On the Reform and Development of Practice Teaching of Undergraduate Law—Taking the Mooot Court Course as an Example

Legal education has the dual attributes of academic and practical, and cracking the "paradox" between them is the basic problem facing legal education. Undergraduate law education is the basis of law education in China. To improve the quality of training legal personnel, it is necessary to continuously deepen the teaching reform of undergraduate law education. Since the implementation of the national and local excellent rule of law (legal) talent education and training plan, the education model based on the single transfer of theoretical knowledge has been challenged to a considerable degree. After a long period of exploration, the "moot court" has been widely recognized as a "standing course" in undergraduate law education, but problems such as the vague positioning of the "moot court" still exist. Under the situation of "encouraging universities to develop practical teaching courses", undergraduate law education must further improve the undergraduate law practice teaching system through effective measures to reform the undergraduate law practice teaching and promote the development of undergraduate law education in China.

The Practice Innovation of Law Competition from the Perspective of New Liberal Arts

The new liberal arts in the United States and domestic promotion have formed a top-down from the outside to the trend of education reform. Law students, whether undergraduates or postgraduate students, should become the leading force in the construction of new liberal arts. The participation of law students in the competition is mostly limited to moot court, court debate and other oral argument competitions, but the participation in the comprehensive cross-over competition in the new liberal arts background is seriously insufficient. The academic circle pays little attention to the literature presentation of competition research, there is a contradiction between the degree of attention to competition and the conversion rate of teaching reform articles, and the problems existing in traditional competition practice and new problems in the background of new liberal arts are emerging. The practice of legal professional competition has a low degree of embracing and contributing to the new liberal arts. Therefore, in order to improve law students' comprehensive qualities and abilities such as information acquisition ability, writing ability, PPT making ability, expression ability and presentation ability, teamwork ability and leadership ability, risk identification, response ability and resolution ability, contingency ability and scientific research ability through competition practice, Universities and teachers should dig deep into the practice levels and elements of the legal profession, actively guide students to participate in the national business competition of multi-disciplinary integration, and improve the "six-level practice method".

Research on Moot Court Teaching Based on Ability Training

With the continuous development of law education, teaching methods are constantly innovating, including moot court teaching as an effective method of law teaching. Moot court teaching mainly focuses on actual combat simulation, aims at cultivating students’ practical ability, and can better enhance students’ legal literacy and practical ability. Firstly, this paper analyzes the definition and characteristics of moot court teaching, and then discusses the role of moot court teaching in the ability training. At the same time, this paper also points out the challenges of moot court teaching, and puts forward corresponding strategies and countermeasures. Finally, this paper explores the ability training model based on moot court teaching, which provides a new way to improve the quality of law education. Through this study, moot court teaching can improve students’ practical ability and legal literacy, which is worthy of further promotion and application in law education.

Formation des compétences langagières à travers le jeu de rôle Moot court: enseignement du français à des fins spécifiques dans des groupes multilingues

The effectiveness of professional role play in studying foreign languages for specific purposes is the research subject of this paper. For these purposes, the authors studied and analyzed the legal role play, or in other words, the legal competition Moot Court intended for students of legal faculties and institutions as an educational instrument or technology in teaching foreign languages. In the context of higher legal education, role-playing in a foreign language becomes a model close to the future profession since it serves to better understand its particularities and details and become aware of its importance, usefulness, and necessity. The authors showed to what extent and how professional role-playing games contribute to studying and mastering a foreign language, what functions they perform and how they can be used in foreign language classes to obtain greater success in class. The study's main conclusions are based on an analysis of the data obtained following the assessment of the student's knowledge after the experience. The authors are convinced that during the game and its preparation, the participating student carries out many different activities related to learning a foreign language as he acquires knowledge of new lexical and grammatical structures, the syntax of a legal text and its terminology, the skills of dialogic speech and monologue, the ability to express oneself on professional subjects. Due to the motivational nature of the game and its properties of involving a student in a real creative and educational process, the acquisition of new linguistic knowledge occurs very actively and effectively.

The Impact of Moot Courts on the Quality of Legal Education: Students of the Faculty of Law at the Applied Science Private University as a Model

This study was concerned with examining the impact of holding Moot Courts and training students in them on the quality of legal education. It dealt with the historical development of Moot Courts held by the Faculty of Law at Applied Science Private University / Hashemite Kingdom of Jordan, for the period 2003 to 2022, a special questionnaire was structured to examine the impact of these trials on students. The questionnaire contained several questions related to the extent of benefit derived via participating in Moot court. The study sample consisted of 70 graduates who participated in Moot Courts held by the law faculties and are currently working in the legal profession. The study concluded the importance of holding Moot Courts in law faculties and that it has an effective role in developing students' legal skills. Based on the above results, the study recommended that the Moot Courts should be an integrated part of the study curricula by allocating a subject for it to grant all students the opportunity to participate in it, in order to enhance and develop their skills.

