МЕТОДОЛОГІЧНІ ПІДХОДИ ДО ВИЗНАЧЕННЯ ЕКОНОМІЧНОЇ ЕФЕКТИВНОСТІ ПРАВА НЕПЛАТОСПРОМОЖНОСТІ

Insolvency law is an essential part of the legal system in any country. It serves a dual function – restoring the solvency of debtors and removing inefficient economic entities from the market. The effectiveness of insolvency law has a direct impact on a country's investment attractiveness and economic growth. This is why international economic organizations conduct assessments of national insolvency mechanisms using various approaches to define and evaluate effectiveness criteria. Despite the existence of an insolvency indicator developed by the Organization for Economic Cooperation and Development (OECD), the international Doing Business ranking by the World Bank became a catalyst for bankruptcy legislation reform in Ukraine in 2021. It is worth noting that each approach to evaluating the effectiveness of this area of law has its advantages and disadvantages in terms of accuracy and objectivity. The final assessments may be distorted due to biases of the compilers, which led to the cancellation of the Doing Business ranking in 2021. For Ukraine, the assessment of the effectiveness of insolvency legislation is crucial, given the importance of this institution in ensuring economic efficiency during both wartime and peacetime. It helps identify directions for improving legal regulation, including aligning Ukrainian legislation with European Union standards. This highlights the need to develop specific criteria for evaluating the practicality of legislative changes to enhance the efficiency when applied to all participants in the insolvency or bankruptcy proceedings. It should stimulate economic growth and harmonize Ukrainian legislation with European Union standards. This research analyzes various aspects of the effectiveness of insolvency legal mechanisms in Ukraine using the methodology of economic analysis of law, which has received insufficient attention in empirical studies and legislative work in Ukraine until now. The research findings will be a significant contribution to promoting effective regulation of debtor solvency restoration and preventing bankruptcy. They will also stimulate economic growth and harmonize Ukrainian legislation with European Union standards. Through the lens of interdisciplinary approaches to evaluating the effectiveness of insolvency law in Ukraine, the study proposes seven indicators for determining the economic efficiency of Ukrainian insolvency law: 1) Funds Recovery Ratio; 2) Case Processing Time; 3) Solvency Restoration Index; 4) Bankruptcy (Insolvency) Case Quantity Dynamics Index; 5) Business Climate Index; 6) Insolvency Policy Index for SMEs; 7) Legal Application Predictability Index. The proposed methodological approach allows for the assessment of the result of the formation and implementation of the state insolvency policy.

Objective limitations of the current vector of ESG-transition development

Aim. To identify objective reasons for the slowdown of ESG-transition, as well as a list of risks and limitations of the current vector of development of the climate agenda, which are often ignored by developers of “green” standards and taxonomies.Tasks. To evaluate ESG transition initiatives during the COVID-19 coronavirus pandemic; to identify non-obvious barriers and constraints to ESG transition; and to uncover the reasons that have shaped the current vector of the climate agenda.Methods. The study is based on the analysis of empirical data. Their processing showed that ideas of the international climate agenda are often broadcast regarding the ESG topic, but there are very few critical articles and reviews about it.Results. The current vector of development of the climate agenda is primarily conditioned by the goals of its initiators - international economic organizations. These include the Organization for Economic Cooperation and Development (OECD), the International Monetary Fund (IMF) and the World Trade Organization (WTO). The propagated notions of global environmental crises that future generations will inevitably face unless measures are taken to facilitate the transition to sustainable development are only a political tool for competing in the hydrocarbon market. Given the lack of strong technological solutions, investments in green assets can be seen as high-risk given their speculative nature.Conclusions. Despite the priorities of the global economic agenda, there are doubts about its integrity, as it fails to take into account a number of constraints and circumstances, including failure to take into account the scale of the raw material strain required to transform the global energy system; the lack of technologies to efficiently process large volumes of retired so-called renewable energy sources; the lack of energy technologies for which demand is not yet evident; and the “rebound” effect, i.e. the question of what happens next. As a result, market participants often use so-called greenwashing (or “green camouflage”) to formally meet the requirements, or rather, to portray the “greenness” of their technology/products.

