The paper focuses on big data and healthcare pharmaceuticals, which pose both great promise and challenge as they can contribute to well-being and deliver innovation and knowledge to next-generation healthcare products. This paper provides an overview of the benefits that machine learning and big data technology contribute to healthcare systems. Realities such as patient and healthcare professional demands, the number of diseases, insufficient drugs, regulations, legal and ethical guideline restrictions, modus operandi, and technology development take place in the healthcare sector. In addition, big data opportunities and challenges for healthcare companies, research, and healthcare infrastructure are discussed. Finally, a vision of health innovation through personalized medicines as well as smart medicine is presented as a step closer to patients through regulatory, legal, and ethical guidelines, applications, and opportunities that need to be regulated and resolved.

Gas Box Exhaust Design Modification for Accidental Hazardous Gas Releases in Semiconductor Industry

Hazardous substances such as hydrogen and chlorine are used in semiconductor manufacturing. When these gasses are discharged, they are mixed with outside air and are connected to a treatment facility through a duct inside a gas box. This study investigated an optimal exhaust design to prevent fire explosions and toxic exposure by optimizing the exhaust volume when hazardous substances leak from the gas box of semiconductor manufacturing equipment. In this study, carbon monoxide was used for modeling. A 75 mm duct was used, and the tracer gas was released into the gas box at 15.4 LPM. The concentrations were measured at nine points inside and outside the gas box. According to the test results, in an experiment designed with 0% air intake, the internal leakage concentration was measured to be more than 25% of the LEL (lower explosive limit) for 10 min when leakage occurred due to stagnant flow, and the outside toxicity concentration was also measured to be more than 50% of the TWA (time-weighted average) value. When the air intake ratio was designed to be 100%, there was a point on the outside that exceeded 50% of the TWA, confirming that excessive air intake could also cause gas to leak outside. Finally, when the intake ratio was designed to be 50% in both directions, it was confirmed that the airflow was maintained smoothly, and the hazardous gasses were safely diluted and discharged through the duct. This study was conducted to improve the safety of workers in the field in the event of leakage of flammable and toxic gasses by testing the location and area of the air intake hole in the gas box exhaust port. Through this effort, the aim is to present specific standards for gas box design and to assist in establishing a legal framework or standardized guidelines.

A REGULAMENTAÇÃO DA INTELIGÊNCIA ARTIFICIAL E SEUS IMPACTOS NO DIREITO

The introduction of this research deals with the regulation of artificial intelligence (AI) and its impacts on the Brazilian legal system, with an emphasis on the areas of civil, criminal and labor law. The study analyzes how the growing presence of AI in social and economic relations requires the creation of legal guidelines that protect fundamental rights, such as human dignity, privacy and equality. In civil law, issues of liability for damages caused by AI, protection of data and automated contracts. In criminal law, the focus is on the use of AI both to prevent crimes and to commit illegal acts, which requires the creation of specific regulations to prevent abuses and guarantee criminal liability. In relation to labor law, the research explores how automation driven by AI can transform the job market, threatening jobs and increasing the need for legal protections for workers. The research adopts an integrative literature review methodology, seeking to identify the main challenges and risks associated with the use of AI. This includes ethical issues, such as algorithmic discrimination and the lack of transparency in automated decisions, as well as debating the need for a regulatory framework that balances technological advances with the protection of fundamental rights. AI, while promising, presents challenges that need to be addressed through effective regulation to ensure innovation occurs safely and fairly.

Research ethics implications in the development of personalised therapy for pediatric SIRS patients

