Environmental Law Enforcement in Waste Management Based on Good Environmental Governance Principles in Denpasar City

Waste management is still an unresolved problem. This study aims to examine problems in waste management in the city of Denpasar. This research is empirical legal research with a statutory approach. Data was collected with primary and secondary data and then analyzed qualitatively. Several laws and regulations correlate with waste management in Indonesia, namely Law No. 18 of 2008 concerning Waste Protection and Management. Structure, substance, and culture are three legal systems combined to make up law enforcement in the waste management industry. Moreover, there are two perspectives on law enforcement in waste management: preventive law enforcement and repressive law enforcement. To increase public awareness of a good and healthy environment, law enforcement in waste management also embraces the principles of Good Environmental Governance of the federal and municipal governments. The study results show that the Denpasar City Government already has mentoring rules regarding waste management. However, waste management based on good environmental governance in Denpasar City has not been effective. This is because the community and the lack of public awareness of healthy living still commit many violations. Thus, the government still needs to improve and increase the regulation and supervision of waste management in Denpasar City.

Good Environmental Governance Roles in Sustainable Solid Waste Management in Indonesia: A Review

Indonesia is an archipelagic country consisting of more than 17,500 islands. Urbanization and community agglomeration in urban areas in Indonesia are increasing the complexity of solid waste management in Indonesia. The old paradigm of 'collect-transport-disposal' waste management still occurs frequently in cities in Indonesia. This research is designed to be a systematic qualitative review. The relationships between good environmental governance and sustainable solid waste management are synthesized from a perspective of current conditions in Indonesia. The solution to sustainable waste management is generally carried out through well-organized waste management in an integrated manner from upstream to downstream with a 'cradle-to-grave' mindset, including the impacts that may arise therein. Implementing sustainable solid waste management requires commitment and support from all aspects of stakeholders. Good environmental governance is a comprehensive, dynamic, and complex concept that attempts to improve environmental conditions while promoting sustainable solid waste management. The results show that good environmental governance is very influential for sustainable solid waste management, but it still needs to be implemented optimally in Indonesia. Integration and synchronization of policies between the central government and local government must be further improved to implement good environmental governance.

Management of Green Open Space in the Karanganyar Regency Government Based on the Principles of Good Environmental Governance

The high level of industrial development in Indonesia is parallel to population growth which has an impact on changes in land use. Green Open Space or RTH is the smallest part of an area in a city or district which is used not only as an aesthetic area but also as a green area as a place for community activities with a health connotation. Green open areas in Karanganyar Regency have not yet reached the applicable standards by Karanganayar Regency Regional Regulation No. 12 of 2022 concerning the Management of Green Open Spaces. The research method uses qualitative descriptive and data collection techniques by interviewing various data sources, conducting direct observations in the field, library research, documentation. Government websites and Instagram, transparency, and accountability, access to information through local government websites, and reporting in the annual LKPJ, decentralization is not yet strong enough but decision-makers are still the authorities and institutions and agencies, do not have their own RTH institutions, but each section carries out duties according to its main duties, access to law enforcement, complaints are submitted on the online public application and complaint service website, and the open spaces of Karanganyar Regency can be accessed by the public. The overall analysis is quite good, but several aspects are less than optimal, namely decentralization. So there needs to be innovation from the Karanganyar Regency government.

Portrait of Environmental Governance in Waste Management in Malang City

The government has set the main national targets for waste management, namely 30% waste reduction and 70% waste handling by 2025. However, waste generation in Malang City continues to increase yearly and is included in the high category in East Java. This study aims to analyze waste management in Malang City from an environmental governance perspective. The environmental governance perspective can be analyzed using Belbase's theory with seven indicators of good environmental governance, namely 1. the rule of law, 2. participation and representation, 3. access to information, 4. transparency and accountability, 5 decentralization, 6. institutions and institutions, 7. access to justice. Data collection was carried out using interviews, observation, and literature study. The data analysis used in this study is the interactive model analysis of Miles, Huberman, and Saldana. The portrait of environmental governance in Malang City waste management must fully reflect the principles of good environmental governance. This is because there are still records in the indicators of the rule of law, participation, and representation, as well as institutions and institutions. Constraints faced in waste management in Malang City include needing to be fully implemented, not yet maximal public awareness in reducing and sorting household waste, as well as institutions and institutions that could be more optimal in waste management.

