Digital dividend or divide: The digital economy and urban entrepreneurial activity

The integration of the digital economy into various economic and social sectors is profoundly impacting urban entrepreneurial development. This study delves into the empirical analysis of how the digital economy influences entrepreneurial activities and the resulting gaps across cities. To achieve this, panel data from Chinese cities between 2011 and 2020, coupled with statistical information about registered enterprises in China's industrial and commercial sectors, are employed. Additionally, the study examines emerging digital risks and suggests corrective measures stemming from the rapid digital economic expansion. The findings of this research reveal that the digital economy fosters increased entrepreneurial activity within cities while simultaneously widening the gap in such activity across different urban areas—a phenomenon akin to the “Matthew effect.” Importantly, these conclusions withstand rigorous testing for endogeneity and robustness. In response to digitalization risks, establishing a robust intellectual property protection system emerges as an effective countermeasure. The government's role is pivotal: it should expedite urban digitization by prioritizing new infrastructure development and fostering a conducive business environment. Furthermore, it must remain vigilant to the potential exacerbation of the “Matthew effect” and regional developmental imbalances prompted by the digital economy.

To the question reform of the state system of legal protection of intellectual property in Ukraine

The article highlights the current state of intellectual property protection in Ukraine. It is emphasized that in accordance with the provisions of Art. 41 of the Constitution of Ukraine, everyone has the right to own, use and dispose of their property, the results of their intellectual and creative activities. Article 55 of the Constitution of Ukraine stipulates and guarantees everyone the use of all national types of legal protection, protection of rights and freedoms in court. According to the second part of Art. 124 of the Basic Law, the jurisdiction of the courts extends to any legal disputes and all legal relations arising in the state. In addition to the guaranteed constitutional right to judicial protection of intellectual property rights, the norms of special legislation in the field of intellectual property determine the legal basis for the protection of violated rights.
 In connection with the reform of the state system of legal protection of intellectual property, the Concept of reforming the state system of legal protection of intellectual property in Ukraine, approved by the order of the Cabinet of Ministers of Ukraine dated June 1, 2016 No. 402-r, was analyzed, which states that the state system of legal protection of intellectual property property implements the state system of legal protection of intellectual property, and also draws attention to the imperfect and inert system of state management of intellectual property, which has led to the absence of significant changes in the adaptation of the legislative framework to modern economic and political conditions (the fight against patent trolling, Internet piracy, satisfaction needs of the IT industry, military industry), as well as the National Strategy for the Development of Intellectual Property in Ukraine for the period until 2020, where a two-level structure of the state system has been created instead of a three-level structure. Separate provisions of the legislation, the norms of which guarantee the protection of intellectual property rights, as well as special laws and by-laws defining the reformation and functioning of the state system of legal protection of intellectual property, are considered. Attention is drawn to the fact that today the state system of intellectual property protection in Ukraine has an extensive system of state authorities that ensure the protection and protection of the violated subjective rights of copyright holders. The existing problematic issues of intellectual property protection are analyzed and the author’s proposals for improving the state of protection and protection of intellectual property rights in Ukraine are formulated.

THE TRADEMARK RENEWAL PROCESS RELATES TO THE EXCLUSIVE RIGHTS OF THE BRAND HOLDER BASED ON LEGAL CERTAINTY

In experiencing the changing era, the Intellectual Property protection system also needs to adjust well, along with the changes, growth, challenges, and opportunities that exist. How Does Intellectual Property Protection Empower Technological Innovation in Enterprises - Take China as an Example

With the advancement of technology, fields such as artificial skills, biotechnology, and renewable energy are undergoing rapid iterations. Correspondingly, converting these technologies into tangible assets underscores the critical role of intellectual property protection. This paper takes the current status of intellectual property protection laws in China as an example to analyze the potential benefits of an improved intellectual property protection system for innovative enterprises and the market economy and the limitations of the current Chinese intellectual property protection laws. Enhancing the intellectual property protection system can empower enterprises with creative logic by improving the market economy, shaping new modes of thinking, and refining mechanisms for benefit distribution. Simultaneously, in the face of limitations in intellectual property protection laws, improvements can be achieved by strengthening law enforcement, advancing judicial reform, refining system design, enhancing international cooperation, and raising legal awareness. This article aims to assist scholars and relevant practitioners in understanding the current status of Chinas intellectual property protection laws, thereby facilitating the development of innovative enterprises in China.