Lessons to the DSU from the US-China Trade War and Proposal of Reforms

In the context of globalization, people pay more attention to the role of international economic organizations in managing transnational trade relations. The US-China trade war has critically impacted the global economy and significantly influenced the international trade pattern. The Dispute Settlement Understanding (DSU), an essential section under the World Trade Organization(WTO), failed to function during the US-China trade war. Using the US-China trade war as the entry point to review the US-China trade relations under the WTO, this paper first evaluates the deficiencies of the DSU. Then it raises some reform suggestions in relatively practical aspects. The main intention of reforms is to provide a more concise and complete negotiation platform for solving transnational trade disputes.

Institutional Provision of Tariff and Non-Tariff Regulation of Cross-Border Trade

Introduction. The study is devoted to a comprehensive study of the global trade system in conditions of global economic instability, in particular, to the identification and analysis of the determinants of deepening its asymmetries in the regional perspective. The study contains a description of the peculiarities of the modern global trade system and regulatory regime, including tariff and non-tariff methods of regulating cross-border trade and key trends in its development.
 Aim and tasks. The purpose of the study is to diagnose the institutional provision of tariff and non-tariff regulation of cross-border trade in order to determine the presence or absence of asymmetries in the global trade system in the regional context.
 Results. The study identifies and systematizes fundamental features of the modern global trade system whose development has been directly or indirectly influenced by regional asymmetries. Particular attention is paid to the characteristics of the major international economic organizations as the main regulators of the cross-border trade process, and to the study of the impact of the use of tariff and non-tariff import and export regulatory tools on cross-border trade asymmetries. The world trading system is divided by country and individual customs territory, depending on whether it belongs to a certain geographical area or to a group of countries with a certain level of economic development.
 Conclusions. Although the expansion of global trade has visually slowed down, the integration of world trade is not over, on the contrary, there are clear signs of the beginning of a completely new phase of globalization. The presence of asymmetry in the world trading system in a geographical context, regardless of the size of the region, has been theoretically proven. According to the criterion of the asymmetry of the trading system depending on the level of economic development of the countries, in general, there is a tendency to increase the level of liberalization of trade regimes by the increase in the level of development. At the same time, it has been proven that belonging to the group of least developed countries does not necessarily mean closed access to national markets, and categorization as a developed country does not indicate the application of the least number of non-tariff measures to regulate trade volumes. At the same time, Ukraine remains a country that has undertaken the most liberal obligations regarding providing access to markets for both goods and services. As one of the world's leading exporters of agricultural products in 2020, Ukraine has set the customs tariff level at 11%, the lowest among group members.

ENSURING FOOD SECURITY OF KAZAKHSTAN IN THE CONDITIONS OF THE EAEU

The level of food security of the member countries of the Eurasian Economic Union lags behind the developed countries, despite the fact that the Eurasian Economic Union occupies a significant place among international economic organizations. The problem of food security of the Eurasian Economic Union is the focus of the member countries and each of them independently acts against economic and political risks and threats on the way to ensuring the country&s national food security. Each of them has formulated and applies its own food security assessment and control systems. However, due to the complex nature of the problem of ensuring food security in the conditions of the Eurasian Economic Union, it must be considered and solved through the implementation of state programs not only within the country, but also within the framework of the Eurasian Economic Union as a whole. The article examines topical issues of ensuring food security in the conditions of the Union, assessment, and also identifies the main obstacles.

The emergence of new international organizations in the context of digital transformation of the world economy: myth or reality?

Not only does the process of digitalisation in the broad sense affect individual enterprises and smaller financial organizations, but it also has a direct impact on international economic organizations’ operations. This is manifested both in the need to introduce digital technologies into their activities and to a greater extent in the need they experience to adapt themselves to new realities. The range of actors in the world economy is expanding, the role of transnational corporations is changing, and it is becoming increasingly difficult for the state to regulate production and circulation at the national level, which generates the necessity of creating additional opportunities for international regulation. To a certain extent, existing levers of influence used by international organizations are outdated and require serious revision. The question thus arises as to which one of the following directions for the system’s development should become the main one: reforming existing organizations, establishing fundamentally new ones or combining the two options. The purpose of the article is to analyze current changes in international economic relations, caused by the digital transformation, and to identify the key ways to improve the institutional architecture of the world economy.

