Rural settlement as a factor of administrative and territorial changes (on the example of Zakarpattia and Chernivtsi regions)

Purpose: to analyze the features of rural settlement in Zakarpattia and Chernivtsi regions and to identify its influence on the formation and functioning of territorial communities and districts of these regions. Methods. comparative-geographical, statistical, analytical method, structural-functional approach Results: the rural settlement network of the Zakarpattia and Chernivtsi regions was analyzed from a socio-geographic point of view, taking into account the similarity of natural and geographical conditions, historical, ethno-geographical aspects of the formation of settlements and modern socio-spatial processes in the regions. It is noted that the regions have a number of common features of rural settlement, in particular, high density and average population of settlements in the plain part and zones of dispersed settlement in mountainous areas, which must be taken into account in the process of formation of territorial communities. It is noted that according to the results of the ATU reform in the regions, rural communities absolutely prevail. This will contribute to the preservation of the demographic and socio-economic potential of rural settlements - community centers, however, in remote peripheral and depressed areas, rural communities may not be able to cope financially and administratively given the limitations of their own resources. Possible positive and negative consequences of the impact of the reform on changes in inter-settlement relations, functions of settlements, and their further development are identified and summarized. Conclusions: Intra-regional differences in rural settlement are an important factor in administrative-territorial changes and were taken into account in the process of formation of territorial communities and new districts. Most communities in both regions are rural; the settlements that became their centers received broad powers and prospects for development. In today's conditions, most rural communities cannot take advantage of the opportunities of decentralization due to the limited socio-economic potential of settlements. According to indicators of economic activity, these communities are mostly subsidized and require significant investment income. The development of rural areas will contribute to the strengthening of the grassroots link of the administrative-territorial system.

Організація соціально-економічного розвитку територіальних громад

Abstract. Introduction. Participants of the territorial community are united by a common territory of permanent residence, social interaction with each other, common territorial interests and needs of local significance, self-identification, common values and historical events, communal property, etc. Purpose. The purpose of the article is to deepen the theoretical and methodological foundations of the organization of socio-economic development of territorial communities. Results. The main shortcomings in the functioning of territorial communities are highlighted, among which: the presence of differences in the priority needs of communities and actions by local authorities to meet them; lack of a coordinated feedback mechanism with the local population; insufficient level of quality of services provided by local authorities; insufficient number of employees in local authorities. It is emphasized that the introduction of equal programs of socio-economic development is not rational because each region or community needs special, specialized actions by the authorities. The principles on the basis of which the voluntary association of territorial communities in Ukraine is formed are determined, among which: constitutionality and legality of the process of association of territorial communities; voluntariness of the subjects of the association; economic efficiency; state support; ubiquity of local self-government; transparency and openness; responsibility. Factors influencing the development, approval and implementation of programs of economic and social development of individual territorial communities are systematized, namely: political; ecological; financial and economic; social and others. Conclusions. It was found that the list of indicators of socio-economic development of the united territorial community should contain indicators that characterize the demographic situation; economic efficiency of the united territorial community; financial self-sufficiency; quality and availability of public services; creating comfortable living conditions. The structural elements of the plan of socio-economic development of the united territorial community are considered and it is emphasized that the main results of the plan of development of the territorial community should be published in regional media in order to adhere to the principles of transparency, openness and transparency.

Методичний підхід до ідентифікації проблем функціонування територіальних громад в умовах нестабільності

The article deals with the topical problem of spatial development of territorial communities. The study aims at creating a methodical approach to identifying the problems in the functioning of territorial communities, the former being caused by unstable conditions, and the areas of spatial development of territories using a problem-oriented approach. The application of a problem-oriented approach to the spatial development of territorial communities is substantiated. The approach provides a set of actions in public administration and influences aimed at solving theoretical or practical problems of efficiently using local community resources by gaining new competitive advantages, creating favorable living conditions, ensuring population loyalty through actively solving the already existing and possible problems in community functioning. Within the problem-oriented framework, the spatial development of united territorial communities involves an approach based on the hypothesis that using the strategic capacity of a territorial community is not a problem-free process, and the arising problems require analysis and sound management decisions at the community level and within the powers of local authorities. A methodical approach to identifying problems with the functioning of territorial communities in an unstable environment is suggested. Namely, it involves analyzing the following issues: a) development level of united territorial communities through evaluating their resource provision and self-assessment of their development level, which helps to draw conclusions as for the effectiveness of using the community resources; b) legislative support for the spatial development of territorial communities; and c) the existing mechanisms, methods, and instruments of the state policy on the spatial development of Ukrainian territories. A cognitive map of interrelations between the existing problems of the spatial development of territorial communities has been drafted, in which four groups of problems are identified, in particular: 1) problems within the spatial development of territorial communities, and those connected with Ukraine’s territorial system; 2) problems of socio-economic development based on self-sufficiency; 3) problems in the local self-government system; 4) problems of rural development.

