financial freedom achieved leads to greater mafsadah, the main cause is the company making the dominant market opportunity for success it is not clear so it leads to gambling, fraud, usury and tyranny. While the basic services of the PayTren application such as electricity, bpjs, top up the balance, speedy payment and others are not included at all from the main purpose of this contract.

An Exploratory Examination of the Mompreneur and Multi-Level Marketing: What Does She Do and Why Does She Do It?

The number of small businesses owned by women in the United States is on the rise, due to a variety of reasons. One business model, which is attractive to mothers who lead busy lives, is multi-level marketing. The purpose of this study is to examine the motives of mompreneurs and gain a better understanding of their experiences with the multi-level marketing business model. Data collection involved both a survey and phenomenological interviews. The results identified a variety of motivations for engaging in multi-level marketing, ranging from economic to brand relationships. The women utilised social media tools to access their social capital in order to advertise and sell products to a large network of other women. Moreover, they received significant support from their family and friends related to their business. Several success factors and challenges were identified, as was a finding related to the serial nature of multi-level marketing business ownership. Theoretical and managerial implications are discussed.

This study aims to find out about MLM (Multi Level Marketing) in Islamic view (Islamic law). This research is qualitative descriptive. This study included literary research to examine the written sources such as scientific journals, book references, literature, encyclopedias, scientific articles, scientific papers and other sources that are relevant and related to the object which is being studied. As for the object of study of this research is form of texts or writings that describe and explain about MLM that be popular in Indonesia. Results of this study is Islamic law permit MLM as long as not contrary with Islamic law. However, if it is contrary with Islamic law, so MLM is forbiden. Islam has principles on the development of business systems that must be free of elements dharar (danger), jahalah (vagueness) and zhulm (detrimental or unfair to one party). The system of bonuses to be fair, do not oppress and do not only benefit the people. Businesses also must be free from the element of gambling, oppression, fraud, unclean, riba (interest), vanity etc. If we want to develop a MLM business, it should be free from those elements above. Therefore, the goods or services are commercialized and ordinances sales must be halal, no haram and doubtful, and not in conflict with the principles of Shari'ah above.

Analisis Penerapan Akad Al-Ju’alah pada Perusahaan Multi Level Marketing: Studi atas Perusahaan HNI-HPAI

This research is to find out whether the bonus given by PT. HNI-HPAI is in accordance with the ju'alah contract. The method in this study is a descriptive analysis method from personal studies on various information such as websites, desktop sites, and other social media. The research shows that PT HPAI adheres to a Multilevel Marketing business work system based on Islamic sharia. There is an element of service in the MLM system, meaning that a distributor sells goods that do not belong to him and he gets a wage from a percentage of the price of the goods and if he can sell according to the target he gets a bonus or gift set by the company. Bonuses or gifts in Islam are called al-jualah. Sell ​​is a wage or gift that has been promised to someone because he has done a job and the wage/gift can be given because the work that has been determined has been completed. According to the DSN fatwa NUMBER 62/DSNMUI/XII/2007 regarding the al-jualah contract, there are 5 conditions that must be considered by multi-level marketing companies, especially sharia-based MLM. PT. HNI-HPAI as a company that adheres to the MLM work system has met the requirements of the DSN fatwa.

Choosing the optimal marketing plan to create long-term residual income in socio-economic systems

This article discusses the issues of the multi-level marketing (MLM) industry, examines in detail the principles of the functioning of the MLM business, the knowledge of which can be useful when choosing a company for your goals. Currently, a huge number of people do not understand the principles of their marketing, its type, and as a result, they cannot explain the strategy and the payout system. Therefore, before choosing a partner, you should clearly define your own goals. That is, if you need a good manager, you need to pay attention to companies with a good "retail". If the need is for "quick" income, then companies with an appropriate marketing plan (MP) should be considered. If the goal is - stable development of the network, passive income, then we can consider companies with a completely different MP. The article analyzes the existing MPs in the MLM industry, identifies the strengths and weaknesses of each of them in order to select the optimal one for creating long-term residual income. The most suitable, for solving the problem, was chosen - a balanced MT. This type of MP is based on a stepped one with a branch and has a deep commission part. Due to this fact, the interests of all MP participants (consumers, distributors and leaders of high qualifications) are taken into account. Also, the strength of a balanced MT is the ability to clearly build a chain from expectations to results. The results obtained in the work will allow both a novice distributor and a growing leader to achieve high productivity in their activities in the MLM industry in the shortest possible time.

