Comparative Legal Research on Same-Sex Marriage between China and Ireland

The successful legalization of same-sex marriage in Ireland has provided a model for the legalization of same-sex marriage in China. The process of legalizing same-sex marriage in Ireland began in 1993 when Ireland decriminalized private and consensual sexual activity. It took 22 years for Ireland to achieve success in legalizing same-sex marriage through a nationwide referendum in 2015. Due to differences in history, culture, religious beliefs, and social systems, China may not be able to replicate the exact experience of legalizing same-sex marriage in Ireland. However, China can still learn from a comparative study and draw valuable lessons to protect the marriage rights of the homosexual population in China. China can benefit from these experiences by implementing similar initiatives to educate the public and promote LGBTQ+ rights. By raising awareness, dispelling stereotypes, and fostering dialogue, China can gradually overcome social stigmas and create a more inclusive environment for its LGBTQ+ community. Additionally, legal frameworks and protections can be established to ensure the equal treatment of same-sex couples. Irish legislation not only legalized same-sex marriage but also granted same-sex couples the same rights and benefits as heterosexual couples, including adoption and inheritance rights. China can examine these legal provisions and adapt them to its own context, working towards creating a fair and equitable legal framework for same-sex couples. Furthermore, engaging in international dialogue and cooperation can also be beneficial for China's path towards legalizing same-sex marriage. Learning from the experiences of other countries, including Ireland, and collaborating with international organizations can provide valuable insights and support. In conclusion, while China may not be able to replicate Irish exact path to legalizing same-sex marriage, it can draw inspiration and learn from Irish experiences. By promoting awareness, fostering dialogue, enacting inclusive legal frameworks, and engaging in international cooperation, China can work towards protecting the marriage rights of its LGBTQ+ community and creating a more inclusive society.

The gender politics of marriage in Ireland

It is rare that a book's dedication is quite so apposite to its theme as Maria Luddy and Mary O'Dowd's in their new history of marriage, which reads: ‘For Mary Cullen and Margaret MacCurtain who began it all.’ Indeed, they did, and this tour de force is a fitting testament to the significance of that women's history project started in the 1970s, which has ‘paved the way for all of us who engage with Irish gender history’ (p. xiii). Luddy and O'Dowd, both pioneers in the field in their own right, set themselves the not inconsiderable task of producing ‘an extended study of the history of heterosexual marriage on the island of Ireland from 1660–1925’ (p. 1). The result is a rich, colourful, at times playful, but also often depressing, five-hundred-and-fifty-page study of the most popular sexual bond between men and women in history — marriage. Indeed, that complex institution was obviously on the historical mind because Diane Urquhart's erudite study of Irish divorce from 1800 to 1997 and Sonja Tiernan's deftly navigated history of the marriage equality campaign in Ireland were also published in 2020.

Unrecognised Muslim Marriage in Ireland: Incidence and Implications

This article considers the incidence and implications of “nikah-only” marriages in Ireland, that is, marriages which are conducted according to the rites of the Islamic faith but which do not conform to the legal formalities for marriage under Irish law and thus are not legally recognised. Despite a growing Muslim population in Ireland, little is known about Muslim marriage practice in this jurisdiction and no empirical research on this topic has been conducted to date. Without specific data on the phenomenon of unregistered marriage, this article relies on an examination of the Irish legal formalities for marriage and available statistics on marriage in Ireland to hypothesise about the potential incidence of unregistered Muslim marriages in the jurisdiction. Although the formalities for religious marriage in Ireland are not particularly onerous, it is argued that it is likely that Muslim marriages which do not meet the requirements for legal recognition are occurring. This article will identify some of the legal consequences for couples whose marriage is unrecognised and highlight the need for awareness-raising about Muslim marriage practices in Ireland so that the Muslim community are fully aware of both the significance of seeking legal recognition for their marriages and the challenges inherent in ensuring that their marriage will be legally recognised.