THE PARADIGM OF CONTEMPORARY UNITARISM IN UKRAINE: ISSUES OF FORMATION AND IMPLEMENTATION

Aim. The article aims to investigate the essential and content characteristics of unitarism as a phenomenon of contemporary constitutional law. The synergistic connection between the doctrine of modern unitarism, the principles of unitarity of the state territory and the fundamental institutions of political-legal and state-administrative life of modern unitary states is shown. It proves that the unitary system is not only one of the important components of the process of accomplishing the tasks, goals and functions of most modern states, but also an immanent feature and strategic element of the mechanism of exercising their sovereign rights.
 Methods. The methodological basis encompasses philosophico-ideological, general scientific principles and approaches and special scientific methods of inquiry for constitutional and legal phenomena and processes. The philosophico-ideological basis of the study is the position of dialectics, on the basis of which the causes and factors of the evolution of unitarism are thoroughly investigated. In general, the research was conducted on the basis of a combination of ontological, epistemological and axiological analysis of contemporary unitarism.
 Results. The complexity, importance and relatively widespread use of unitarity as a form of government is causing a lively and ever-growing scientific interest in it throughout the world. The unique capability of unitarism to take into account the specific features of a particular condition allows it to manifest itself in each case in a new way. That is why it is important to analyze the mutual influence of unitary theory and practice, to explore and take into account the peculiarities of national unitarism.
 The problem of unitarism and the unitary form of the territorial structure of the state and the status of its constituents is one of the least studied in domestic constitutional law. Modern scholars studying constitutional law, as a rule, are limited to consideration of individual issues of the territory, in particular, the features of the territorial organization of state power and local self-government, problems of state sovereignty, territorial integrity and inviolability, etc. To a large extent, the problem has not been studied exhaustively in contemporary Ukraine which causes difficulties in understanding such interrelated but not identical phenomena as unitarism and unitarity, regionalism and regionalization, municipalism and municipalization, decentralization and deconcentration, etc. It should be noted that in modern literature related to problems of state territory, territorial organization of state power, and other issues of the status of territory, the complex, multidimensional nature of unitarism, as a constitutional category, is not always taken into account.
 Conclusions. Unitarism is proved to be a multidimensional socio-political and constitutional phenomenon: it is an idea, a theory, a scientific direction as well as a global social constitutional practice and a constitutional form of the existence and functioning of territorial communities, it is the historical condition of national statehood and Ukrainian regional civilization and the form of realization of the national identity and civic consciousness, etc.

Сутність і види територіальної громади: аналіз теоретичних аспектів

Each country forms its own systems of territorial organization of power and public administration, which occurs under the influence of the national, historical, geographical, natural, economic, social, cultural, demographic and other features. Considerable attention of researches of scholars and practitioners was paid to the creation and functioning of the territorial community. The choice of theoretical approaches and models of the territorial community influences the efficiency of the functioning of the local self-government system, the ability to fulfill the assigned powers, to ensure a high level of quality of life of citizens and sustainable development of the territory. Studies of global and domestic experience allow to systematize the accumulated knowledge on this issue, which makes it possible to offer a national system of public administration at both the central and the local levels using the best theoretical and practical developments of the countries of the world. Formation of the definition of the concept of the territorial community was carried out over a long historical period under the influence of versatile scientific judgments, ideas, theoretical approaches, practical research. The analysis and study of foreign and domestic experience on this issue is characterized by various formulations, views, principles, signs, etc. regarding the formation and functioning of territorial communities. In parallel with the phrase «territorial community», researchers use other names, such as commune, territorial communion, territorial collectivity, local co-partnership, socio-territorial community, etc. The lack of currently generalized scientific opinion regarding the specification of the content of a certain term, the variety of volumes and approaches to its interpretation confirms the expediency of further research on this topic.