Abstract Background Pediatric Systemic Inflammatory Response Syndrome (SIRS) presents diagnostic and therapeutic challenge that can be addressed through personalised therapy. Related ethical challenges are understudied. Our report aims at identification and analysis of research ethics implications within the bigger ERA PerMed funded project of development of tailored immunotherapy for paediatric SIRS patients (TIPS) coordinated by Prof. Catharina Schütz from Technic University Dresden. Methods A sample of 10 experts with different backgrounds was studied through semi-structured interviews. Systematic literature review grounded the interview questionnaire. The transcripts were subjected to thematic analysis by two independent researchers. Results Five classical research ethics issues were identified: respect for autonomy; informed consent; risk-benefits ratio; data protection; social justice. All experts favoured the empowerment of children (N = 10) and obtainment of informed consent rather than assent was seen as a common goal (N = 5). The emergency context of SIRS research impeded the informed consent. Despite favourable risk-benefits ratio, no direct benefits resulted to study participants. Data anonymisation though necessary (N = 10), hinders proper dealing with incidental findings. Social justice issues apparently accompanied research design in personalised medicine (N = 2) but should not extend to access to personalised therapy. Conclusions The classical framework of research ethics is challenged by the new fields of medical research. Traditional concepts, such as informed consent in minors, are subject to rethinking. Current ethical and legal guidelines fall short of proper practical instructions in the specific case of SIRS pediatric patients. Thus, ethical aspects of new technology development should always be studied in parallel to the biometrics within personalised medicine projects so as to the development of guidelines is more evidence-based than precautionary driven. Bleaching Agents: A Review of Their Utilization and Management

Exposure to disinfectants, cleansers, and bleaching chemicals irritates the eyes, respiratory systems, and skin, triggering asthma and allergic rhinitis symptoms. Bleach, as the major constituent of cleansers, when used improperly or mixed with other indoor cleaning agents, produces harmful halogenated volatile organic compounds. This manuscript assesses the influence of excessive exposure to disinfectants, including bleaching agents, when used against infectious conditions related to SARS-COVID-19 and its management. The use and impact of different bleaching agents in cleansing and their associated problems have been analyzed and presented in this review. This analysis focuses on the conventional and post-pandemic approach towards bleaches. Usage of bleaching agents increased by a staggering 20.4% and 16.4% from January to March 2020 compared to the same period in 2018 and 2019. Mounting use of bleaching agents during the COVID-19 pandemic resulted in negative health effects like asthma, eye irritation, and skin allergies. An approximately 42% rise in poisoning cases, including a few deaths, has been associated with exposure to harmful chemicals involving bleaches during the recent pandemic. Bleaching agents are the primary sources of hazardous indoor pollutants; therefore, despite their importance in disinfection, their utility must be substantiated based on legal guidelines, disposal, and remedial measures. Thus, conducting future occupational exposure assessment studies for bleach hazard management is crucial.

Criminal Responsibility for AI Crimes

The research focused on the issue of which crimes fall under the jurisdiction of artificial intelligence. The incorporation of AI programs into different aspects of life entails many challenges, especially regarding the liability for the actions performed by AI and the question of compatibility of the existing legislation with the characteristics of the AI technologies. The state of affairs means that the AI-powered robots may perform actions that prescribe criminal provisions of criminal law, thus raising the issue in the given article as to the possibility of direct criminal penalties for robots, the feasibility of putting the intelligent robots’ criminal responsibility into practice by the general principles of the Jordanian Penal Code and the receptiveness of the concept of recognizing the crime to be committed by artificial intelligence. From this perspective, the main research question of the study is: What are the aspects of criminal responsibility stemming from AI mistakes? Thus, its significance is derived from the fact that it explores a new and essential issue, namely, the criminal responsibility for AI crimes within Jordan’s legislation. It has great importance in so many spheres, and it is difficult to describe all the aspects of artificial intelligence. The most remarkable outcomes and suggestions of the study show that the legal guidelines for criminal responsibility in Jordan of artificial intelligence crimes remain unrecognized. Thus, it is advised that the legislator proceed with actions to create legislation controlling AI technologies and their use for the purpose of serving the state and citizens’ interests. This legislation will guarantee the proper application of the AI capacities within several spheres for the sake of the general public, while taking into consideration all the ethical and legal concerns that relate to using artificial intelligence.

Juridical Review of The Issuance of Ministerial Regulations without Any Delegation from The Law