The role of waste banks in realizing good environmental governance in Bandarlampung City

Purpose: The aim of this research is to analyze the effectiveness of implementing the Waste Bank as an indicator of achieving the principles of Good Environmental Governance in Bandarlampung City in order to increase public awareness regarding the importance of a healthy environment. Research methodology: This study employs a normative method using a descriptive analysis approach. Secondary data were acquired through meticulous literature review and subjected to qualitative analysis. Rigorous literature selection ensured data validity. The outcomes of the analysis served as the basis for accurate conclusions within the research. Results: The research results show that the role of waste banks as an indicator of the principles of good environmental governance in Bandarlampung is not yet effective. Therefore, law enforcement is needed, which covers three aspects: structure, substance, and community culture. Limitations: The population growth in Indonesia, especially in urban areas, is dynamic. This causes a high population, which results in the accumulation of rubbish in people's lives. Contributions: Ineffective waste management is the basic reason for the Bandarlampung City Government to collaborate with Bandarlampung City Cleaning Service to socialize the role of waste banks. This socialization activity is an effort to enable people to carry out 3M activities (Draining, Covering and Burying) and use waste as a business opportunity.

Ecojustice As an Embodiment of the Principle of Good Environmental Governance

The Administrative Court is a judiciary body with the competence to exercise external control over government legal actions to protect the rights of a good and healthy environment. The research aims to know the role of the Administrative Court in giving ecojustice and the embodiment of principles of good environmental governance. This is normative legal research using primary and secondary data. Judge verdict in Administrative Court decides dispute concerning environmental permission was based on environmental purposes and principles of good environmental governance. The principle of society participation has been implemented in some municipalities; it can be seen in the local regulations made by the Regent or Mayor. Although it was not perfectly executed, it was still a step forward in local government. Obstacles arise from the need for more knowledge and awareness about environmental protection and system of management by the officer and society.

A study of the required sustainability-driven institutional and behavioural mechanisms to tackle the anticipated implications of agricultural water price shocks: a system dynamics approach

Economic policies for managing agricultural water use are often complicated by the challenge of using water prices as an efficient economic tool when other non-economic concerns are involved in the decision-making process. This study aims to analyse the impact of water pricing policies on preserving agricultural water resources in Iran. This study applies a system dynamics approach to simulate the system performance and behaviour of stakeholders and the economic implications. Our finding shows that water pricing policies will likely fail due to low water price elasticity and if there are lack of institutional and physical infrastructure, alternative professions, manufacturing technology, education, and training opportunities. The results also illustrate how agricultural water price increase (AWPI) fails to reduce water consumption in the absence of an adequate institutional arrangement. Also, it shows how the lack of advanced institutional infrastructure in the presence of physical infrastructure enhances pervasive overuse and destructive competition among stakeholders by increasing the area under cultivation. In the discussion, the paper portrays a way out of the decision-making body by following AWPI effects on water conservation in the agricultural sector as the most significant water consumer. It investigates the absence and subsequent presence of specific institutional conditions and evaluates training and enhancing farmers' skills and alternative career source with higher income and technology as the architecture of good environmental governance. Finally, it concludes that a series of inclusive measures must be considered to increase the elasticity of the water price. These measures must stimulate farmers towards pursuing the goals of global sustainable development and enhancing social welfare.

Environmental Court and Principle of Good Environmental Governance in Enforcing Environmental Law

Environment dispute settlement carried out by general and administrative court, depends on the object of disputes. Government has to based on principle of good environmental governance when issue the permit and policies. The issues are the urgency to build environmental court and implementation of principle of good environmental governance. Method use is juridical normative, primary data used are regulations, secondary data are expert opinions, articles. Data analysis qualitatively and describe in descriptive analysis. Environmental court will be under Administrative Court as special court, which comprises of private, penal and administrative chamber. Implementation of principle of good environmental governance through issue permit, policies and supported by strengthen law enforcement. Regulations as based of law to build environmental court has to be synchronized with relevant regulations in order to enforce the environmental law enforcement and gives environmental justice. Novelty in this research is build environmental court to strengthen environmental law enforcement.