Penerapan Strategi Multi Level Marketing Melia Sehat Sejahtera Pada Masa Pandemi Covid-19 Perspektif Ekonomi Syariah

The purpose of this study was to determine the new strategy of PT. Melia Sehat Sejatera Mataram City during the COVID-19 pandemic and analyzed this strategy using a sharia economic perspective. This research uses qualitative methods, data collection techniques are carried out by combining and inductive data analysis. The results of this study stated that there were two new strategies implemented by Melia Sehat Sejahtera Mataram City during the covid-19 pandemic, namely the door to door strategy, sales and recruitment of prospective members through social media or online. The implementation of the Mult Level Marketing strategy of Melia Sehat Sejahtera Mataram City during the Covid-19 pandemic that was honest, transparent and fair is a marketing practice that has been exemplified by Rasulullah during his time as a trader. However, from a sharia economic perspective, the door to door strategy of the Melia Sehat Sejahtera Multi-Level Marketing business in Mataram City during the Covid-19 pandemic is not in accordance with the basic principles of sharia marketing.

Tinjauan Akuntansi Syariah Dalam Penggunaan Sistem Informasi Akuntansi Multi-Level Marketing Pada E-Commerce Indonesia

Islamic accounting is a financial recording procedure that generates information from an accounting information system (AIS) and forms a continuous cycle of repeat business policies. This study aims to describe the views of Islamic accounting related to AIS used for e-commerce-based multi-level marketing (MLM) businesses, as well as confirm the MLM law. The method used in this research is an entirely content analysis method. This research understands the flow of written sources, and then it is linked on an ongoing basis. The results showed that using AIS in the MLM business in e-commerce is permissible. It can be considered valid if the process still follows sharia. Fair according to sura An-Nahl (16) verse 90. It can be accounted for following sura Al-Baqarah (2) verse 282. This research can be a reference and consideration in using AIS in MLM business that stays away from the prohibition of muamalah.

Government Supervision of TVI Express: Multi-Level Marketing Business

This study aims to determine the form of government supervision of TVI Express activities in Bone Regency. In addition, to analyze the role of the Government in responding to the business under the guise of MLM. This type of research is empirical legal research. The interview method was used to obtain research data, conducted by interviewing directly to informants related to the problems studied in this study. The data obtained in this study were then analyzed qualitatively. The results show that the Regional Government Bone Regency is still less responsive in handling public complaints against TVI Express. Furthermore, the Regional Government of Bone Regency did not take concrete steps to anticipate the increasing number of fraud victims from the activities of TVI Express in Bone Regency. Therefore, the Regional Government must take concrete steps and actions and be proactive in handling the existence of businesses under the guise of MLM and illegal companies. In addition, the Government and members of the House of Representatives establish a special Law on the Anti-Pyramid System or the Anti-Money Game System Law. With the existence of this particular law, it is hoped that it can be a means of preventing and eradicating business practices under the guise of MLM. So that in the future, there will be no more similar problems that arise in the community. In this case, the community was not deceived and suffered losses due to business activities under the guise of MLM and illegal companies in Bone Regency.

Penerapan Etika Bisnis Islam Terhadap Bisnis Multi Level Marketing (MLM) Stokis Herba Penawar Al Wahida Indonesia (HPAI) Di Keppo Polagan Galis Pamekasan

Abstract:
 Multi-Level Marketing (MLM) business is a business whose marketing strategy is tiered or tiered. The purpose of the tiered marketing is a marketing in which the sales force (stockist) not only gets a profit based on product sales, but also gets it based on the sales of other stockists who are recruited to become members. This MLM business is in great demand by the public, but recently a problem has arisen regarding the presence of the MLM business. People are victims of money games, unfair marketing strategies, giving product testimonials that are not real and there is an element of fraud that creates unrest in the community. One of the reasons for this is that business actors do not apply Islamic business ethics to their business operations. So many parties feel disadvantaged. Herba Penawar Al Wahida Indonesia (HPAI) is one of the sharia-based MLM businesses in Indonesia. HPAI sharia MLM is here as if to give an answer to the public that not all MLM businesses are detrimental. This study aims to determine marketing strategies and provide testimonials for HPAI MLM business products which are analyzed based on Islamic business ethics. The results of the study stated that the marketing strategy and giving HPAI product testimonials to consumers in general had implemented the five principles of Islamic business ethics. Among them are the principle of oneness, the principle of justice, the principle of free will, the principle of truth and the principle of responsibility.