With this issue, the Journal of International Economic Law launches its 26th volume and celebrates its silver anniversary with an Agora issue. The anniversary Agora has been organized and edited by our distinguished Editorial Board Members: Andrea Bjorklund and Gabrielle Marceau. It features symposium contributions from more than 20 scholars and practitioners and provides both a retrospective and future-oriented accounting of the field of international economic law 25 years after the founding of the Journal. We are especially pleased to feature articles by the leaders of four notable international economic law organizations. The Agora opens with essays from WTO Director-General Ngozi Okonjo-Iweala, IMF Managing Director Kristalina Georgieva and General Counsel Rhoda Weeks-Brown, Deputy Director General of WIPO Lisa Jorgenson, and Secretary-General of ICSID Meg Kinnear. We thank Andrea and Gabrielle for all their efforts to make the Agora issue such a success! This issue also complements prior issues of the Journal and continues to reflect on how international economic law is implicated in the challenges and opportunities faced by societies across the planet. We aspire to be a truly global Journal with both an eye on the future and a sense of the past. We hope to continue to bring attention to ideas that can help confront modern challenges. INTERRELATION OF THE INCLUSIVE DEVELOPMENT INDEX SYSTEM AND CURRENT GDP & GDP BASED ON PPP INDICATORS

This article is empirical in nature. Its purpose is to analyze, on the basis of a multivariate regression model, the question of the impact of the Inclusive Development Index–as the first index instrument of an inclusive economy–on such two forms of GDP as an indicator that the Inclusive Development Index was recognized to replace: current GDP per capita and GDP based purchasing power parity (given that the constant GDP indicator is officially included in the structure of the Index). The dimension of analysis described above and presented in this article is a component of the author’s research as part of a PhD program dedicated to determining the overall effectiveness of the Inclusive Development Index presented in 2017 by the World Economic Forum. The regression analysis showed the minimal presence of significant influences of the structure of the Inclusive Development Index on current GDP and GDP based on PPP as the two main economic indicators in the world. This allows us to talk about the abstract nature of the construction of the Inclusive Development Index. In turn, the inevitability of such aforementioned studies is dictated by the incompleteness of the reorientation of the model of global economic dynamics from the concept of sustainable development developed in the 1970s to the concept of inclusive economic growth. This, in particular, is declared today by specialists from leading international scientific and economic organizations and associations: The WEF, the OECD, the World Bank, The International Monetary Fund, The United Nations, and structures like the International Labor Organization and UNICEF, which operate under the auspices of the UN. The theoretical and practical significance of the results obtained may be useful in further studies on such composite indicators.

An Analysis of the Merits and Demerits of the World Trade Organization’s Dispute Settlement Mechanism System and the Disadvantageous Position of Developing Countries in it

<p>On January 1, 1995, world trade ushered in a new era. An organization used to establish, modify, and enforce rules governing international trade - the World Trade Organization (WTO) - was born.<sup>[1</sup><sup>]</sup> The WTO is the world's largest international economic organization and so far, as many as 164 members have joined.<sup>[</sup><sup>1</sup><sup>]</sup><sup>,</sup><sup>[2</sup><sup>]</sup> The WTO covers a wide range of areas, mainly including trade in goods, services, intellectual property, and other fields.<sup>[3</sup><sup>]</sup> Various trade disputes would arise in the complicated trade process and naturally, resolving disputes has become one of the core activities of the WTO. The WTO Dispute Settlement Mechanism (DSM) is regarded as the central pillar of the WTO and a unique contribution of the WTO to global economic stability.<sup>[4</sup><sup>]</sup> Generally speaking, DSM is excellent and successful. It provides a reliable trading platform for all members of the world and a guarantee for the free, fair, and predictable flow of trade.<sup>[5</sup><sup>]</sup> But on the other hand, nothing is perfect, DSM also has some criticisms, and there is also a certain degree of inequality in the treatment of members with different development levels. This article aims to analyse the merits and demerits of the WTO's DSM and to explain that, although the DSM was originally set up to benefit the weaker countries, in practice developing countries remain at a disadvantage.</p>

Anticipating global warming effects: A comprehensive study of drought impact of both flax plants and fibres

