Digital Transformation in Jordan and Poland - Implications on the Legal Protection of Cultural Heritage and Sustainable Development

This paper aims to clarify the principles of Jordanian and Polish copyright laws applicable to the preservation of cultural heritage, and to recommend the adoption of certain policies to facilitate this task. It is meant to serve as a guide for stakeholders who deal with digital cultural heritage, directed particularly at museums, but also institutions such as libraries, archives, and art galleries. The research aims to discuss the role of copyright law in protecting cultural heritage in the face of the rapid development of ICT technologies. This includes identifying the risks and challenges associated with digital heritage, framing the relationship between authors of digital cultural content, rights holders, and institutions responsible for documenting and preserving it, and the need to establish a fair mechanism that guarantees their rights. The study aims to provide a presentation of the importance of compliance with copyright principles related to the digitization of cultural heritage and other relevant regulations in the Jordan region and the Polish legislation. The article was created as a result of international scientific cooperation in combination with an innovative view at the law-making and application processes in the era of dynamic development of science and technology. The analysis will include identification of legal acts, which aim to ensure the effective, future-oriented, and long-term protection of cultural heritage in Jordan and Poland.

ЗБЕРЕЖЕННЯ КУЛЬТУРНОЇ СПАДЩИНИ УКРАЇНИ В УМОВАХ ВІЙНИ: ПРАКТИКИ МІЖНАРОДНОЇ ВЗАЄМОДІЇ

The article deals with the experience of preserving cultural heritage in the armed conflict in Ukraine and international cooperation in this field. The historical reconstruction of the legal protection of cultural heritage is carried out. It is indicated in the article that during the 19th century, international legal bases for the preservation of cultural heritage were actively developed. However, in the 20th century, two world wars brought significant destruction of cultural heritage by all parties of the conflict. And the optimism of the Europeans of the 19th century regarding a civilized attitude to cultural heritage was destroyed, although the work on the creation of international normative documents in the field continued and international organizations were founded that took care of cultural heritage. In the 21st century, the previous trends persist. Such reconstruction can become the context for the Ukrainian situation. To clarify it, the method of situational analysis is used. The situations with the Hryhorii Skovoroda museum in the village of Skovorodinivka in the Kharkiv region and the Ivankiv Local History Museum unfold in time and space and focus the theoretical framework. In the article, the author addresses the problem of the biography of a place, which is relevant in modern social sciences and humanities. Despite objections to anthropomorphization, scholars emphasize the close link of places and human destinies there. Skovorodinivka ceases to be exclusively a place of memory of an outstanding Ukrainian philosopher and becomes evidence of the attitude towards the object of cultural heritage in the current war. The article shows that in Ukraine today, the war is blurring the "battlefield" and military actions are spreading to the territory where the civilian population and cultural heritage sites are located. The striking difference in the attitude towards the cultural heritage of mankind during the military conflicts of the optimistic modern XIX and the postmodernist relativistic XX centuries illustrates the loss of position by modern phenomena. The situation with the Hryhorii Skovoroda museum testifies that today international aid comes for the preservation of the destroyed cultural artifacts. International cooperation is also essential in the issue of digitizing the cultural heritage of Ukraine and creating conditions for its preservation. The Principle of Sustainable Development as the Basis for Weighing the Public Interest and Individual Interest in the Scope of the Cultural Heritage Protection Law in the European Union

The concept of sustainable development is widely used, especially in social, environmental and economic aspects. The principle of sustainable development was derived from the concept of sustainable development, which appears in legal terms at the international, EU, national and local levels. Today, the value of cultural heritage that should be legally protected is indicated. A problematic issue may be the clash in this respect of the public interest related to the protection of heritage with the individual interest, expressed, e.g., in the ownership of cultural heritage designates. During the research, scientific methods that are used in legal sciences were used: theoretical–legal, formal–dogmatic, historical–legal methods, as well as the method of criticism of the literature, and legal inferences were also used. The analyses were carried out on the basis of the interdisciplinary literature on the subject, as well as international, EU and national legal acts—sources of the generally applicable law. Research has shown that the interdisciplinary principle of sustainable development, especially from the perspective of the social and auxiliary environmental aspect, may be the basis for weighing public and individual interests in the area of legal protection of cultural heritage in the European Union. It was also indicated that it is possible in the situation of treating the principle of sustainable development in terms of Dworkin’s “policies” and allows its application not only at the level of European Union law (primary and secondary), but also at the national legal orders of the European Union Member States.

