Legal nature of the leasing agreement and its peculiarities

The article examines the legal nature of leasing in Ukraine. The issues of scientific analysis of the essence and mechanism of civil renewal of legal transformed regulation of the economics of leasing research legal relations in traditional Ukraine are considered. In the capital of modern economic instability in the means of Ukraine’s economy, the urgency of regulation acquires the issue of developed effective responsibilities and rational legal use of existing resources, investment, procurement, enterprise, search for effective funds, methods of accelerated legal development destroyed equipment is the case of the development of a developed lease relationship, the state in particular the financial entrepreneur. Investment leases help countries entrepreneurs who cope with the most economically important task due in the financial business - leasing constant financial renewal risks means synonymous with production and production maintaining them develops at a developed proper due level dynamically mastering develops.It is the loan due to the investment leased post-war mastery of Germany and equipment developed by Japan turned accelerated from the need for economically sound destroyed Germany states into a legal country with a mechanism of strong which and funds developed loan economy leasing.
 In the financing of countries with major developed economies to prove the task of one of the main lending types of investment investment regulation is used leasing.For Ukraine, this type of activity is relatively new, but is actively developing. Therefore, there is a need to bring Ukrainian legislation governing leasing relations in line with international standards and to define their clear legal criteria.It is also worth noting that the increase in investment activity in Ukraine will be largely determined by the presence of conditions attractive for the development of new forms of investment financing, including leasing. Therefore, providing the legal framework for the regulation of leasing relations is an extremely important task of the legislator.

New directions for civil renewal in Britain

• As with most migration-related issues, it is cities that are on the front lines of the social cohesion debate. Museums — important as sites that represent nations and cities and their populations — have been positioned by national governments as strategic players in the debate, with the result that they are increasingly held accountable to claims that they are, or have the potential to become, central to the wellbeing of community life. This article explores the reasons that the public policy initiatives of cultural diversity, cultural cohesion, cultural capital and cultural industries have come to rely on museums as institutions that collect and create culture, in all its diverse forms, experiences and understandings. •

Institutional Innovation in Philanthropy: Community Foundations in the UK

In the United Kingdom, there has been a resurgence of interest in philanthropy amongst the media, policymakers, and scholars alike. In this context, the analysis of new and innovative forms of philanthropy is paramount. This paper focuses on an innovation in the philanthropic form: the community foundation. The success of community foundations in the United States provided the impetus for the establishment of community foundations in the UK in the 1980s. This paper examines how the community foundation form has been adapted to the UK and the factors which have influenced the development and roles of British community foundations. It is argued that this study is both timely and important for three reasons. First, the analysis of new structures through which people give furthers our understanding of Britain’s culture of giving. Second, the paper examines the role of community-based philanthropy in the civil renewal of Britain’s communities. Finally, the study makes an important contribution to efforts to promote the community foundation form worldwide as it highlights the challenges of transferring philanthropic forms from one context to another.

The Community Dimension of Community Penalties

Abstract: The recent history of probation supervision in England and Wales has seen a significant reduction in its links to residential communities; but, by contrast, visible ‘Community Payback’ is now a key feature of unpaid work penalties. This article considers why these contrasting developments are occurring simultaneously. It argues that the dominant reason for the evolution of the ‘Community Payback’ scheme is governmental preference for aspects of the ideology of the ‘new market state’ (Bobbitt 2002). However, it is contended that a more appropriate policy framework, capable of application to both unpaid work and probation supervision, would be a dual emphasis, in a community context, on: (i) civil renewal and community engagement; and (ii) offender rehabilitation.

Active learning for active citizenship: The policy context

In this paper the UK civil servant directly responsible for managing the action research programme Active Learning for Active Citizenship (ALAC), sets out in brief the policy context within which the programme developed. He explains how concepts of active citizenship and community development were brought together in the early 21st century by the British Government, in a programme of ‘civil renewal’. As this has spread across Government as a commitment to ‘community empowerment’, the role of learning in building the capacity of both citizens and communities, and also public servants, has become increasingly recognized. Action research proved a very cost effective way of informing the development of a new approach to this kind of learning for adults.