Ahead of the syncronous Regional Elections (Pilkada) that to be run in November 2024, there is still a polemic related to the legal guidelines for the acting of regional heads’s levitation whose term of office ends ahead of the 2024 simultaneous elections. The legal basis for the Minister of Home Affairs Regulation Number 4 of 2023 concerning Acting Regional Heads issued by the Minister of Home Affairs is considered to have many irregularities. This paper reveal the absence of statutory delegation in the issuance of the Permendagri and the use of legal considerations of the Constitutional Court judges in the Constitutional Court Decision Number 15/PUU-XX/2022 as a consideration in the Permendagri. The research method used in this paper is normative juridical through a statutory approach as a source of existing law. The results of this study conclude that the issuance of Permendagri No. 4 of 2023 is unfounded if only viewed through the presence or absence of delegation of the formation of implementing regulations. If viewed more broadly through the theory of discretion, then this is considered valid, in order to fill the legal vacuum. The legal deliberations of the Constitutional Court judges in MK’s Decision Number 15/PUU-XX/2022 also strengthen the legitimacy of the issuance of Permendagri No. 4 of 2023, this is because the content of the legal considerations is considered to be commensurate with the ruling, even though the ruling was rejected. Unfortunately, the implementing regulation chosen by the government to regulate the inauguration of acting regional heads is in the form of a Minister of Home Affairs Regulation, not a Government Regulation.

Past and Present of Social Inequality: Analysing Structure and Future Trends

The purpose of the article is to highlight the peculiarities of fundamental and applied forms of social inequality in the context of cultural and historical experience and prospects of civilisational development. Social differentiation has a diverse character, which forms the diversity of parameters of this socio-cultural phenomenon. The purpose of scientific research is to unify social indicators that activate and determine the level of inequality in society. Social processes are marked by contradictions in the worldview and mental understanding, so the issue of inequality is regulated by clear and understandable theoretical, methodological, legal, and socio-cultural guidelines. The research methodology is focused on the scientific and sociological methodological cluster. A sociological study based on content analysis, monitoring, and expert opinions allows us to determine the structure and manifestations of social inequality. Long-term sociological observations and in-depth analytical descriptions form the constants of the fundamental nature of social inequality. The results of the study emphasise the need to correlate the fundamental understanding of social inequality and the applied manifestation of this phenomenon in the socio-cultural space. In today's dynamic world, traditional and sustainable interpretations of inequality are hardly accepted, since the current principles of social development involve rapid permanent changes that determine the parameters of social inequality almost online. Under such conditions, society needs new flexible parameters that will determine the quantitative and qualitative parameters of social inequality. Anti-Corruption Efforts in Regional Police Departments: The Role of Regional Inspectorate Supervision Based on Justice Values

This study explores how effective oversight can enhance the utilization of state apparatus for achieving good and clean governance, specifically focusing on the role of regional inspectorates in preventing corruption within regional police departments. The study aims to: 1) analyze why current regulations regarding the regional inspectorate's role in corruption prevention are not based on justice values; 2) identify challenges in these regulations; and 3) propose a reconstruction of the regulations to align with justice values. Using a constructivist paradigm, a socio-legal approach, and descriptive research methods, the study relies on secondary data sources, including primary, secondary, and tertiary legal materials. Data collection is conducted through a literature review, and qualitative analysis is employed for data interpretation. The findings reveal that the current regulation is not justice-aligned due to the supervisory function of the Regional Inspectorate (Itwasda) being under the authority of the Regional Police Chief (Kapolda), rather than the National Police Chief (Kapolri). This structure limits the effectiveness of oversight and suggests the need for a direct reporting line to National Police Chief. Challenges in the existing framework include a lack of specific legal guidelines governing the inspectorate's role in corruption prevention and insufficient synergy between organizational sections and Supervision Inspectorate. Furthermore, there is a cultural reluctance to report corruption. The study proposes reconstructing the regulation to ensure a justice-based framework, including normative revisions to relevant laws and regulations, such as Law No. 20 of 2001 on the Amendment of Law No. 31 of 1999 on Corruption Eradication, and Indonesian National Police Regulation No. 14 of 2018. This reconstruction aims to establish a clearer, more effective oversight mechanism that enhances the inspectorate's role in corruption prevention.

Limitation of Human Rights and Freedoms amid New Global Challenges (Lessons from the Pandemic)

Globalization has had far-reaching effects on all key spheres of public life, leading to mixed outcomes, both positive and negative. One of the recent global trends is the fast and large-scale spread of viral infections, which has profoundly reshaped the economic landscapes, political environments, and government systems of most states. As the COVID-19 pandemic progressed, governments worldwide were forced to impose unprecedented restrictions that interfered with fundamental human rights, such as the freedom of movement and speech, to curb the virus spread. It sparked rigorous debate among the academic community and practicing lawyers. This article overviews the measures taken by Russia and other states in response to the COVID-19 pandemic. The obtained results highlight the need to legally establish new conceptual frameworks related to disease control, as well as to develop clear legal guidelines on optional and mandatory steps that public authorities should take in order to ensure the sanitary and epidemiological well-being of the population. Therefore, it was concluded that certain legal provisions must be specified to define the grounds and extent to which the rights and freedoms of citizens can be limited in case of viral epidemics.