The impact of technological transformation on basic research results: The moderating effect of intellectual property protection

This study creatively investigates the strategic and substantive innovation transformation of basic research results from the perspective of intellectual property protection. Using Chinese provincial panel data from 2001 to 2018, the relevant empirical research findings are threefold. First, basic research results have a significant role in promoting strategic and substantive innovation, and the level of intellectual property protection has a significant regulatory role. Improved intellectual property protection will weaken the strategic innovation transformation of basic research results and strengthen substantive innovation transformation and a variety of robustness tests support these conclusions. Second, a regional heterogeneity test demonstrates that intellectual property protection has the most significant impact on the technological transformation of basic research results in the eastern region. Third, an industrial heterogeneity test indicates that intellectual property protection significantly enhances the substantive innovation transformation of high-tech enterprises, and the impact on general industrial enterprises is insignificant. The research findings provide a theoretical foundation and empirical evidence for China to improve its intellectual property protection system to facilitate basic research innovation transformation efficiency while comprehensively considering regional and industrial differentiation.

Intellectual property system and urban green innovation: Evidence from China

AbstractGreen innovation (GI) can enable win‒win style economic and ecological benefits. Using China's pilot scheme for the construction of the intellectual property protection (IPP) system as an example, this paper empirically tests the impact of IPP system reform on the GI level and its spatial spillover effect. The results show that IPP system reform has significantly promoted urban GI, indicating that a progressive reform model characterized by experimentalist governance is applicable to innovation policy practices in developing countries. The dynamic effect analysis shows that IPP system reform can be applied to continuously promote urban GI. The mechanism analysis shows that such use of IPP system reform can improve the level of urban GI by promoting investment and talent agglomeration, confirming the viewpoint of the institutionalist school. The heterogeneity analysis shows that IPP system reform plays a stronger role in promoting GI in peripheral cities than in central cities, in cities with lower rather than higher scientific and educational levels and in cities with weaker rather than stronger GI capacity. Consistent with the theory of institutional diffusion, IPP system reform has a significant spatial spillover effect, promoting GI activities in surrounding cities while working to improve the local GI level. This paper affirms the effectiveness of the pilot regional innovation policy with Chinese characteristics, with important theoretical significance.

Artificial Intelligence and its Patentability: A Comparative Study Between India,UK, and USA

This dissertation examines the patentability of artificial intelligence (AI) based inventions in India, UK, and USA. The study provides an overview of the history and development of AI, the patent law framework in each jurisdiction, and the patentability requirements for AI-based inventions. The dissertation conducts a comparative analysis of the patentability standards for AI-based inventions in each jurisdiction, highlighting the similarities and differences in the approach taken by each country. The study finds that while the three countries have similar patentability requirements for AI-based inventions, there are notable differences in their interpretation and application. For example, India's patent law explicitly excludes software and algorithms from patentability, while the UK and USA have a more permissive approach, allowing patents for software that demonstrate a technical effect. Furthermore, the dissertation highlights the challenges of patenting AI-based inventions, such as the difficulty of determining inventorship and the lack of clear guidelines for assessing the novelty and non-obviousness of AI-generated inventions. The study also provides case studies of patent applications and grants for AI-based inventions in each jurisdiction, highlighting the challenges and opportunities presented by these inventions. The case studies illustrate the potential impact of AI on innovation and patenting, as well as the potential implications for access to technology and competition in the market. Unequal Accessibility to COVID-19 Vaccination Calls for Improvements for Future Pandemics

COVID-19 vaccine accessibility emphasized the importance of balancing the TRIPS Agreement to support both research and societal goals. From 2020 to 2022, the TRIPS waiver was proposed, opposed, and countries now reached an agreement on the compromised waiver, but it has still received much criticism. Furthermore, the current situation of unequal accessibility emphasizes the importance of reforming the system of intellectual property protection to ensure the human right of individuals in low-middle-income countries. The essay analyzed the measures used in two past cases, which are HIV/AIDS and cancer, to allow for equal accessibility treatment, combined with the current situation of COVID-19, to suggest future improvements required for states to be more prepared for the next pandemic.

Who judges plants? Scientific‐legal judgement of varieties for plant breeder's rights

AbstractAn internationally standardised system of intellectual property protection for new varieties of plants is outlined by the Union for the Protection of New Varieties of Plants Convention. Within this system, member States must determine who will be responsible for assessing plant varieties. Jurisdictions have adopted divergent approaches to this question, with varying degrees and modes of government involvement in the assessment process. Taking Australia as a case study, this article explores a decentralised system of expert judgement where individuals accredited as Qualified Persons are authorised to judge new plant varieties. Drawing on extensive interviews, this article outlines Australia's Qualified Person system, including the accreditation, training, and supervision of Qualified Persons. I argue that the formal system of varietal assessment is underlaid and buttressed by a multiplicity of informal elements, including the tacit knowledge of Qualified Persons, audit processes, apprenticeship‐like learning practices and interpersonal relationships of trust between Qualified Persons and government officials.