Pengaruh Good Corporate Governance dan Environmental Social Governance terhadap Nilai Perusahaan dengan Kinerja Keuangan Sebagai Moderasi

The faster information spreads, the more important it is for companies to publish good things and minimize issues that can have a negative impact on company reputation and value. Publication of positive information such as the application of good governance and disclosure of social responsibility among cases and issues of rampant corruption and environmental pollution is very attractive for investors to take into consideration in investing. Therefore, this study aims to examine the influence of Good Corporate Governance and Environmental Social Governance on Corporate Values ​​with Financial Performance as Moderation. This research uses a sample of 16 companies which have been listed on the Indonesia Stock Exchange for 3 consecutive years, participating in the CGPI assessment program and also the ESG Refinitiv Scores in the 2019 – 2021 period. The research sample was determined using a purposive sampling method. This type of research and data used is quantitative with secondary data. The analytical method used is panel regression analysis and moderation regression analysis. This study after being moderated by Financial Performance (ROA) can provide results that significantly strengthen the effect of Good Corporate Governance and Environmental Social Governance on Corporate Values, whereas before being moderated both have no influence on Corporate Values. This study also uses company size as a control variable.

Emissions trading scheme and green development in China: Impact of city heterogeneity

AbstractThe emissions trading scheme (ETS) is a key policy tool for reducing carbon emissions and combating climate change but may cause unintended social‐economic consequences. Clarifying the role of city heterogeneity can contribute to improving ETS policy and informing green development roadmaps. Using panel data of 274 Chinese prefecture‐level cities, the heterogeneous impacts of ETS on city green development efficiency (CGDE) were assessed by the difference in difference in difference (DDD) method. The results show that: the ETS significantly advances China's CGDE, mainly through inducing cities' green innovation. More insightfully, the ETS policy has more significant positive effects on the cities in the eastern region, high economic development, resource abundance, and good environmental governance than otherwise. The study suggests that designing the ETS should incorporate the cities' heterogeneous characteristics to accelerate green development through green innovation and cover more regions and industries.

Pengelolaan Sampah Melalui PLTSa Di Indonesia Untuk Mewujudkan Net Zero Emission

The goal of this paper is to conduct a normative analysis of the PLTSa development in Indonesia as a form of net-zero emissions policy. This research is normative and conducted through library research utilizing the statute approach method. It is done by looking normatively at the relevant statutory regulations. So, utilizing the theory developed by Hans Kelsen and Nawiasky, known as the stufenbau theory, he concentrates on the discussion of statutory regulations connected to PLTSa development in the discussion part and the study findings. Examining if different legal frameworks governing PLTSa development in Indonesia are harmonized is the goal. Additionally, the discussion and research findings in this paper draw on studies of the literature from a range of sources that address the integration of the Sustainable Development Goals (SDGs) and the principles of Good Environmental Governance in Indonesia's PLTSa development plans. According to the research in this paper, it can be concluded that PLTSa development in Indonesia can positively influence efforts to achieve net zero emissions, and that PLTSa use in waste management is a form of environmental protection that is consistent with the objectives of sustainable development. In order to develop and administer PLTSa in Indonesia, the government still needs to take into account a number of factors, starting with the implementation of these policies and statutory regulations. in order for the PLTSa policy optimization to work effectively.

How does digital governance affect the level of domestic waste separation for rural residents? Empirical evidence from rural areas in Jiangsu Province, China.

The management of rural domestic waste is directly related to the quality of China's rural habitat and the ecological security of the countryside, and is one of the important tasks of rural revitalization. Based on the perspective of digital technology empowering rural governance, this study uses the China Land Economic Survey (CLES) data to empirically test the impact of digital governance on the level of domestic waste separation for rural residents by constructing the ordered probit model. The results show that in the process of rural governance modernization, digital governance helps to improve the level of domestic waste separation for rural residents in the process of rural governance modernization, and the findings still hold after robustness tests. Mechanistic tests showed that digital governance can impact the level of domestic waste separation for rural residents through cadre-mass relationship and institutional trust. The findings of this study provide a new perspective on good environmental governance in China's countryside and have important implications for promoting the improvement of rural habitat quality.