Entry in the register of monuments as a form of administrative and legal protection of cultural heritage in Poland – legal and practical aspects

The aim of the article is to characterize entry in the register of monuments as a statutory form of administrative and legal protection of monuments in Poland and to identify regional disparities (differences) in the practice of implementation of entry in the register of monuments in provinces, as at the end of June 2018. The thesis was put forward that entry in the register of monuments is an important way of protecting cultural assets in Poland after 2003, while the practice of use of the identified administrative and legal form of monument protection may testify to the particularly rich historical stock of some Polish provinces. Entry in the register of monuments is a necessary administrative and legal measure for protection of monuments in a democratic state that takes care of the development of cultural resources. The condition of culture depends largely on protection of monuments. Monuments in Poland are characterized by significant diversity in terms of geographical distribution and costs of their protection.

Formation and development of legal protection of cultural heritage in Ukraine

Метою статті є аналіз становлення та розвитку пам’яткоохоронного законодавства в Україні.
 Наукова новизна статті полягає в аналізі основних законодавчих і підзаконних актів України, завдяки яким відбулося реформування сфери охорони культурної спадщини в Україні та приведення її у відповідність до міжнародних норм і стандартів.
 Висновки. У законодавчому забезпеченні охорони культурної спадщини України можна до певної міри умовно виділити кілька етапів. Перший розпочався із прийняттям Декларації про державний суверенітет України від 16 липня 1990 р., яка започаткувала зміну державних підходів до культурної спадщини України, задекларувавши культурне відродження українського народу й необхідність повернення національних, культурних та історичних цінностей України, що знаходяться за її межами. Водночас базовим актом стали Основи законодавства України про культуру від 14 лютого 1992 р. Саме Основи законодавства України про культуру визначили правові засади діяльності органів публічної влади у сфері охорони культурної спадщини, а також започаткували процес формування Державного реєстру національного культурного надбання. Конституція України від 28 червня 1996 р. більш послідовно, у порівнянні з Конституцією УРСР, забезпечила гарантії культурних прав громадян та обов’язки держави щодо охорони культурної спадщини. На цьому етапі було ратифіковано ряд міжнародних актів у сфері охорони культурної спадщини, а також прийнято національні законодавчі й підзаконні акти, спрямовані на імплементацію цих норм у національне законодавство України, зокрема Закон України «Про вивезення, ввезення та повернення культурних цінностей» від 21 вересня 1999 р. Другий етап розпочався з ухваленням Закону України «Про охорону культурної спадщини» від 8 червня 2000 р., в якому враховані основні тенденції міжнародно-правового забезпечення охорони культурної спадщини, зокрема положення Конвенції ЮНЕСКО про охорону всесвітньої культурної і природної спадщини 1972 р. Законом урегульовані права та обов’язки суб’єктів охорони культурної спадщини, а також порядок формування Державного реєстру нерухомих пам’яток України за категоріями національного й місцевого значення. На цьому етапі ухвалені й такі важливі нормативні акти, як Закон України «Про охорону археологічної спадщини» від 18 березня 2004 р. і Загальнодержавна програма збереження та використання об’єктів культурної спадщини на 2004–2010 роки, затверджена Законом України від 20 квітня 2004 р. Третій етап розпочався з ухваленням Закону України «Про культуру» від 14 грудня 2010 р. і триває донині. На цьому етапі ухвалено ряд важливих змін до законодавства, спрямованих на приведення українського пам’яткоохоронного законодавства до міжнародних норм і стандартів, зокрема щодо збереження пам’яток культурної спадщини, включених до Списку всесвітньої спадщини ЮНЕСКО.

International Legal Protection of Cultural Heritage in Armed Conflict: Achievements and Developments

The recent statement by President Donald Trump, according to which he was ready to strike at 52 sites in Iran – some of them of primary cultural importance – in response to possible attacks against United States targets in the aftermath of the killing of General Soleimani, has been met with outrage by many international observers, while the Pentagon hastened to distance itself from ‘its’ President. These reactions shed light on the fundamental importance that the international community presently attaches to the safeguarding of cultural property in times of armed conflict, in particular that property of outstanding universal value that should be considered part of the world cultural heritage, such as the many Iranian sites that provide testimony of some of the most ancient civilizations. This paper will first summarize the existing legal framework for the protection of cultural property in times of war and the main problems associated with it. That framework will then be revisited in light of the various developments arising from the normative and judicial practice which has emerged, to an unprecedented extent, in the context of recent cultural crises and tragedies caused by armed conflict. Developments relating to customary law, individual criminal responsibility and the activities of the UN Security Council in this area are especially analyzed. The paper concludes that, ultimately, all conditions are in place for the protection of cultural heritage in armed conflict to take further steps forward, for example by strengthening the ban on the use of cultural property for military purposes, or by increasing the legal and political synergies between UNESCO’s work, chiefly in safeguarding the world heritage, and that of the institutions most involved in the military and humanitarian field.