Geographies of heteroactivism: Resisting sexual rights in the reconstitution of Irish nationhood

Legislative and cultural changes have produced significant shifts in sexual and gender rights. Although this has been extensively studied in relation to those who have “won” and in relation to the normalisations that these changes create, there is little scholarship on the emergence of new resistances to Lesbian, Gay, Bisexual and Trans equalities. We employ the term heteroactivism to name the ways that resistances to sexual and gender rights have moved from vilifying “the homosexual,” towards more subtle and nuanced resistances in places with sexual and gender equalities legislation. Geography is key because legislation and its enactment varies spatially, and national legislations and imaginings recreate distinctive, place‐based heteroactivism. Paying attention to the ideologies of those who opposed same‐sex marriage in Ireland's 2015 referendum, this paper explores how the boundaries of Irishness were central to heteroactivist campaigns, drawing on specific invocations of relatedness between a female child and her mother, the quintessential Irish Mammy. Using a close reading of the textual and visual elements of a “Vote No” poster, the paper elucidates the presences and silences of new forms of resistances that seek to recuperate what was once not only “common sense” heterosexuality, but also seen as the essence of Irishness. In doing so, the paper extends understandings of sexuality–gender–nation–state nexus by critically interrogating the ideologies of those who contest progressive state sexual and gender legislation.

Debating Human Rights, by Daniel P.L. Chong

Reviewed by : Gillian McFadyen, Aberystwyth UniversitySince beginning of 2015 alone, international news has been dominated by debates on human rights, be it migrant deaths on Mediterranean sea, threat of Boko Haram and Islamic State to regions in Africa and Middle East, attacks on right to freedom of speech and freedom of religion as in case of Charlie Hebdo and Bangladeshi bloggers, or recent and vote on gay marriage in Ireland. Human rights are continuously being challenged, debated, and in many instances, threatened. Although we are heading into seventh decade since signing of Universal Declaration of Human Rights (UDHR) in 1948, human rights remain a contentious issue within international politics.Accordingly, Daniel P.L. Chong's Debating Human Rights is a welcome intervention. The ethos of book is to challenge dialogue surrounding human rights by offering critical and creative engagement with how we understand, implement, and uphold them. Chong reminds us that the boundaries of what we call 'human rights' are still shifting and open to interpretation (242). Through his work, he challenges traditional approach and aims to create new spaces to debate.The book is divided into four parts: global human rights system; civil and political rights; economic and social rights; and a concluding part on advancing human rights through debate. Across these four parts, Chong has written 14 chapters, allowing book to cover a wide array of content that is historical, theoretical, and empirical in nature. The first seven chapters address global human rights system and provide reader with a brief overview of main histories, institutions, philosophies, and responsibilities within human rights debates. Part two, on civil and political rights, has four chapters that treat in depth a key human rights debate. One chapter is dedicated to terrorism, one to freedom of speech, one to right to an abortion, and one to female circumcision. Part three, on economic and social rights, includes chapters dedicated to food, housing and health care, transnational corporations, right to health, and a final discussion on states and foreign aid. The concluding part raises a call to advance human rights through debate (241). The disputes surrounding human rights are still as important, 70 years on from UDHR, and Chong emphasizes that many roadblocks to progress remain; thus need to continue debating human rights.Each chapter provides an introduction to a human rights and then adopts two opposing arguments, which Chong describes as more than opinions; they are making theoretical and empirical claims about how world really works (3). In developing arguments, Chong tends to ground debates within standard international relations theories: realism, liberalism, and constructivism. …

A yes vote would legalise same sex marriage in Ireland. As the Irish premier put it, the vote was about “tolerance, respect and sensitivity.” The electoral outcome turned out to be 62.07% for the yes vote with voter turnout at 60.52% of the registered voters. Ireland thus became the first country in the world to legalise same sex marriage through a popular vote. Using hourly Google Search data one week prior to the Irish Referendum of May 22, 2015 and a simple ratio of “vote yes” to “vote no” searches I demonstrate how the outcome could have been predicted on the nose. The method is used here successfully for the second time and is so far as I know the only one which forecasts popular vote with Google Search.

Legalising Divorce in the Republic of Ireland: A Canonical Harness to the Legal Liberation of the Right to Marriage Among the Disenfranchised

The history of marriage as an institution in the Republic of Ireland cannot be looked at without understanding and appreciating its historical Catholicism and the role that the politically-systematised Roman Catholic Church in the public and private guardianship of marriage as both a religious sacrament and a contractual obligation carrying legal rights and duties. The sacrament of marriage in the Roman Catholic tradition contains spiritual and contractual elements, thus inviting conflict between goals and obligations encompassed in the two marriage perspectives. The sacramental qualities surrounding the marriage contract and its basis in canon law proffered the canonical foundations on which Ireland based its Constitution. In essence, marriage and the rights to it were (are?) a dual institution that creates a religious sacrament and legal contract and the subsequent overlap of Canonical and Constitutional doctrines in Irish marriage law. This Essay grapples with the issue of divorce and its significant role in impeding the right of marriage in Ireland. Prior to the 1996 constitutional amendment legalising divorce, individuals were effectively caught between the anvil of the Church and the hammer of the State.