Currently, the effects of global warming are one of the most important topics on the agendas of all governments and international economic and scientific organisations on the planet. Temperatures and rainfall will be especially subjected to increasing deregulation, and thus crop yields will be affected according to geographic location. Cellulosic materials, such as bast fibres, are considered one solution to decrease human environmental impact: they are a renewable resource, biodegradable and have a lower carbon emission than synthetic materials. However, their quality, yield and mechanical properties depend on environmental conditions during plant growth. In this paper, we explored the possible impact of seasonal drought linked to future climate change on flax plants and fibre quality. Two batches of the same textile flax plant cultivar were grown under two different field environmental conditions in the same year, one taken as a control under regular climatic conditions and the second one grown under drought stress. Carbon isotopic discrimination reveal an increase in water stress plant of the fibre δ13C, reflecting that plants are indeed suffering from drought stress from a physiological point of view. We characterized the mechanical properties, biochemistry and morphology parameters at both the stem and technical fibre scales. Our results showed that the plants of the two batches were morphologically different and that the drought-stressed plants were smaller, mainly in terms of the height of the stem (−28%) and diameter (−16%). Biochemical analyses highlighted a contrasting lignin content between the two batches. A difference in protein content was also measured, with an increased amount in stressed flax plants, with contrasting distributions revealed by tyrosine and tryptophan monitored by synchrotron UV fluorescence. In addition, polysaccharide composition was also quantified with an increase in mannose and an important decrease in glucose in the drought-stressed technical fibres. Surprisingly, despite the difference in biochemistry composition and morphological parameters, the mechanical properties of elementary flax fibres extracted from the two batches were not significantly different. This suggests that drought can affect the yield and biochemistry of the extracted technical flax fibres but does not necessarily impact the longitudinal mechanical performance of single fibres.

The Political Economy of the Next Pandemic

While the pandemic and recovery unfold in real time, this article investigates some of the major themes on preparations for the next pandemic. Humanity cannot rely on modern medicine to beat the next ‘disease X’ and the world cannot afford the extortionate health and economic policy interventions during the COVID-19 pandemic again. From the COVID-19 pandemic we learned that the international economic organizations suffered from disaster myopia and that the self-image of the advanced economies is distorted. It also has become apparent that ‘beggar-thy-neighbor’ health care was generally practiced while global health care should have been the norm. A discussion on the related issues of rationing, triage and scarcity of health care during a pandemic is urgently needed. All in all, a major global investment project is necessary to reduce the vulnerability to and impact of pandemics. As inequalities to a large extent determine pandemic vulnerability and adjustment of SDGs is necessary.

Abstract. Introduction. The relevance of the study of trends in the reform of the global financial system is due to the fact that it is currently going through one of the most difficult and critical stages of its existence. The traditional challenges in the field of international currency circulation include the steady development of globalization of all economic processes, the development of digital technologies, as well as the impact of powerful exogenous factors such as rapid climate change and the COVID-19 pandemic, which requires a rapid and comprehensive response Purpose. In this regard, this article aims to identify key aspects of the current stage of reforming the global financial system, their general characteristics, as well as changes in theoretical and political approaches to solving problems of the global financial system from the standpoint of complexity. The main research method was the method of induction, which based on the study of a number of primary international documents, theoretical studies and research focused on the initial analysis of individual problems of the global financial system allowed to form a comprehensive vision, identify and systematize major trends in global financial system reform. Results. The article provides a brief overview of trends in global financial architecture, emphasizes the awareness of major players – politicians, international economic and financial organizations, most scholars and key bankers of central banks – the need for closer linkage of monetary and financial processes with the needs of the real economy and international trade, increasing the regulatory role of the state in financial processes, as well as closer international coordination of efforts in the financial sphere, which is especially important for an adequate response to climate change and in the fight against the COVID-19 pandemic. The impact of digital technologies and exogenous factors (climate change and the COVID-19 pandemic) has forced politicians and financiers to focus on the Global Tax Agreement and the European Union's introduction of a transboundary carbon regulation mechanism. Conclusions. The identified trends in reforming the global financial system and their key characteristics, given in this article, can serve as a starting point for further research, both comprehensive and more specialized, as well as contribute to a broader understanding of modern global financial processes in shaping financial policy and adoption management decisions/

Ekonomska diplomatija kao osnov i instrument u ostvarenju ciljeva privrede države