Factors Responsible for Joining MLM Business and Relation of Mode of Association with Networker’s Satisfaction

This study focuses on identifying factors responsible for joining Multi-Level Marketing (MLM) business by the networkers and analysis of satisfaction level of networkers with respect to the mode of association with MLM business. A quantitative methodology with a survey technique was used on 305 selected networkers who operate their MLM business from Kanpur city. Factors responsible for encouraging people to join the MLM business as a networker are explored by the factor analytical approach. An independent T-test was employed to test the proposed hypothesis. This study found that earn income for meeting expenses, source of residual income, low investment and low risk, more leisure time, personality development, better lifestyle, enhance social interaction, and helping others are the key factors that motivate the networkers to join MLM business. Moreover, the networkers involved in MLM business through any mode of the association are equally satisfied with this business.

Analysis of Empowerment of Human Resources (Member) in Improving Career Development (Case Study at PT. HNI-HPAI Bussines Center (BC9) Subdistrict Sudirejo 1)

Empowerment which means an effort needed to build power, by encouraging, motivating, raising awareness of the potential that is owned and trying to develop the potential of a member (member). In running a multi-level marketing business, PT.HNI-HPAI cannot be separated from human resources (members). A member (member) will not run optimally without the support of a leader/mentor. The research approach used in this research is qualitative. Research locations are areas or places that will be used as research targets. This research was conducted at PT. Herbal Medicine Alwahida Indonesia (HPAI) Bussines Center 9. Jl. Clean Water, Ex. Sudirejo I Kec. Medan city of North Sumatra Province. Research time for this research was conducted from December 2019 to July. The strategy of the research that can be drawn 1) The upline's active role that nurtures the members can improve the quality and income of members every month. 2) Good communication between members (members) and the upline can increase the target of each member. 3) Fostering a sense of responsibility to all members by giving awards to members who are enthusiastic and motivated to always be active in their membership. And finally, there is a lot of training offered by the leadership / upline to members by holding training as interesting as possible to empower and manage members so that they are superior to members of competing companies. The results of the SWOT analysis that have been obtained in PT HNI-HPAI Business Center 9 Medan is The total score of each of the detailed factors, strength 3.25, weakness 0.15, opportunity 3.23, threat 0.18.

Multilevel Marketing (MLM) business visualizes a business network into a hierarchical tree consisting of relationships between nodes. In its application, a branch is generated from each node which when visualized becomes a tree with a height that continues to increase and will consume space which will have an impact in terms of less than optimal data access. In order for the tree structure to be formed from relationships between nodes with hierarchically ordered data, and to streamline time in the search and data access process, an MLM business process information system was built by applying the Binary Tree algorithm. The concept in the Binary tree itself is a hierarchical organization of several nodes, where each node has no more than 2. Nodes that are under a node are called children of the node. A node above a node is called the parent of that node. A binary search tree is a search in a binary tree by tracing nodes that are placed in the left branch if the information content sent is smaller than the information at the root, or tracing the right branch if the information content is stated to be greater than the root. The goal is to implement sorted data into the information system in accordance with the hierarchy of the MLM system and in this way data retrieval can be done quickly and easily.