Perceptual Hashing of Deep Convolutional Neural Networks for Model Copy Detection

In recent years, many model intellectual property (IP) proof methods for IP protection have been proposed, such as model watermarking and model fingerprinting. However, with the increasing number of models transmitted and deployed on the Internet, quickly finding the suspect model among thousands of models on model-sharing platforms such as GitHub is in great demand, which concurrently triggers the new security problem of model copy detection for IP protection. As an important part of the model IP protection system, the model copy detection task has not received enough attention. Due to the high computational complexity, both model watermarking and model fingerprinting lack the capability to efficiently find suspected infringing models among tens of millions of models. In this article, inspired by the hash-based image retrieval methods, we introduce a novel model copy detection mechanism: perceptual hashing for convolutional neural networks (CNNs). The proposed perceptual hashing algorithm can convert the weights of CNNs to fixed-length binary hash codes so that the lightly modified version has the similar hash code as the original model. By comparing the similarity of a pair of hash codes between a query model and a test model in the model library, similar versions of a query model can be retrieved efficiently. To the best of our knowledge, this is the first perceptual hashing algorithm for deep neural network models. Specifically, we first select the important model weights based on the model compression theory, then calculate the normal test statistics (NTS) on the segments of important weights, and finally encode the NTS features into hash codes. The experiment performed on a model library containing 3,565 models indicates that our perceptual hashing scheme has a superior copy detection performance.

Within the greater map of the legal mechanisms related to software Intellectual Property Law and its protection systems1 certainly play a core part. This article only grasps the interaction between two of the Intellectual Property protection systems granting a direct form of protection by employing exclusive rights over software: copyright and patent law. The choice between one of these two regimes has been historically challenged. As software is a complex concept gathering heterogeneous elements – the dynamics of copyright and patent law related to software are molded by their specific subject matter – hence, defining software becomes a core step in the assessment of its protection mechanisms.

Implementing Intellectual Property Provisions in New-Generation Free Trade Agreements in the EU

The inclusion of chapters that introduce a high standard of intellectual property protection in free trade agreements has become an essential feature of the international commercial policy of developed countries. Based on the analysis of the legal policies and practices of entering into and implementing commitments on intellectual property in the new generation of free trade agreements of the European Union (EU), this article points out that there are two prominent legal aspects of implementing intellectual property provisions in the new generation of free trade agreements. On the one hand, in comparison to partners being developing countries, the EU has always been in the position of a negotiating party with a superior intellectual property protection system; therefore, the goal of these agreements is to provide “sticks and carrots” to push the developing countries to change their laws, policies, and standards. From the perspective of comparative law theory, the implementation of agreements will lead to the “transplantation and transformation” of intellectual property legislations from the EU to partner countries. On the other hand, in some typical cases related to i) the protection of genetic resources, traditional knowledge, and ii) technology transfer, the developing countries have also gained certain achievements in including the above issues in the agreements; and thereby imposing obligations on the EU to implement these commitments.

This study focuses on the need to refer to or apply analogy to the intellectual property system that is most similar in essence to data for the effective establishment of non-personal data regulatory policies, which are gaining importance with the advent of the data economy era. In order to establish a virtuous cycle structure of the ecosystem, it is intended to compare the coordinates of a desirable data policy with the intellectual property regulatory system. To this end, we first explore the nature of data and intellectual property and the interface between the two regulatory systems. First, consider the nature of data and intellectual property: i) ‘data as intellectual property (IP)’ (comparative review with data and intellectual property’s subject matters such as inventions, works), and conversely ii) ‘intellectual property as data’ (The informational nature of intellectual property) is understood by considering both aspects. Next, the interconnection link between the IP system and the data regulation system will be examined, taking into consideration what points can be applied by analogy from the characteristics of the established intellectual property protection system. First, after i) analyze the characteristics of the intellectual property protection system, ii) analyze the commonalities and differences in the nature of information and seek contact points iii) check in the context of a common policy structure of creation, protection, utilization and foundation.
 In data policy establishment, a system that can be inferred from the intellectual property system should be able to support the maintenance and development of the data ecosystem virtuous cycle structure. After comprehensively examining the factors that can be inferred and applied from the IP system, additionally, a few topics such as i) Collective ownership of IP and the concept of total sharing data ownership ii) Non-voluntary license and forced sharing of data iii) Implications of the collective copyright management system through trusts will be discussed in more detail.