Analyzing the complex of essential and substantive characteristics of unitarism as a phenomenon of modern constitutional law, outlines perspective directions of development of the unitarian doctrine. The synergistic connection between the theory of modern unitarism, the principles of unitarity of the state territory and the fundamental institutions of political-legal and state-administrative life of modern unitary states is shown. It proves that the unitary system is not only one of the important components of the process of achieving the tasks, goals and functions of most modern states, but also an immanent feature and strategic element of the mechanism of exercising their sovereign rights. Considering that unitarism is a multidimensional socio-political and constitutional phenomenon: it is an idea, a theory, a scientific direction, and a global social and constitutional practice, and a constitutional form of the existence and functioning of territorial communities, and the historical state of national statehood and Ukrainian regional civilization, and the form of realization of national identity and citizenship, etc., concludes the relevance and necessity of forming a unitarist discourse in modern constitutional law science and education. In the opinion of the author, consistent conceptualization and institutionalization of the unitarist doctrine will allow us to understand the deep processes that determine the emergence of the phenomenon of national unitarism, testify to the enormous civilizational role and axiological, ontological, epistemological, functional and psycho-logical features in the course of its political structuring, formation of market economy relations, implementation of eco-humanistic national security and defence.

Удосконалення фінансової основи місцевого самоврядування в контексті децентралізації, реалізації бюджетної та податкової політики держави

Розвиток сучасного муніципального права України відбувається на якісно новому рівні. Концепції децентралізації, деконцентрації державної влади, зокрема децентралізації фінансів, є предметом посиленої уваги під час політико-правових дискусій і практичного втілення результатів доктринальних та інших теоретичних досліджень. Мета цієї публікації – запропонувати шляхи розв’язання проблем правового регулювання процесу фінансової децентралізації в Україні на підставі результатів аналізу законодавства, а також подальшого вдосконалення фінансової основи територіальних громад і системи місцевого самоврядування в Україні. Методологія. Для досягнення окресленої мети застосовано загальнонаукові методи, насамперед – діалектичний метод наукового пізнання реальних явищ, а також акцентовано на його використанні під час дослідження діяльності органів місцевого самоврядування в Україні. Визначальними є також спеціальні методи дослідження: метод системного аналізу; системно-структурний – для висвітлення змісту досліджуваних категорій і правових явищ, формування понятійно-категоріального апарату; порівняльно-правовий, формально-логічний, статистичний, прогностичний тощо. Наукова новизна статті полягає в удосконаленні теоретичного розуміння змісту фінансової децентралізації на рівні місцевого самоврядування. Реалізація права на місцеве самоврядування, захист законних інтересів членів територіальних громад, які покладено на органи й посадових осіб місцевого самоврядування, потребують перегляду пріоритетів і напрямів бюджетної та податкової політики держави в сучасних умовах, здійснення фінансової децентралізації в інтересах громад і місцевих жителів. Висновки. Одним із напрямів сучасної муніципальної реформи в Україні є децентралізація державно-владних повноважень, зокрема її різновид – фінансова децентралізація. На підставі результатів аналізу проблемних питань створення та функціонування територіальних громад як юридичних осіб публічного права визначено перспективи вдосконалення їхнього статусу, фінансових та інших засад організації, діяльності територіальних громад. Вивчення співвідношення централізації та децентралізації державно-владних повноважень, реформи міжбюджетних відносин дали змогу сформулювати пропозиції щодо підвищення рівня ефективності інституційного та нормативного механізмів діяльності системи місцевого самоврядування, продовження фінансової децентралізації з метою забезпечення соціально-економічного розвитку територіальних громад в Україні.

