Современные методологические проблемы исследования творчества Н. Бердяева

The article works out the methodology of intellectual history applicable to the complex approach to the philosophy of N. Berdyaev. The current discussions on Berdyaev’s heritage consider Berdyaev’s work in the context of the world history of thought. Nevertheless, there is no consensus not only on the question of which philosophical school Berdyaev belongs to, but even on the problem of attributing Berdyaev’s figure to certain discipline. Thus, a comprehensive methodology of intellectual history, based on the ideas of the Cambridge school (Q. Skinner) and secularization theories, is relevant to tackle this task. The ap­proach developed by the author aims to consider the texts of the philosopher as real actions carried out in a particular social and political context to make a valuable impact on it. In contrast to the political texts traditionally considered in Cambridge approach, in the case of studying religious philosophy this metho­dology should also consider the relationship of philosophical discursive practices with religious discourse, religious practices and institutional church relations regulating them. The application of these methodological considerations to the research of Berdyaev’s philosophy demonstrates prospects of study the influ­ence of political and religious discussions at the beginning of the 20th century on the formation of the late doctrine of the philosopher

Prestito vitalizio ipotecario and mandatum post mortem

U radu se analizira mandatum post mortem u rimskom i talijanskom pravu kao pravni posao koji služi zaštiti interesa koji nastaju nakon smrti davatelja mandata. Glede sadašnjeg prava, uzimajući u obzir dominantno stajalište doktrine, koja smatra mandatum post mortem s imovinskim sadržajem ništetnim, budući da je u suprotnosti s člankom 458. talijanskoga Građanskog zakonika, analizirat će se osnovna obilježja instituta prestito vitalizio ipotecario radi usporedbe kompatibilnosti tog nedavno uvedenog instituta sa zabranom ugovora o nasljeđivanju koji je još uvijek na snazi u Italiji. Istraživanje će se provesti i na razini rimskog prava. nakon dokazivanja da se mandatum post mortem, shvaćen kao ugovor, razlikuje od drugih oporučnih raspolaganja, premda isto nazivanih mandatum post mortem, autorica uzima u obzir jedan izvor (Gai 10 ad ed. D. 17.1.13) koji bi mogao utvrditi postojanje takvih ugovornih mandata post mortem imovinskog sadržaja i u rimskom pravnom sustavu.

A critical study of Rasamritam and it′s applied aspects

Historical studies of Rasa shastra reveal the use of metals and minerals, both for alchemical and therapeutical purposes in ancient past. But, gradually the alchemical use of the subject, declines and the therapeutical use takes over. Rasamritam is the latest doctrine in the field of Rasa shastra which compiles the extract of the older books and adopted some new and contemporary concepts. The practical aspects of this text influence both the academicians as well as physicians in large extent. Keeping the wealthier, timely concept of this text in mind, we are trying to review and analyze it critically for the benefit of researchers and practitioners and hope the idea will be fruitful.

Normological Inferences and the Generation of Legal Norms

Abstract.This paper is an answer to Mazzarese (1993) in which the author argues that Kelsen's normological scepticism is a consequence of his theory of legal dynamics and of his views on the relation between higher and lower norms. The author rejects this tenet and reasserts his opinion that there is an essential break between the classical Pure Theory of Law and Kelsen's late doctrine. Therefore an inquiry is justified whether the theses and concepts of the classical Pure Theory are compatible with normological scepticism in Kelsen (1979). Mazzarese's comments on neo‐institutionalist views on legal validity are based on a misinterpretation of this conception.
