The article concerns an increasingly frequent phenomenon of holding instructors, coaches and organizers of physical activities liable for damages for personal injury suffered by participants of those activities. The analysis conducted by the author was based on legislation of England and Wales. The article outlines the premises of liability, the concept of duty of care in the context under discussion, causality and potential contributory negligence of the injured causing the occurrence or aggravation of the injury. The development of this legal institution, prospective changes and approaches of the English and Welsh scholarly writers have been presented. The article addresses important issues which are, however, seldom discussed in the Polish legal literature, and constitutes an important piece of knowledge for legal scholars, providing professional insights and prompting both axiological and purely practical deliberations.