IDENTIFICATION OF RISKS IN THE FIELD OF HEALTHCARE AND THEIR INFLUENCE ON THE FUNCTIONING OF TERRITORIAL COMMUNITIES IN THE CONDITIONS OF IMPLEMENTATION OF MODERN REFORMS

Introduction. Among the measures to ensure the well-being of communities, one of the most important is health care, which in Ukrainian reality is largely due to high mortality rates, reduced life expectancy and low satisfaction of community residents with the quality of health care. Goal. Identification of health risks, identification of their impact on the functioning of local communities and development of a set of measures aimed at their leveling. Method (methodology). Methods of logical generalization, analysis, comparison and synthesis are used to identify risks in the health care system and justify measures to minimize them. Results. Identified organizational and institutional, functional, financial risks in the health care system; an analytical study was carried out and the peculiarities of their influence on the functioning of territorial communities were clarified. A set of measures aimed at the effective functioning of health care at the territorial community level and minimization of negative consequences in terms of identified risks, namely: organizational and institutional (legislative definition of secondary and tertiary levels of health care, taking into account administrative and territorial features of primary health care). Assistance in determining the capitalization rate and the abolition of limitation of declarations in rural areas); financial (establishment of an effective mechanism for financing primary health care in the local community, elimination of inefficient expenditures, application of financial incentives for employees of health care facilities of the local community); functional risks (establishing partnerships between local governments and the management of the primary care institution, stimulating and encouraging local governments to develop medicine in the local community, control over the conditions of remuneration of primary care physicians).

Financial capacity of territorial communities in the context of evaluating the results of administrative and financial decentralization

The article investigates the theoretical foundations of the financial capacity of territorial communities. Parameters of estimation of territorial communities’ financial capacity in the context of achievement of administrative-financial decentralization results are characterized. The necessity of improvement of criteria of territorial communities’ financial capacity is determined in terms of identification of sources of personal income tax, number of operating enterprises in the territory of the territorial community and the number of payers. Attention is paid to the need of improvement of the methodological basis for calculating the taxability index by taking into account the size of the able-bodied population, the median distribution of income tax per capita weighted by the population, and inclusion in the calculation of Kyiv city budget. The peculiarities of formation and use of financial resources of the territorial communities of Lviv and Poltava regions are clarified. The scientific and methodological approach to the evaluation of the financial capacity of territorial communities is improved by determining the priority of their expenditures, the interdependence of their own revenues and transfers with the financing of public services at the level of territorial communities. The directions of increasing the efficiency of functioning of territorial communities are outlined. Based on the assessment of the interdependence of the amount of generated financial resources and the financing of public services at the level of the territorial communities of Poltava region, it is determined that the growth of own revenues should be ensured for their proper functioning, first of all, through efficient use of their own financial and economic potential; parity in the ratio of economic and social expenditures in order to generate long-term positive effects of socio-economic development of territorial communities; diversification of functional expenditures for comprehensive provision of public services at the level of territorial communities.

Theoretical and methodological foundations of the organizational construction and functioning of territorial communities as integrated socio-economic organizations

The scientific positions on the necessity of deepening, expanding and using the theory of organization when building and developing specific social organizations – territorial communities – are grounded. It is shown their compatibility and identity with organizations of production character.A comparative analysis of the evolution and methodological and legislative support for using the organization’s theory to use its instrumants in the construction and functioning of territorial communities is carried out.Issues of importance, priority of consideration and solving problems of organizational development of territorial communities as a set of complex, integrated social and economic organizations and social institutions of organizational forms of development of society at the basic, initial level of its existence in conditions of decentralization of power and modernization of local self-government are outlined.The evolutionary way of the organization theory, the methodological and legislative principles of which are aimed at the organizational development of enterprises with a predominantly productive nature is studied, including the principles of constructing a bureaucratic model of the organization structure, the principles of constructing human relationships, the principles of the theory of perception, and others. Determination of the possibilities of using the laws on organization and functioning of organizations for the formation and functioning of territorial communities as integrated socio-economic complex organizations is carried out. The essence of the models of organizations and their management tasks as a possible organizational ground for improvement of organizational models of community development is considered.The proof of the necessity of further development of the organization’s theory concerning the organizations of a new type – territorial communities, whose activities are ensured by the common territory of people living, in different organizations, the interconnection, orderliness and interdependence of their joint activities, the unity of the goals of joint development and participation of community residents in their achievement. The algorithm of the formation and substantiation of theoretical and methodological formulation of the organization’s theory concerning social organizations as the basis of the modern innovation organization of territorial communities is constructed.