‘Changing Marriage? Messing with Mr. In-Between?: Reflections upon Media Debates on Same-Sex Marriage in Ireland’

This article explores some aspects of the emergence of local debates around same-sex marriage in the Republic of Ireland. Taking up this issue through an analysis of Irish (local) mediatized reactions to the introduction of German gay marriage in 2001, I point to how we can see some evidence of a shift away from Irish traditional relationships between the social, politics and religion, which served to police and silence much public discussion about sexuality. While prudery about sexual issues still remains, my paper points to the emergence of prudent-yet-tolerant sharing of stories about the social exclusion of same-sex couples. In spite of recent setbacks for a legal case seeking the recognition of a foreign same-sex marriage in Ireland, we may point to a growing political and legal consciousness for the extension of rights for lesbian and gay couples but it is still unclear as to what model will be adopted in the Irish context. While in the Irish case, there is only intermittent media interest in ‘gay marriage’, we can locate this struggle within the framework of the sociology of intimate citizenship. Not only do claims for same-sex marriage illustrate pointed inequalities experienced by lesbians and gay men, the stories also problematize the naturalness of heterosexuality. The Irish case may, of course, be explored within the context of a global challenge to gender identity where the imagined same-sex couple enjoy some element of certainty in an uncertain world.

Religious Intermarriage in Dublin: The Importance of Status Boundaries between Religious Groups

Intermarriage has long been recognized as one of the most robust boundaries between groups. This continues to be the case in the Republic of Ireland for inter marriage between Catholics and Protestants. This paper uses data from the Census of Population (1991) and loglinear modeling to examine religious, edu cational and class homogamy in Dublin. The main question which is posed is whether there is any evidence of social exchange between the characteristics of religion and level of education or class, which husbands and wives bring to their marriages. This question is a development on research on social exchange in eth nic and racial intermarriage. It is particularly interesting to look at the possibil ity of this type of exchange in marriage in Ireland given the traditional differ ences in social status between the religious groups. Our results show that the association between (i) the educational levels and (ii) the current class of hus bands and their wives is weaker for marriages of the type Catholic husband/Protestant wife than it is for homogamous Catholic marriages. Protestants still enjoy high status and this appears to make it easier for Protestant, compared to Catholic, women of low education or manual class to marry Catholic husbands of high education or professional class. A knowledge of the status dimension to religious groups can therefore contribute to our under standing of the pattern of religious intermarriage.

Fertility control early in marriage in Ireland a century ago

Data were extracted from the 1911 Irish manuscript census to study the regional variation in the extent and character of family limitation strategies in Ireland a century ago. Regression analysis of the data shows evidence of ‘spacing’ in both urban and rural Ireland. Further analysis of the so-called child ‘replacement’ problem also produces results consistent with ‘spacing’.

"This paper deals with delayed marriage and singlehood among the Irish as a focus for the study of the persistence of ethnic characteristics. Patterns of delayed marriage in Ireland in the nineteenth and twentieth centuries are reviewed, and evidence is also presented that Irish persons in other countries (especially in the United States) continue to show significantly higher rates of singlehood and postponed marriage than persons of other nationality groups. Discussion includes how delayed marriage became common in Ireland during the past 150 years and what may be involved in the apparent persistence of this pattern today in Ireland and among the Irish in other countries."

Age, region and marriage in post-famine Ireland: an empirical examination.

T THIS article examines the connexions between conditions in the rural economy of Ireland and marriage during the post-famine period from I 85 I to I9 I1. A number of previous studies have posited such connexions in several Western agrarian societies.1 Kennedy has noted, however, that because changes in marriage variables during the post-famine period were so dramatic there, Ireland can serve as a test case for hypotheses with more general, though less extreme, relevance.2 Such an orientation is adopted in the following examination of factors affecting marriage in Ireland, which attempts to use more systematic analytical techniques than most previous work on the problem.