State of formation and implementation of state policy on ensuring the protection of intellectual property during weapons and military equipment development

 Legislative acts that form the state policy in the field of national security and defense of Ukraine regarding the protection of intellectual property are considered. The state of realization of the defined questions at development of armament and military equipment is investigated. It is determined that the effective implementation of the state national security policy is impossiblewithout a comprehensive analysis of the impact of intellectual property issues on the sphere of national security and defense of Ukraine. The importance of improving the system of intellectual property protection in the development of armaments and military equipment is noted.Ensuring Ukraine’s defense capability largely depends on equipping the Armed Forces of Ukraine with modern types and models of armaments and military equipment that is developed based on intellectual property rights.
 The required level of defense capability of the state is achieved through the formation and implementation of defense and industrial policy, the purpose of which is the development and production of weapons and military equipment and equipping the Armed Forces of Ukraine.It is the military-technical sphere where the objects of intellectual property rights belonging to the sphere of national security and defense are created, and the state is obliged to ensure their protection.Ukraine began to form a state policy on national security and defense from the first days of the independence.The legislation of Ukraine on national security and defense determines the need to use scientific and technical achievements and the introduction of new technologies to increase the state's defense capabilities. However, the provisions on intellectual property issues in all regulations are purely declarative by nature without defining specific tasks to eliminate possible threats and address issues.This is especially true of the use of intellectual property in the field of national security and defense.An important component of the mechanism for formulating state policy in the field of national security and defense should be the organization and comprehensive protection of intellectual property, especially in the development of armaments and military equipment.

Can intellectual property protection promote trade credit financing of high-tech enterprises: evidence from the Chinese ‘three-in-one trial’ reform

Whether the intellectual property protection (IPP) system can improve the financing environment for enterprise innovation is a poorly studied research issue. Taking the Chinese ‘three-in-one trial’ reform of intellectual property rights (IPRs) as a quasi-natural experiment; we investigate the impact of strengthening IPP on trade credit financing of high-tech enterprises. The results show that strengthening IPP can promote their trade credit by about 2%, and the technology market effect, innovation effect and information effect are the underlying mechanisms. Further tests indicate that the promotion effects of IPP are more obvious on high-tech enterprises with lower government support, lower proportion of fixed assets and healthier government–business relationship. Different from the previous literature, which focuses on the relationship between IPP and innovation activities or benefits, this article expands the literature by investigating its impact on innovation financing and fills the research gap of the impact of IPP on capital market information searching.

Evolutionary Game Analysis of E-Commerce Intellectual Property Social Cogovernance with Collective Organizations

China’s E-commerce market is very active. Despite the impact of COVID-19, the market has ushered in major development opportunities. Alongside, the level of intellectual property protection in China is constantly improving. However, there are relatively few studies on intellectual property protection in the field of E-commerce. This study introduces the theory of social cogovernance and explores the construction of China’s E-commerce intellectual property protection system with the participation of collective organizations. Evolutionary game method is applied to model construction. Through numerical simulation, the study analyzes the evolution of E-commerce platform and collective organization strategic choice. The results depict that improving the open space provided by E-commerce platforms for collective organizations and strengthening their public service capabilities can promote the construction of social cogovernance systems. The establishment of reasonable reward and punishment mechanisms can increase cooperation enthusiasm. We also discuss the theoretical and practical implications for governments, E-commerce platforms, and collective organizations, to improve the level of intellectual property protection in E-commerce. This study can provide suggestions for China’s E-commerce intellectual property protection, improve the overall level of intellectual property protection in China, and provide a reference for global E-commerce intellectual property protection.

Економіко-правові засади захисту інтелектуальної власності: український та європейський досвід

The article is devoted to the identification and substantiation of economic and legal foundations of the system of intellectual property protection from the standpoint of the formation of domestic and European experience. The current stage of development of the world raises the issue of intellectual property protection in the context of ensuring economic development and increasing their attractiveness for international cooperation. Approaches to the definition of «intellectual property», objects of intellectual property and industrial property and their classification are widely covered in the scientific literature. It is determined that the object of intellectual property is an intangible result of intellectual activity, recorded on a tangible medium, and gives its author the exclusive ownership of this result, which is acquired, exercised and protected in accordance with applicable law. Given the importance of intellectual property for the development of countries, intellectual property law was formed as a separate sub-branch of civil law. It is established that the protection and defense of intellectual property is possible provided that the relevant legal framework. Modern legislation in the field of intellectual property includes the Constitution, Codes and Laws of Ukraine, Decrees of the President of Ukraine and Resolutions and orders of the Cabinet of Ministers of Ukraine, current standards in the field of intellectual property, departmental regulations, international treaties and agreements in the field of intellectual property. The institutional basis of the state system of legal protection of intellectual property is a number of specialized institutions with defined tasks and functions. The strategic tasks of the state on the development and protection of intellectual property in Ukraine are performed by the National Intellectual Property Office. Modern processes of reforming the system of intellectual property protection are associated with the process of European integration and implementation of the provisions of the Association Agreement between Ukraine and the EU.