Municipal legal problems of realization and protection of human rights depending on belonging to the LGBT community

The article is devoted to the study of the process of formation and realization of the rights of persons belonging to the LGBT community in the context of local self-government and the functioning of territorial communities. In the article is investigated the concept and nature of identity as self-determination, self-identification as a representative of a particular social group in the context of the human rights for LGBT. It is proved that the identity itself cannot be a basis for discrimination. Attention is drawn to the importance of the immediate implementation of the principle of respect for the identity of the person, combating and prevention of marginalization and demonization of minorities.It is reported that acts on human rights of international importance and legislation of the most countries of the world, including Ukraine, are based on the principles of justice, equality and non-discrimination. The author justifies the position that the lack of effective mechanism of protection of human rights and non-discrimination based on sexual orientation both at national and municipal levels inevitably conflict with the ideas of social legal state and civil society. In this regard, it is concluded that the development of an effective human rights protection municipal mechanism and prohibition of discrimination based on sexual orientation are a significant target to achieve.

Децентралізація та місцеве самоврядування у гендерному вимірі: вітчизняний досвід та міжнародні стандарти.

The problems of the theory and practice of ensuring the principles of non-discrimination on the basis of and equality in local self-government are considered. In modern international political and sociological discourse, the notion of local self-government, decentralization and the functioning of territorial communities are often considered in connection with the concept of gender. Attention is focused on the fact that gender means not just adding a female component to projects and programs. It is, first of all, an analysis and consideration of the various conditions and requirements for women and men, the roles they play in society as a whole, and in the territorial communities and processes of decentralization of public authority, in particular. After all, the idea of the value of a human person, his rights and freedoms at the local level – within the limits of local self-government and processes of institutionalization of the municipal authority – is most clearly shown and is tested. Recognition and formation in Ukraine of local self-government, deep economic and political transformations in society and the formation of a new democratic state on this basis are directly related to the development and practical implementation of fundamentally new approaches to human rights and freedoms for us, to resolve both national and regional, as well as local problems in this area. The main international standards are analyzed, as well as acts of national legislation proclaiming these principles.Among the key challenges and opportunities for equality in Ukraine: promoting mainstreaming in local self-government and strengthening the role of territorial communities in this area, introducing a gender perspective in policy at the local level to ensure access to state and municipal policies for all citizens who have an impact on the daily life of women and men, the elimination of stereotypes in the territorial communities and the promotion of equality and local-regional dimension functioning of society, the development and implementation of strategies for equality and mainstreaming in various aspects of life of local communities and of local government and so on. One of the most gender-sensitive issues characteristic of modern Ukraine is their limited access of women to the authorities in general and the municipal authorities, in particular.It proves that local self-government is one of the most gender-sensitive forms of democracy.

АНАЛІЗУВАННЯ ФІНАНСОВОЇ РОБОТИ ТЕРИТОРІАЛЬНОЇ ГРОМАДИ

Reforming the system of public finances and administrative- territorial organization of Ukraine affects the formation of effective mechanisms for financial support of the functioning of territorial communities for their full involvement in the processes of socio-economic growth of the state. In this context, the theoretical principles of the need to analyze the financial condition of territorial communities in Ukraine are considered. In accordance with modern domestic transformation processes, local self- government bodies are gradually becoming influential subjects of financing the development of territorial communities in Ukraine. In addition to them, today the important subjects in these processes are public authorities that provide funding for the development of territorial communities. The author of the study analyzed the financial work of Novostrilishchanskaya TG during 2019-2020. As a result, the amount of budget allocations increased by UAH 442082. Revenues from the provision of services also increased by UAH 6,668. The amount of income from exchange transactions increased by UAH 448,750,000. Tax revenues of the budget decreased by UAH 35,642. However, the total budget revenues increased by UAH 492,853. As for expenditures, there was a significant increase in expenditures for the implementation of budget programs by UAH 424,473. Based on the SWOT analysis, problems were identified and priority areas of community development were selected. The community has significant prospects for economic and social development, associated with a favorable geographical location, good transport links and hard work of community residents. It is substantiated that the financial support of territorial communities should be understood as the process of formation, distribution and use of financial resources in order to meet the needs and interests of citizens in all spheres of life in the territory. In this context, the main priority areas of financial development of the community for the next 3-5 years are proposed. Effective methods of analysis of financial work for construction of strategy of development of territorial communities are defined.
