Penegakan Hukum Tindak Pidana Pemerasan Dengan Ancaman Dalam Pembangunan Properti Di Kota Padang

Crime is committed in various forms and developments. One of the things that occurs in society and receives little attention is the crime of extortion and threats. In Padang City there are cases of criminal acts of threats in property development. This was done by thugs under the pretext of security money. This is of course detrimental and requires action by the police. The formulation of the problem in this research is how to enforce the law against the crime of extortion with threats in property development in Padang City and what are the obstacles faced by the police in efforts to enforce the law for the crime of extortion with threats in property development in Padang City. The research method used is empirical legal research supported by field research at the Padang City Police Department by interviewing sources. Based on the results of the research, it shows that law enforcement for the criminal act of extortion with threats in property development carried out by the police is carried out by: 1. Repressive law enforcement through action based on the provisions of the criminal procedure law. 2. Preventive law enforcement, namely by prevention. The various obstacles faced by the Polresta Padang include limited personnel, the public accepting the practice of criminal acts of extortion with threats, criminal acts often occurring in remote areas and minimal reporting from the public

Therefore, the objective of this research is to help families with their welfare and safety and motivate the use of mobile applications. In the present work the situation, task, action, dan result (STAR) methodology was applied to elaborate the present work, this technique will allow improving the difficulties of the people. This methodology is very important because it is used to evaluate the circumstances in which people find themselves, a sequence must be followed to achieve the proposed objectives. The result obtained is an average of 84.5% on the design of the mobile prototype; being approved by the experts. The beneficiaries of the research are citizens through the mobile application.

THE CRIME OF EXTORTION COMMITTED BY A PUBLIC OFFICIAL BY COERCION (TPC ART.250/1)

TCK’nın 250. Maddesinin ilk fıkrasında düzenlenen icbar suretiyle irtikâp suçunda kamu görevlisi olan fail, görevinin sağladığı nüfuzu kötüye kullanmak suretiyle kendisine veya başkasına yarar sağlanmasına veya bu yolda vaatte bulunulmasına bir kimseyi icbar etmektedir. Ceza kanunlarında yer alması oldukça eskiye dayanan bu suç tipi gerek İtalyan gerekse de Türk doktrininde pek çok bilimsel çalışmaya konu olmuş ve bu çalışmalar uygulamayı da derinden etkilemiştir. Bununla birlikte bu suç tipinde hangi hukuksal değer ya da değerlerin korunduğu, kanunda geçen “yarar” ifadesinden ne anlaşılması gerektiği, suçun ne zaman tamamlanacağı, suçun benzer suçlardan ne şekilde ayırt edileceği gibi pek çok mesele halen dahi oldukça tartışmalıdır. Bu tartışmalar çerçevesinde Türk ve İtalyan doktrinlerindeki gelişmelerin ve Türk ve İtalyan yüksek mahkemelerinin özellikle son yirmi yılda verdiği kararların incelenmesinin hem doktrin hem de uygulama açısından son derece faydalı olacağı müşahede edilmiştir. Bu çerçevede çalışmamızda TCK’nın 250. Maddesinin ilk fıkrasında düzenlenen icbar suretiyle irtikâp suçu, suç teorisinin inceleme metodu çerçevesinde, yakın zamanda doktrin ve uygulamadaki gelişmeler ışığında ele alınmaktadır.

Tinjauan Yuridis terhadap Tindak Pidana Pungutan Liar (Pungli)

In the community, it is often heard about illegal fees which are a form of criminal act. This study aims to determine the regulation of illegal levies (Pungli) based on Regional Regulation No. 8/2010 concerning levies, creations and sports and to determine the imposition of criminal sanctions against perpetrators who commit illegal extortion (Pungli). The research method used is the normative research method, primary and secondary legal material sources, records of statutory books and other literature are carried out to collect data, and analysis of legal materials using legal arguments. The results of this study indicate that the regulation of corruption is implied in the formulation of corruption in several articles including Article 423 of the Criminal Code referred to in Article 12 of Law Number 31 Year 1999 as a criminal act of corruption, which is then reformulated in Law Number. 20 of 2001 concerning the crime of corruption. Legal sanctions against extortion consist of social sanctions and criminal sanctions. The law on corruption is stated in it regarding the crime of extortion.

The Genesis of a Permanent Tribunal: Quaestio Perpetuae de Repetundis

The aim of the paper is to present the judiciary in cases de repetundis in the period before the permanent court was established, including plebeian tri­bunals and “occasional” tribunals: quaestiones estraordinariae / quaestio­nes temporiae, as well as the collegium of recuperators. An important ele­ment is the evolution of the court proceedings and the emergence of new legislative efforts, as well as the influence of the emergence of new court models on the proceedings. The author will discuss the legal, social and political background of the development of legislation with regard to prose­cuting the crimen repetundarum (crime of extortion) and outline the scale of the problem of extortion in the Roman Republic, as well as the related social conflicts.

THE IMPORTANCE OF SECRET SURVEILLANCE OF COMMUNICATIONS IN DETECTION AND PROVING THE CRIMINAL OFFENSE OF EXTORTION

On the one hand, the crime of extortion is a conventional criminal offense; on the other hand, taking into account the highly specific level of organization, it is a modern criminal act. Such a stance has been justified by the statutory provisions incriminating the qualified forms of this criminal offense which is committed by organized criminal groups. Bearing in mind that our legislator has enacted different measures for combating organized crime, Serbian legislation includes specific measures and investigative techniques aimed at counteracting this type of crime. In addition to traditional methods which have now become part of regular evidentiary actions, the 2011 Criminal Procedure Code precisely regulates the former special investigative techniques, which are now part of special evidentiary actions. In this paper, the authors analyze one of the six prescribed special evidence-gathering actions - the secret surveillance of communications and its application in detecting and proving the criminal offense of extortion, particularly considering that the legislator explicitly prescribed the circle of offenses that may be subject to applying the special investigative measures whose scope of application includes some of the qualified form of extortion. Finally, the authors point to possible modifications of the legal provisions on the secret surveillance of communications, which should be precisely regulated in order to improve the procedural application of this special investigative measure in detecting and proving the criminal offense of extortion.