Abstract - From 23 to 25 June 2022, the eighth edition of the ‘Laboratorio Romanistico Gardesano’, organised by the Universities of Milan, Rome 'Sapienza', Trento and Verona, was held in Gargnano (BS). The first part of the event was dedicated to the ‘Moot court competition’, a competitive trial simulation in Roman law aimed at first-year law students. In the second part, the doctoral seminar took place in which many young scholars had the opportunity to present and discuss their research results with a specialist audience.

Analysis of the Training Paths for Foreign-Related Legal Talents: From the Perspective of International Humanitarian Law Moot Court

The Department of International Law of China Foreign Affairs University has established a relatively effective moot court training model and system in the long-term practice of the excellent foreign-related legal talent training project. As one of the distinctive and influential competitions, the International Humanitarian Law (IHL) Moot Court has been proven to be an effective education method for cultivating foreign language-savvy, high-quality compound and application-oriented legal talents for international organizations. Based on years of experience, the IHL Moot Court of China Foreign Affairs University emphasizes the ability and potential of the students in English, law, and teamwork when selecting team members, and respects student self-governance and teamwork during preparation and competition. There is a relatively mature moot court talent training model in the IHL Moot Court.

Research on Case Studies: A Concise Guide on International Law Case Studies

Under the legal education environment in China, it seems that it is very difficult to carry out case study reform directly among undergraduates. Although many universities have tried it, the effect is not as expected. The case study at the postgraduate stage has significant advantages. Postgraduates have an adequate knowledge base, and the course structure is more flexible. The case study is helpful to cultivate the independent research ability of postgraduates. In the International Law Case Study (the “Course”) with the case study as the core, the aim of the course is to strengthen the communication and discussion between teachers and students, and promote the teaching process through guided questioning. The Course uses two models, i.e. case analysis and moot court. Correspondingly, the Course has also formed distinctive teaching methods such as the list of key issues, statement and presentation, and question-based teaching methods.

Network interaction in student organizations before and after COVID-19 pandemic start

The COVID-19 pandemic since 2020 provoked the shift to remote functioning in a range of organizations, causing the change of formal and informal interaction networks in the organizations. The paper outlines the research results of the outcomes of such shift from offline to remote functioning in three student organizations at NaUKMA: “Ta Mohylianka” (TM), “Kyiv Mohyla Moot Court Society” (KMMCS) and “Buddy NaUKMA” (Buddy). The survey data on the network interaction in ТМ and KMMCS were collected in March 2020 before the shift to the remote mode, and after a year another wave was conducted in March 2021 to collect the data from these two organizations and another third organization, Buddy. This enables us to trace the change in informal networks due to the remote mode of communication a year after the pandemic started. As a result, we reveal that the informal interaction and friendship in organizations increased after the shift to remote mode when we focus on the actors who were in the organizations both before and after the pandemic started. Thus, they sustained and strengthened their informal ties that they formed in offline format prior to COVID-19 (this is observed both for TM and KMMCS). However, with new actors joining the organizations in 2021, the average ties strength for friendship networks declined for KMMCS. Moreover, the attribute of faculty that defines the work processes in Buddy caused higher average tie strength for friendship network within a faculty, but much lower between faculties. In contrast, TM as an organization also joins students from all the faculties, but its work processes are not overlapping with the boundaries of one faculty, so the friendship ties formed actively in groups that are heterogeneous by faculty attribute. In addition, we found that the level of integration of actors into the organization informal networks is partly interrelated with how the staff assess the efficiency of communication in the organization. The last outcome requires further checking with alternative tools and a more detailed scale to assess the efficiency of communication in the organization. For practical reasons, this also sheds light on the improvement of organizations functioning when the remote or mixed modes of work are planned to be applied in 2022–2023 academic year due to the wartime in Ukraine.

Along with the development of Sharia Economic law, disputes arise, as for Law Number 3 of 2006 jo. Law Number 21 of 2008, the authority to adjudicate sharia economic disputes by litigation. While this non-litigation program provides students with the Islamic Economics Law and Family Law Faculty of Sharia IAIN Pontianak in addition to developing themselves. On this basis, researchers are interested in exploring the engineering of the Sharia Faculty curriculum.

This research is qualitative. juridical-sociological approach, observation and interview data collection techniques. Analysis of the data using descriptive analysis-analysis with a deductive pattern.

Abstract Scholarship has generally represented moot court competitions in one of two ways: either as a beneficial way for students to develop practical skills prior to the Bar, or as a reproducer of hierarchy and exclusion. This review essay attempts to plot a third way of thinking about moots, one that finds critical potential in the exercise of mooting while remaining attentive to its conservative biases. Building out from a critique of the common law focus of Thomas and Cradduck’s The Art of Mooting, the essay reflects on how critical approaches to international law can be used to teach moot skills more effectively. The essay then turns to the limitations such a critical pedagogy must be aware of within the actual practice of the competition, considering how these limits can be navigated and even flipped into teachable moments for critically inclined students. The essay closes with a call for a more nuanced discussion about the use of experiential learning, of which moots are only one example, for fostering critical engagement with international law.