PROTECTION OF CULTURAL HERITAGE AND THE ROLE OF CULTURE IN PROMOTING EUROPEAN INTEGRATION

This article analyzes the legal protection of cultural heritage, and the role of cultural heritage, in the promotion of integration into the European Union. Within the legal field, the notion culture derived from the preamble of the UNESCO Universal Declaration on Cultural Diversity is considered as a fundamental norm; which is contrasted from the perspective of International Law, and subsequently, under the legal framework of the European Union, in order to understand the role of culture in promoting integration within the European Union.

Próba oceny nowych rozwiązań w zakresie karnoprawnej ochrony dziedzictwa kultury

New solutions in the field of cultural heritage protection law: an assessmentIn the years 2017–2018, new regulations appeared in the system of criminal legal protection of cultural heritage. It seems that some of them should significantly strengthen the protection of cultural heritage, in particular the increasing of penalties for the destruction of monuments, as well as the determination that carrying out searches for monuments without appropriate permission is treated as a crime since 2018. Unfortunately, the significant dispersion of criminal laws and the lack of an appropriate chapter in the penal code which would refer to crime against cultural heritage is still a serious drawback of the functioning system.

Джерельна база дослідження правової охорони культурної спадщини в Україні

Правова охорона культурної спадщини в Україні хоча й не така давня як, приміром, у Франції, проте має власну столітню історію. За цей час сформувалася досить значна джерельна база, яка істотно збагатилася за роки державної незалежності України. Разом із тим спостерігається певна тяглість не лише політики у сфері охорони культурної спадщини, а й відповідних правових джерел. Як наслідок, увесь масив правових джерел з питань охорони культурної спадщини потребує не лише докладного вивчення, систематизації та узагальнення, а й, зрештою, критичного переосмислення.Метою статті є здійснення класифікації джерельної бази правової охорони культурної спадщини в Україні та стислий аналіз окремих видів джерел.Наукова новизна полягає у виділенні й аналізі основних джерел правової охорони культурної спадщини в Україні, передусім міжнародно-правових документів та національних актів законодавства. Розглянуто як джерела права охорони культурної спадщини, так і джерельну базу дослідження. Здійснено класифікацію джерельної бази правової охорони культурної спадщини в Україні. За результатами дослідження виділено чотири основні види джерел.Висновки. Класифікація джерельної бази правової охорони культурної спадщини в Україні базується на поширених класифікаціях джерел права і виділенні основних видів писемних джерел, які застосовуються у джерелознавстві. У нашому дослідженні виділено такі види джерел: 1) національні нормативно-правові акти; 2) міжнародно-правові акти; 3) довідкову літературу, зокрема енциклопедії та словники, путівники та довідники, каталоги та бібліографічні покажчики тощо; 4) аналітичні записки, звернення, заяви, інформаційні повідомлення, листування органів, уповноважених на вироблення та здійснення політики у сфері охорони культурної спадщини, а також пам’яткоохоронних громадських організацій, товариств тощо.

Правова охорона культурної спадщини в Україні: стан дослідження проблеми вітчизняними вченими

