Sport plays an important role in the life of society and protection of the rights, freedoms and interests of its members. Through sport and its principles of equality, respect and fair play, we can unite people across borders and overcome social, cultural and economic barriers. Sports can teach us valuable lessons about non-discrimination and inclusion, and can show us what equal participation should look like. Sport can challenge stereotypes, helping us to break down barriers in society and promote progress on issues that are fundamental to the exercise and realization of fundamental human rights. At any level, sport can bring enormous value—for the competition, the participants, and the fans. Sports have powerful tools not only for changing the human experience of life, but also for uniting nations, cultures and communities from around the world. Speaking at an international conference on sports, Pope Francis recognized that: «... sports is a human activity of great value that can enrich people’s lives...». An important characteristic of sports, the Pope noted, is: «...the beauty and joy present in sports, whether playing or watching, is something that benefits and unites everyone, regardless of religion, ethnic group, nationality or disability».Within the framework of the national normative array, sports guarantees are given a lot of attention, in particular, among the current acts that regulate and mention the right to sport, we can to list: Laws of Ukraine «On physical culture and sports», «On support of the Olympic, Paralympic movement and sports of the highest achievements in Ukraine», «On the rehabilitation of persons with disabilities in Ukraine», «On the management of state-owned objects», «On advertising», Decrees of the President of Ukraine «On the development and support of the Paralympic movement in Ukraine», «On measures for physical culture and sports rehabilitation persons with disabilities and support of the Paralympic and Deaflympic movement in Ukraine», «On state scholarships to champions and prize-winners of the Olympic, Paralympic and Deaflympic Games», «On scholarships of the President of Ukraine for children with disabilities who have high achievements in all-Ukrainian sports competitions, and their coaches », etc., as well as numerous bylaws.Thus, with regard to enshrining the guarantee of the right to sport in the Constitution of Ukraine, it is worth noting that such a guarantee can contribute to increasing the level of physical culture and sports in the country. The national constitution contains principles that must be followed in all areas of the country’s life, and sports in this case is no exception.This constitutional guarantee can serve as an additional means of protecting the right to sport, as well as provide a legal basis for the development of physical culture and sports in the country. The latter is an important step in the direction of ensuring the availability of sports for all citizens of Ukraine.In addition, let us add that enshrining the guarantee of the right to sport in the Constitution of Ukraine is expedient, provided that it will be implemented in practice and will have a sufficient legal basis for its protection.