Costs and Benefits of Energy and Major Natural Resources Extractive Industrial Operations on Communities: Spotlight on Host Communities Development Regime in Nigeria’s Petroleum Industry Act, 2021

Landmark studies and follow-up scholarly researches, as well as practical evidences around the globe on energy and major natural resources extractive industrial operations (EIOs), such as petroleum (oil and gas) and other mining and mineral resources EIOs, are consistently demonstrating that EIOs inhibit sustainable development (SD). Conversely, the findings of such foremost scholarly studies and their follow-up measures, as well as practical evidences regarding energy and major natural resources EIOs around the globe, are revealing that these operations may contribute to SD. In other words, EIOs may contribute to SD when they are implemented well, in conformity with international benchmarked standards and practices. In that case, EIOs are advantageous in the nooks and crannies of the world, when they are executed in a way that occasions socio-economic advancement in host countries, including resource-rich areas of such countries. In the circumstances, EIOs may be considered to have been implemented in ways that preserve the rights of members of the public, especially those that are adversely affected directly by extractive industrial projects, such as those of resource-rich communities, and when the benefits derived from these projects are directed towards overall public good in host countries. On this note, EIOs may contribute to SD in developing countries, through good environmental governance, towards generic good governance and overall public good. Considering the foregoing negative impacts and possible positive contributions of EIOs, this study will explore the costs and benefits of petroleum EIOs on the resource-rich and other direct negatively impacted host communities of Nigeria, in the framework of the country’s Petroleum Industry Act, 2021, concerning the development of host communities, and thereby arrive at appropriate findings.

Good Environmental Governance Mainstreaming in Preparation for the Implementation of Carbon Trading in Indonesia

Climate change is a global problem that is often echoed. Indonesia has an obligation to reduce greenhouse gas emissions by 29%-41% in accordance with Indonesia's commitment in the Nationally Determined Contribution (NDC). The Government's initiative in reducing Indonesia's greenhouse gas emissions was then demonstrated by issuing Presidential Regulation Number 98 of 2021 which regulates the implementation of carbon economic values carried out through mitigation and adaptation efforts. One of the steps mentioned as mitigation and adaptation efforts is carbon trading. Carbon trading is the answer to the conflicting interests of pursuing a reduction in greenhouse gas emission targets as well as increasing economic growth in Indonesia. This is supported by the existence of several factors that make carbon trading a great potential in Indonesia, including economic factors, environmental factors, and legal factors. This research is a normative juridical research and uses non-interactive qualitative research methods. In this study it was found that using the principles of Good Environmental Governance (GEG) can be a solution for the implementation of carbon trading in Indonesia later. That is by using the GEG principles which include participation, accountability, transparency, rule of law, and effectiveness and efficiency. With the implementation of this principle, the Government should immediately prepare itself carefully. Furthermore, the implementation of GEG needs to be supported by strong political will. Thus, carbon trading can be carried out optimally and bring benefits to all Indonesian people

Fragmented Agencies in Public Sector: An Obstruction to Indonesia’s Climate Policy Implementation

Member states of the United Nations Framework on Climate Change (UNFCCC) are urged to limit its emission in order to maintain global temperature to 1.5 degrees Celsius that is textualised in the Glasgow Climate pact. In order to implement the mandate, Indonesia introduced several policies at national level. However, emerging issues in the public sector challenges the implementation of climate policy: fragmented agencies. This research attempts to address two questions; How fragmenting agencies impacts the implementation of climate policies? How can the implementation be possible amidst the emergence of fragmented agencies? This research utilises normative-empirical methods, where it would normatively analyse environmental policy agenda problems in selected ministries as public sector actors, while it would empirically examine the impact on the issue. This research shows that the issue of fragmented agencies in Indonesia has become the main obstacle in implementing climate policies due to the unsynchronized sectoral policy with the current climate policies in each ministry, where such fragmentation then obstructs good environmental governance. Furthermore, the implementation of Indonesia’s environmental and climate policies would not be optimally implemented if the aforementioned issue cannot be resolved through each ministries agenda restructuration. Another recommendation is to utilise the Penta Helix method in optimising climate policy implementation by multisectoral cooperation in climate policy.