Legal analysis of derivative transactions in islamic economics

The legal position regarding derivative transactions in Islamic economic practices has attracted significant attention from Islamic financial institutions such as AAOIFI and DSN-MUI. Derivative instruments can be incorporated into the sharia framework as long as they fulfil the core principles of sharia such as being free from elements of riba (interest), gharar (uncertainty), and maysir (gambling). These bodies have issued guidelines and fatwas such as the DSN-MUI fatwa No. 96/DSN-MUI/IV/2015, which permits the use of derivatives for hedging purposes under a number of strict requirements that ensure transparency and fairness and emphasizes that transactions are based on real needs and not speculation. However, implementing these legal guidelines on the ground faces various challenges. Key challenges include correctly applying derivative instruments so that they do not turn into prohibited tools of malicious speculation. Strict supervision and audit systems are needed to ensure compliance with Shariah principles on an ongoing basis, as well as ensuring transparency in the execution of transactions. In addition, in-depth training and education for Islamic finance practitioners is essential to support proper and effective implementation. Thus, the legal position regarding derivative transactions in the Islamic economy is clear and feasible to implement with strict supervision and supported by continuing education.

ADMINISTRATIVE AND LEGAL GUIDELINES FOR STANDARDIZATION OF FINANCIAL REPORTING OF ENTERPRISES AS SOCIO-ECONOMIC SYSTEMS

This article aims to present an approach for determining the most effective administrative and legal guidelines for the standardization of financial reporting in modern open socio-economic systems. It emphasizes the current state of financial reporting of these open socio-economic systems at the time of analysis and the application of the proposed approach. As the most common form of open socio-economic systems today, enterprises are taken as the basis. The method of multi-criteria decision analysis (MCDA), which encompasses various approaches to decision-making based on multiple criteria, including hierarchical analysis, was applied. In addition to its comprehensiveness, the method of pairwise comparison, which involves the use of two elements for comparison, was also applied. Experts were involved in the assessment and determination of the administrative and legal guidelines. As a result, an approach to forming key administrative and legal guidelines for the standardization of financial reporting was developed, which, unlike other similar approaches, aims to take into account external environmental factors and the changes they bring in order to try to adjust financial reporting standardization policies in complex development conditions. The practical value is revealed in the possibility of application by state bodies and structures involved in the development and establishment of financial reporting standards in Ukraine.

Contact lenses as a preferred choice for vision correction in various clinical scenarios with regard to work environment

Amendment to the Regulation of Minister of Labour and Social Policy of 1 December 1998 on safety and occupational hygiene at positions equipped with display monitors, adopted on October 18th, 2023, entered the long-awaited by employees possibility of reimbursement for corrective contact lenses, adjusting the Polish legislation to European directive regulating working conditions with display screen equipment. Contact lenses in many cases of refractive errors can be an alternative to prescription glasses method of correcting the visual impairment. There are however many clinical conditions, in which contact lenses can provide a better corrective effect on visual acuity. The information contained in medical databases of articles and scientific journals (PubMed, Biblioteka Nauki), online publications (Lippincott Journals), books, applicable legal regulations (available in Internetowy System Aktów Prawnych) and guidelines published by organizations and associations (Nofer Institute of Occupational Medicine in Łódź, Occupational Safety and Health Administration, Tear Film & Ocular Surface Society) were analyzed, covering the discussed issues over the years 2000-2023. Non-correction or suboptimal correction of a refractive error can cause a wide variety of troublesome symptoms, such as eye pain, headache, double vision, balance disorders, nausea, disturbances in the perception of the surroundings, contributing to poorer work efficiency, faster fatigue or an increased risk of error. This article, which is a narrative review, aims to present these conditions, as well as provide a brief overview of the types of contact lenses used, complications that may result from their use and contraindications to the use of this type of correction. SAFEGUARDING CHILDREN’S DATA IN THE DIGITAL AGE: A LEGAL APPROACH TO PREVENT CYBERATTACKS AND CHILD SEXUAL ABUSE