Consumer Motivation and Multilevel Marketing on Health Products

Multi Level Marketing (MLM) for healthcare product is one of the dramatic transformations that have emerged in contemporary times with varying behavioral responses. Its increasing acceptance in Nigeria is because people find it an alternative option to addressing diverse health concerns amidst other economic benefits. The study considered multilevel marketing in health with a key focus on the relationship between multilevel health products and continuance intention. Descriptive statistics and SEM statistical tool was employed in the analysis. This study therefore examines the issue of MLM and motivating factors and continued intention to engage in MLM in the health related product categories. An online survey was administered on 227 networkers of MLM in South-East, Nigeria. The data was analyzed using Structural Equation Modeling (SEM) and descriptive statistics. Result shows that Nature Renascence International (NRI), Longrich, and Norland are the major MLM brands. Other not popular brands are Edmark, Tianshi, AIM Global, Forever Living Products, Oriflame, and Neolife. However, the major challenge lies in getting down-liners / new people to register and be part of the MLM business. Analysis shows that wealth benefit is the major motivation to join an MLM despite the promises of health benefits. Specifically, wealth benefit is found to be significantly related to health benefit. The study also provides evidence that there is a nexus between wealth benefit and ethical concern. Also, wealth benefit has a significant effect on continued intention. The recommendation centers on policy-drive and regulation. An appropriate policy that addresses the establishment and operation of businesses that engages in MLM of health products is required. This is paramount in other to curtail unethical practices and sharp practices from MLM businesses. In addition, there is a need for proper regulation. The regulation is required to control the use of unprofessional healthcare personnel in counseling and prescribing health drugs as well as targeting issues of false claims.

Bisnis Multi Level Marketing Pada PT. K-Link Nusantara Di Tinjau Dari Hukum Bisnis Islam

The purpose of this research is to discuss the multi level marketing (MLM) business in terms of Islamic business law, as well as to find out how the business practices carried out by PT. K-LINK and whether K-Link's MLM business practices are in accordance with the DSN-MUI fatwa No 75 / DSN-MUI / VII / 2009. This study used descriptive qualitative method. The data collection techniques used interviews and documentation. Based on the research results it is known that the Multi Level Marketing business practices at PT. K-Link Nusantara, starting from its direct selling practice, marketing and recruiting, bonus distribution and prices have followed the existing Islamic law rules and can be said to be in accordance with the basic principles of the Islamic religion which refers to the Al-Quran, Hadith, and Ijma '. And the MLM business practices of PT. K-Link Nusantara is protected from something that is forbidden such as maisir, ghoror, haram, usury, indecency, dzulm and immorality. The aqad uses aqad al-bai '/ murabahah, aqad wakalah, aqad ju'alah, and aqad ujroh. All of these aqads are adjusted to the contents of the DSN-MUI fatwa Number 75 / DSN-MUI / VII / 2009 concerning the Guidelines for Direct Selling in Sharia Level, so the practice can be said to be in accordance with the DSN-MUI fatwa Number 75 / DSN-MUI / VII / 2009.

A Critical Analysis of Halal Marketing in Malaysia’s Multi-Level Marketing (MLM) Industry

The concept of Halalan Toyyiban is very important in Muslims’ lives in their servitude to Allah. The business itself is broken down into many different kinds, one of those which has become nowadays the trend is Multi-Level Marketing (MLM). MLM business is a business model that involves selling and recruitment of new distributors inside the company. Multi-Level Marketing is seen to be good as it helps many people to achieve their dreams, but ,on the contrary, it is observed as a medium of cheating. With its players reaching 2 million in Malaysia since its establishment in the early 1990s, MLM’s presence in the business industry should not be taken lightly. This research attempts to analyse the current MLM system and its factors that can be categorized as Halalan Toyyiban, as well as the factors which lead to the destruction. This factor includes the system itself, manufacturing, the distribution channels, the after-sales service, and the long-run vision of the company. By doing this, it is aimed that the doubtful (Syubhah) or even the impermissible (Haram) practice of MLM can be eliminated and abstained by the Muslim players, and it is expected that better MLM companies can be established, using proper S.O.P and guidelines. Consumer buying decision towards MLM branded health supplement in Malaysia

With increasing health awareness and demand for health supplements in Malaysia, the purpose of this study is to identify the reasons why consumers in Malaysia choose to buy multi-level marketing's branded health supplements. This study examines the extent of price, membership status, influencer's impact and product attributes towards consumers buying decision of multi-level marketing's branded health supplements. A questionnaire-based survey was used to collect data from 391 consumers in Malaysia and the data was analysed by employing SPSS. The results indicated that price, membership status and influencer's impact have significant positive effect on consumers buying decision, but such effects were not shown by product attributes. The results suggested that the multi-level marketing companies should look more into the development and promotion of the product rather than the method of selling and this is important in developing strategies to be competitive in multi-level marketing business.