Good Environmental Governance Model in Domestic Waste Management in Batang Arau, West Sumatera

River damage is often caused by human activities, one of which is massive domestic waste pollution in river flows. Using the Good Environmental Governance model, this study analyzes domestic waste management in Batang Arau, Padang City. This type of qualitative research with data analysis techniques Manual Data Analysis Procedure (MDAP). The results show that the domestic waste management of the Batang Arau City of Padang has not yet implemented the Good Environmental Governance model. Field data illustrates several pillars of Good Environmental Governance, such as low community participation, access to information on domestic waste management is not available, and Transparency and Accountability of domestic waste management in Batang Arau are constrained due to the difficulty of collecting domestic community data. Waste. Domestic waste processing in Padang City has not been decentralized and is still centralized. Environmental management institutions in Padang City have not been well integrated because there are still sectoral egos between institutions. The obstacle to managing Batang Arau domestic waste is that the Wastewater Treatment Plant in the city of Padang has not appropriately been facilitated in the city of Padang.

Good environmental governance: Predicting PM2.5 by using Spatiotemporal Matrix Factorization generative adversarial network

In the context of low-carbon globalization, green development has become the common pursuit of all countries and the theme of China’s development in the new era. Fine particulate matter (PM2.5) is one of the main challenges affecting air quality, and how to accurately predict PM2.5 plays a pivotal role in environmental governance. However, traditional data-driven approaches and deep learning methods for prediction rarely consider spatiotemporal features. Furthermore, different regions always have various implicit or hidden states, which have rarely been considered in the off-the-shelf model. To solve these problems, this study proposed a novel Spatial-Temporal Matrix Factorization Generative Adversarial Network (ST MFGAN) to capture spatiotemporal correlations and overcome the regional diversity problem at the same time. Specifically, Generative Adversarial Network (GAN) composed of graph Convolutional Network (GCN) and Long-Short-Term Memory (LSTM) network is used to generate a large amount of reliable spatiotemporal data, and matrix factorization network is used to decompose the vector output by GAN into multiple sub-networks. PM2.5 are finally combined and jointly predicted by the fusion layer. Extensive experiments show the superiority of the newly designed method.

Mainstreaming Ecosystem Services from Indonesia’s Remaining Forests

With 120 million hectares of forest area, Indonesia has the third largest area of biodiversity-rich tropical forests in the world, and it is well-known as a mega-biodiversity country. However, in 2020, only 70 percent of this area remained forested. The government has consistently undertaken corrective actions to achieve Sustainable Development Goal targets, with a special focus on Goals #1 (no poverty), #2 (zero hunger), #3 (good health and well-being), #7 (affordable and clean energy), #8 (decent work and economic growth), #13 (climate action), and #15 (life on land). Good environmental governance is a core concept in Indonesia’s forest management and includes mainstreaming ecosystem services as a framework for sustainable forest management. This paper analyzes efforts to mainstream Indonesia’s remaining forest ecosystem services. We review the state of Indonesia’s forests in relation to deforestation dynamics, climate change, and ecosystem service potential and options and provide recommendations for mainstreaming strategies regarding aspects of policy, planning, and implementation, as well as the process of the articulation of ecosystem services and their alternative funding.

Implementation of Batang Arau Watershed Management with Good Environmental Governance Perspective

The relationship between the environment and economy and people's consumption is still contradictory in efforts to save the environment. Excessive consumption and production patterns lead to polluted rivers. This qualitative research aims to describe the management of the Batang Arau watershed from a GEG perspective. Primary data was collected with in-depth interviews regarding the condition. Secondary data was obtained study of documentation related to laws and regulations. Informants are determined by the purposive sampling method (Sugiyono, 2017). Informants are parties related to the watershed. Data obtained were analyzed with Manual Data Analysis Procedure (MDAP) technique 1. Results showed the management of the Batang Arau watershed had not been implemented following principles of Good Environmental Governance; findings in the field found that; Public awareness is low, the law of environmental protection has not been optimal, and access to industrial waste information has not been opened, the government response is quite good, and environmental consensus has not been reached, there is a sectoral ego, a long bureaucratic path, environmental responsibility is lacking. Constraints, unified management vision among stakeholders, insufficient budget and fleet, low supervision, IPAL facilities have not integrated, Illegal logging, and inter-sectoral coordination are still problematic. Efforts made by the government: Conducting socialization to the community, cleaning and dredging watershed, and normalizing and rehabilitating critical land. Management must be carried out thoroughly, so there is no gap between upstream and downstream. We argue to create a balanced ecosystem. The government needs to improve management as a whole with a Good Environmental Governance approach in every management action to create sustainable management.