The growth of digital technologies and online platforms has dramatically increased the risk of children becoming victims of sexual abuse. Cybercriminals often abuse children's personal information, such as their name, age, location, and online activities, to identifyand exploit them. However, this digital revolution has also led to increased risks, including the vulnerability of children's data to cybersecurity attacks. One of the most concerning consequences of such attacks is facilitating child sexual abuse. Therefore,protecting children's data is essential in preventing child sexual abuse. In this background based on this hypothesis, this paper focuses on the legal approach to protect the vulnerability of children's data from cybersecurity attacks. The paper analysis the legal frameworks and guidelines developed by the Indian government to safeguard the personal data of children. Further, it would identify the current gaps in the legal framework and emphasise the need for further improvements towards strengthening the data protection of children. Moreover, the paper explores the role of technology in protecting children's data, including data encryption, secure data storage, access controls, and monitoring systems and also analyses the challenges associated with implementing these technological solutions. Finally, the paper offers suggestions for policymakers, legal practitioners, and technology professionals to protect children's data from cyberattacks, thereby preventing child sexual abuse.

Offering protection to immigrant youths in America: Is asylum or Special Immigrant Juvenile Status truly in the best interest of the child?

AbstractIn the United States (US), children's ‘best interest’ principles are central to child welfare policy, but their incorporation into immigration laws is less robust. Drawing on data from international and domestic policies, interviews with legal professionals and legal guidelines, we compare how Special Immigrant Juvenile Status (SIJS) and asylum – the main forms of immigration relief for undocumented youths in the US – align with children's best interest principles. SIJS, while promising, undermines family integrity by imposing rigid child‐rearing standards that may penalize immigrant families. Asylum upholds family integrity, but the application process involves intense interviews and strict evidentiary standards that harm youths’ well‐being. Given asylum's high denial rates, the process often results in trauma without much promise of the permanency asylum can offer. Consequently, both SIJS and asylum fall short of protecting children's rights and best interests. We argue that how legal systems manage youths significantly affects youths’ well‐being and their access to rights and benefits. The impact of legal processes on youths should be paramount to best interest policies and practices. We conclude with policy recommendations for SIJS and asylum that better promote children's best interests.

Judging the algorithm

AbstractThis paper discusses an algorithmic tool introduced in the Basque Country (Spain) to assess the risk of intimate partner violence. The algorithm was introduced to address the lack of human experts by automatically calculating the level of violence based on psychometric features such as controlling or violent behaviour. Given that critical literature on risk assessment tools for domestic violence mainly focuses on English-speaking countries, this paper offers an algorithmic accountability analysis in a non-English speaking region. It investigates the algorithmic risks, harms, and limitations associated with the Basque tool. We propose a transdisciplinary approach from a critical statistical and legal perspective. This approach unveils issues and limitations that could lead to unexpected consequences for individuals suffering from partner violence. Moreover, our analysis suggests that the algorithmic tool has a high error rate on severe cases, i.e., cases where the aggressor could murder his partner—5 out of 10 high-risk cases are misclassified as low risk—and that there is a lack of appropriate legal guidelines for judges, the end users of this tool. The paper concludes that this risk assessment tool needs to be urgently evaluated by independent and transdisciplinary experts to better mitigate algorithmic harms in the context of intimate partner violence.

Language Barriers in School Health: Addressing Health Equity in the U.S. Educational System.

Federal law requires school health leaders to ensure meaningful access to language resources to promote optimal health and education outcomes. This paper aims to inform all stakeholders, including decision-makers, about the importance of developing language access plans and policies. Multiple sources and legal guidelines provide a comprehensive overview of the issue. Including an examination of current practices and challenges that school nurses encounter, specifically regarding language resources, guidance is offered to elucidate meaningful language access policies that ensure equitable access to school health services. Supporting meaningful language access includes providing school nurses with qualified interpretation and translation services to care for those who do not speak, read, or write in English or have limitations with the English language. Additionally, local and state agencies may implement language access services requirements and enforce compliance with a language access plan to meet federal funding requirements.