Метою статті є аналіз праць українських вчених, присвячених питанням правової охорони та збереження культурної спадщини, їх систематизація і виділення основних напрямків дослідження.
 Наукова новизна полягає в комплексному аналізі стану дослідження питань правової охорони культурної спадщини українськими вченими з часу здобуття незалежності України. Проаналізовані наукові праці систематизовано за проблемним принципом і виділено основні напрямки досліджень. Доведено, що питання правової охорони культурної спадщини досліджувалися не лише вченими-правознавцями, а й представниками суміжних галузей науки – фахівцями з державного управління, міжнародних відносин, історії, культурології, політології та ін.
 Висновки. Аналіз праць українських вчених дає підстави стверджувати, що питанням охорони та збереження культурної спадщини за роки незалежності України присвячено кілька десятків монографій і дисертаційних досліджень, кількість наукових статей вже перелічується сотнями, ще більше оприлюднених наукових повідомлень і тез виступів на міжнародних і всеукраїнських наукових конференціях, семінарах та інших наукових і експертних форумах. При цьому проблематика правової охорони культурної спадщини досліджувалася не лише вченими-правознавцями, а й представниками суміжних галузей науки – фахівцями з державного управління, міжнародних відносин, історії, культурології, політології та ін.
 Аналіз наукових праць дав змогу виокремити такі основні напрямки наукових досліджень:
 1) узагальнюючі й теоретичні праці з питань охорони культурної спадщини;
 2) праці, присвячені міжнародно-правовій охороні культурної спадщини; діяльності міжнародних організацій та інституцій; питанням реституції об’єктів культурної спадщини;
 3) праці, присвячені зарубіжному досвіду законодавчого забезпечення та політиці держав/держави у сфері охорони культурної спадщини; порівняльні дослідження зарубіжного й українського законодавства;
 4) праці з конституційного й адміністративного права України, пов’язані із забезпеченням культурних прав людини, політикою держави та діяльністю національних інституцій у сфері охорони культурної спадщини;
 5) праці, присвячені проблемі відповідальності (адміністративної, кримінальної, цивільної) за порушення законодавства у сфері охорони культурної спадщини;
 6) праці, які висвітлюють регіональні особливості правової охорони культурної спадщини в Україні.

Методологія дослідження правового забезпечення охорони культурної спадщини в Україні.

У статті висвітлюються основні методологічні підходи до дослідження питання правової охорони культурної спадщини в Україні. Охарактеризовано принципи і методи наукового дослідження, розкрито їх роль у процесі висвітлення особливостей правової охорони культурної спадщини в Україні.

Legal regulations in the field of cultural heritage protection in Poland after 1989 – evaluation attempt

This article attempts to analyze the legal regulations developed in the field of cultural heritage protection after 1989, with particular reference to the acquis after 2003. A thesis has been formulated that the period after 1989 was characterized by a clear redefinition of objectives and priorities in the field of cultural heritage protection compared to the period of the People’s Republic of Poland. To prove the thesis, the author referred to legal acts and jurisprudence, as well as to literature based on studies and articles from scientific journals on the legal protection of monuments. The research methods used were the legal acts analysis method and the literature analysis method. The presented content shows that the issue of legal protection of cultural heritage in Poland after 1989 was treated as one of the most important aspects of the long-term cultural policy of the state, although the work on the new law lasted for a relatively long time, 14 years after the political and structural transformation. The 2003 Act regulated a number of important issues regarding the protection of monuments and the care for monuments, redefining, and in many aspects setting, new directions in the field of cultural heritage protection in Poland. At the same time the legislator rejected the possibility of continuing the direction in this sphere, which had been chosen in the period between 1944 and 1989.

Legal protection of cultural heritage in China: a challenge to keep history alive

This article provides an in-depth examination of the current Chinese legal regime for cultural heritage protection from two perspectives, i.e. from that of legislation and law enforcement and highlights the deficiencies thereof. The article argues that China has to improve and reform its domestic law to rectify the blatant shortcomings of the existing statutes and to implement the international instruments that it has concluded or acceded to; Moreover, China should reform its administrative system of cultural heritage protection to overcome the obstacles to efficient law enforcement whose success, in turn, depends on the comprehensive reform promised by the Communist Party of China.

Law and the Politics of the Past: Legal Protection of Cultural Heritage in Greece

AbstractThis article examines the main lines of Greek legislation on antiquities and on cultural heritage in general, in the course of its history, with an emphasis on the innovations and continuity of the current Law 3028 of 2002. It attempts to place the Greek case in the context of the relevant international experience and the broader debate about ownership of the past. It throws light on the relationship between the legal framework of antiquities and the formation and fostering of national identity in Greece, and on their close connection with the state, while at the same time criticizing the view that opposes a “cultural internationalist” approach to heritage to the “cultural nationalism” of Greece and other source countries.

Cultural Heritage, Human Rights and Development: Coincidences, Ambiguities and Disagreements

Based on the analysis of two legal experiences that took place in Mexico and Peru, this article examines the way in which the development of the legal protection of cultural heritage is related to the concepts of cultural rights and sustainable development. On one hand, a recent reform to the Mexican Constitution, which acknowledged the access to cultural rights, imposes the need to clarify its definition and the way it should be articulated. On the other hand, Peru recently issued two laws in order to promote investments in public and private works, which shows us that many Governments do not understand that cultural heritage protection and sustainable development can be complementary.