Economic diplomacy as such includes targeted activities carried out by representatives of one country with representatives of another country, which in their core aim to increase foreign investments, greater volume of exports or imports, as well as strengthening the positions of domestic companies in other countries. In addition to the aforementioned activities, economic diplomacy also includes activities that a country undertakes by participating in international economic organizations as well as joining them. This discipline represents the future and the direction of diplomacy of every modern state that wants to survive in today's market conditions, which are unstable, changing and a decisive factor for every participant. The main goal, focus and function of economic diplomacy must be the protection of national economic interests in every international relationship, whatever level it may be. In this paper, economic diplomacy as a discipline will be dealt with, a short theoretical review will be given, as well as the author's perspectives and views on the progress of the Republic of Serbia and the countries of the region in this field.

Establishing of UNCTAD in 1964 and the Logic of the Cold War: Economic Diplomacy of the GDR in the Struggle for International Recognition

This article is dedicated to the problem of preparation and participation of the socialist countries in the first United Nations Conference on Trade and Development (UNCTAD), held in Geneva from March 23 to June 16, 1964. On the basis of the documents of the Russian State Economy Archive (RGAE) being introduced into science the author shows the importance the Soviet leadership attached to economic diplomacy, actively using for its realization the CMEA mechanisms. The practical embodiment of this was the solidarity position at the conference of socialist countries, prepared through the decisions of the II meeting of the Executive Committee of the CMEA in 1962 and aimed to establish a new international trade organization (ITO), one of the founding principles of which was to be universal membership. Unlike the FRG, which at that time was a member of the specialized organizations of the UN and thus had the right to participate fully in the 1964 conference, the GDR could only rely on collective forms of representation, above all as a member of the CMEA delegation. Thus, the solidarity-based struggle of socialist countries for international legal recognition of the GDR at the UN level, including through international economic organizations such as UNCTAD, strengthened the international status of CMEA, which sought to turn world trade into a tool for expanding its economic influence, including in the Third World.

ПРОБЛЕМНО-ПЕРСПЕКТИВНІ СФЕРИ ЗМІЦНЕННЯ МІЖНАРОДНОЇ КОНКУРЕНТОСПРОМОЖНОСТІ ТА ПОСИЛЕННЯ СТРУКТУРНИХ СКЛАДОВИХ ФІНАНСОВОЇ БЕЗПЕКИ ІКТ-СЕКТОРА УКРАЇНИ

The ICT sector creates a powerful potential for ensuring the competitiveness of the national economy and the quality of life of the population. However, the current state of development of the digital economy system of Ukraine is insufficient, which is confirmed by the low positions of our country in the ratings of leading international economic organizations. Particularly problematic areas have become: training of personnel and activation of scientific and research work in the ICT sector; information and communication technology of enterprises of the real sector of the economy; accelerating the digital transformation of the national economy; modernization of digital infrastructure; development of the information society; formation of the system of interaction of e-business, e-government, e-society. All this leads to a slowdown in the pace of development and realization of the potential of the ICT sector, limiting the inflow of investments and cash inflows into the sector and the economy in general, and reducing its share in the country's GDP and export potential. A number of positive trends in the digitization of the economy, although they ensure the formation of a full-fledged infrastructure for the functioning of the ICT sector and the expansion of the scope and volume of activities of its subjects, but this does not sufficiently ensure the strengthening of the financial security of the sector. In order to ensure the financial security of the ICT sector of Ukraine, taking into account the problem-target orientations of the development of the sector and the functional components of financial security, it is necessary to provide for the implementation of the following tools: modernization of the personnel training system and implementation of investment projects for the activation of R&D of subjects of the ICT sphere; implementation of specialized credit programs supporting ICT products for the real sector of the economy; improvement of the fiscal policy of the digital transformation of the economy and society; stimulating the involvement of ICT companies in the implementation of development projects for the modernization of digital infrastructure; activation of innovative and technological activities of subjects of the ICT sector in the consumer market of digital communication; formation and development of the national ecosystem of digital transformation.

