Video Consultation Hours in the Statutory Accident Insurance - Application Possibilities and Economic Evaluation

Video consultations are becoming more and more important for health care providers as they enable new treatment options. Since 2017 video consultations have been used by the public health insurance companies in Germany. However, similar options are lacking in the employer's liability insurance association (BG in Germany) health insurance system. The aim of this article is to present and discuss possible applications of video consultations in the latter system and to evaluate economic advantages. Possible applications of video consultations are discussed in the context of feasibility, potential benefits and the existing scale of fees for physicians (in Germany UV-GOÄ). Video consultations can be used for follow-up evaluations as well as preparation for initial medical examinations especially in complex cases and for case conferences. Even though video consultations are not included in the reimbursement system, similar CPT codes (current procedural terminology) already do exist. Video consultations might help improve the quality and reduce the costs of the public health insurance system. Furthermore, since video consultations can be expected to become more important in the future, they should be included as a standard tool in the employer's liability insurance association insurance system and an adequate reimbursement system be established.

Traumatische Ruptur eines Hydrogel-Brustimplantates: Ein Fall für die Berufsgenossenschaft?

Today textured breast implants for augmentation and reconstruction are commonly used to reduce the incidence of capsular contractures. Despite modified surfaces, capsular contracture may occur as result of traumatic or iatrogenic ruptures of the implant along with discharge of filling material.We report the interesting case of a female patient with traumatic rupture of one prosthesis in an industrial accident 14 years after implantation of hydrogel-filled breast prostheses. As it was a work related accident, the Employer's Liability Insurance Association is responsible for covering the treatment. The patient history and the histological exam have proven that the accident was work related.

Forms and means of fulfilling the obligation for insurance of employees by the employer in the Republic of Serbia

In the first part of this paper, the author is presenting two acts of Serbian positive legislation of which one allows the employer to insure their employees as a form of additional social care and the other is obligating them to insure the employees from injuries and diseases that can arise out of and in the course of their employment by the employer. In the second part, Law on Safety and Health at Work, as the law that obligates them on insurance, is analised, and the good solutions (the definition of the obligation) and shortcomings (absence of minimum sum insured) of the Law are presented. In addition, it is appointed that the obligation that is established, does not have the sanction for non-fulfillment of the obligation. The third section of this paper outlines Worker's compensation insurance and Employer's liability insurance, as the types of insurance through which the employer can fulfill their obligation. Furthermore, the conditions of both types of insurance, of some Serbian and foreign insurers were analyzed and it was concluded that the conditions of Serbian insurers are not providing the necessary coverage. In the penultimate section, tax treatment of these two types of insurance in Serbia is shown and bearing in mind that one of them is excluded from tax on insurance premium and the other one is not, the equalization of their tax treatment is suggested. In the last part of the paper it is concluded that in Serbia, the structural changes in both legislation and conditions of insurance in this domain are necessary. It is suggested that the legislation needs to prescribe the minimum sum insured and the sanction for non-fulfillment of the obligation and on the other side the National bank of Serbia should point out to the insurers on the necessary changes in their insurance conditions.

Substances such as cement dust, polycyclic aromatic carbonhydrates (PAC), diesel exhaust and lubricatant cooling may contribute to the formation of cancer, but are not yet recognized as to be causing occupational cancer. By decree, these diseases can be recognized for compensation when there is enough new evidence for causality. The knowledge about these conditions is crucial for judgement. The technical supervisory board of the Employer's Liability Insurance Association should be asked to report information about the working place concentration of the accused substances before a decision can be made, because life-style factors (alcohol, smoking, nutrition) may contribute also.

SUBROGATION IN INSURANCE LAW— A CRITICAL EVALUATION

There can be few, if any, legal subjects, that have received less critical attention in Commonwealth countries than the law of insurance. The doctrine of subrogation, for example, is set out in most Commonwealth insurance law textbooks without a whisper of criticism.' To be sure, the periodical literature is a little more promising. There one finds criticisms of specific incidents of subrogation; for example in its application to the vendor-purchaser situation,2 to employer's liability insurance' or to the right of health authorities to bring claims for subrogation.4 It is worth considering why the doctrine of subrogation has attracted so little critical attention from legal writers. In the first place, most writing in the law of insurance has been aimed at practitioners and there is a feeling (perhaps justified) that practitioners are not interested in policy debates. Second, the doctrine of subrogation is at least two centuries old' and it is associated with the name of Lord Mansfield who has achieved the status of legal sainthood-at least in the area of insurance law even if he is credited with having formulated rules which he did not.6 After a doctrine has been in existence for two centuries, it becomes natural to think of that doctrine as being an indispensable part of insurance law.