Post-Soviet States of Eurasia in International Economic Relations

The present article is devoted to the analysis of participation of new post-Soviet Eurasian states in international economic relations, of current goals and strategic targets of this policy in the economic development of these states. Many, in fact the majority of them appeared to be unable after achieving political sovereignty to solve complex economic problems of national development since they had neither organizational experience in carrying out an independent and effective economic policy nor the personnel, technological and financial provisions for these goals. Therefore new independent Eurasian states had to approach foreign countries searching for adequate forms and methods of cooperation with them on these issues. In this connection the article explores the nature of interrelations between post-Soviet states with their principal foreign partners on a bilateral basis as well as in multilateral international economic organizations, of the comparative role of political and economic factors in these relations. Some of the post-Soviet states have begun their participation in the Eurasian integration project headed by Russia, others aim at solving their external political and economic problems by strengthening relations with the USA and European Union on a priority basis, still others see the way out in promoting their orientation primarily on their closest regional partners (such as China, Turkey, Iran). However, neither of these directions of external economic activities has become a dominant one on the post-Soviet space. Moreover, some of their elements may get a priority significance, neighboring others or even replacing them at various stages of development of this or that post-Soviet state. Besides, three decades after their formation the new sovereign Eurasian states having endured complex processes of national state building began to differ substantially from each other by their political systems, by levels of economic development and above all – by their strategic goals, aspirations and orientations. And in its turn this has caused serious changes in their approaches to building relations with their external partners, both in bilateral and multilateral formats. Under these conditions the most important national priority of Russia is to implement such a foreign policy at the post-Soviet space that would react timely and most flexibly at social, political and economic processes going on there and emphasizing that most important goal of such a policy is neither a political expansion or an institution of a great power hegemony but development of partnership and friendly relations with the post-Soviet states on the basis of equality and mutual benefits.

Methodological Basis of the Comparative Evaluation of Inclusiveness Level of Economic Development

Abstract The article is devoted to the methodological basis of comparative assessment of the level of inclusion of economic development in different areas and regions. The article focuses on the methodological problems of analyzing, evaluating, and raising the level of inclusiveness of economic development. The importance of raising the level of inclusion in the context of new development trends in society and the economy is interpreted. The need for a new look at the scientific and theoretical basics of economic development are emphasized. Available studies on inclusive development issues are analyzed. Indicators and sub-indices characterizing the inclusive development of the society are proposed. An analysis of international scientific research on the problems of inclusive development was conducted. As the increase in the inclusion of the economy leads to an increase in the Gross Domestic Product (GDP), the urgency of developing its prospects is justified. Ratings of advanced countries on inclusive economic development indices were analyzed. Indicators of inclusive development of international economic organizations have been identified and based on them, relevant improvements have been made and additions have been made. Indicators and sub-indices characterizing the inclusive development of society are offered. The evaluation of inclusive development at the international level is analyzed. The methodological basis of the evaluation of the inclusiveness level is explained and a technique is developed. Key efficiency indicators for inclusive growth and development have been identified. The country's National Inclusive Development Index (NII) is proposed as a dependency on sub-indices that reflect several areas. Subindices and indicators forming the level of inclusion of national economic development have been proposed. The scientific-methodological approach proposed for the assessment of inclusion at the national level is presented in the form of algorithms and conceptual stages. Assessment of the level of national inclusion is offered as Level I - inclusion at the national, social, or macro-level; Level II - inclusion of regional or individual cities and regions; Level III - intersectoral or sectorial inclusion; Level IV - inclusion in the private sector, non-governmental structures; Level V - inclusion in non-governmental and public administration; Level VI - inclusion in the micro or enterprises, production level; Level VII - in several sub-levels as individual inclusion in homes and families. National and international evaluation of the inclusive society and economic development is studied. The main factors of inclusive development of Azerbaijan's economy such as GDP per capita, labor productivity, expected healthy life length, employment level, Gini index of income, poverty level, Gini index of wealth, monthly household income, net savings, carbon capacity, public debt to GDP indicators such as ratio, demographic load ratio have been developed. The importance of the use of inclusion technologies was highlighted and reported on. It was noted that the effective platform for increasing the inclusion of the information society has many opportunities. It was noted that the globally implemented “Internet of Things” (IoT), Cloud computing, soft-computing, Big Data technologies, and components of the 4.0 Industrial Revolution will create additional opportunities for joint effective activities of citizens in society, increasing the level of inclusion.