Active Learning for Active Citizenship: An Overview

The project Active Learning for Active Citizenship formed part of recent civil renewal policy and contributed to the development of ideas along with action on the ground. Whilst that practice will be explored in other chapters, this chapter will examine the underlying principles. It is written by the author of the original report submitted to the Home Office in 2004, who subsequently helped initiate work across England forming Active Learning for Active Citizenship. It was seen as crucial that both learning and citizenship be active, following on from praxis related to empowering community development.

Active Citizenship and Effective Public Services and Programmes: How Can We Know What Really Works?

This paper is a review of the aims and practice of active citizenship in England. It sets out the key concepts and gives an account of the developing policy agenda in crime, regeneration and housing, education, health and local government. It reviews the current state of scientific knowledge in this area, in particular summarising research commissioned by the Home Office Civil Renewal Research Programme, 2004-05. Whilst the research findings show the positive contribution of government initiatives in this area, a key theme that emerges is that the policy context and the causal relationships are often more complex than advocates sometimes claim.

Building Community Networks for Active Learning for Active Citizenship

Recent attention from government bodies has turned to the question of how citizens engage with the state and its institutions and how learning processes might strengthen these interactions to create active citizens and responsive social structures. The Community OR Unit (CORU) has been engaged by the Home Office (Civil Renewal Unit) as part of one such project — through the creation of one of 7 Active Learning for Active Citizenship hubs nationwide. This paper introduces the role of community operational researchers within this endeavour and reflects on some of the lessons learnt.

Civil Renewal and Community Safety: Virtuous Policy Spiral or Dynamic of Exclusion?

Civil renewal is an emerging policy priority for the UK government, aiming to build stronger, more cohesive communities and to encourage individual citizens to be active members of such communities. The promotion of social capital and trust relationships is central to this approach. Strategies to improve community safety and reduce crime and disorder are closely related to the drive for civil renewal, with the two sets of policies seen as mutually supportive. This article shows, however, that many community safety initiatives are founded on relationships of suspicion between citizens. This generates a dynamic of exclusion that is likely to undermine attempts at civil renewal.

CHARACTER, CIVIC RENEWAL AND SERVICE LEARNING FOR DEMOCRATIC CITIZENSHIP IN HIGHER EDUCATION

ABSTRACT: This article explores the civic republican conception of citizenship underlying the Labour government's programme of civil renewal and the introduction of education for democratic citizenship. It considers the importance of the cultivation of civic virtue through political participation for such developments and it reviews the research into how service learning linked to character education can lead to the civic virtue of duty or social responsibility.

New Labour's Approach to the Voluntary Sector: Independence and the Meaning of Partnership

A major problem for voluntary organisations service providers under contract has been their independence in regard to both the relatively narrow issue of the terms and conditions of service provision, and the broader issue about the part voluntary organisations might play in policy shaping and democratic renewal. I examine the way in which New Labour has developed its ‘partnership’ approach to the voluntary sector since 1998. I argue that better terms and conditions have been secured for voluntary organisations providing services, and that large and umbrella organisations now have more impact on the implementation of central government policy. However, the more equal partnership required for a policy-shaping role in the sense of agenda-setting is likely to remain elusive, while at the local level there are tensions between the idea of voluntary organisations as agents of ‘civil renewal’ and as service providers.

The New Local Governance of Community Safety in England and Wales

This article provides an overview and assessment, since 1997, of the "New Labour" government's reforms and policies of crime prevention and community safety in England and Wales. It reviews developments since the Crime and Disorder Act, 1998, and assesses the impact of the government's Crime Reduction Strategy and its campaign against antisocial behaviour. The argument is that, in its zeal to reduce crime through its "modernization" agenda, applied to public service delivery, and the consequent emphasis on performance in the reduction of crime, the government is neglecting the institution-building task of constituting a new security governance in the community. This neglect may have led to a rise in insecurity in society, fostered by a heightened anxiety about disorder. This trend seems set to continue with the government's approach to police reform. And although an emergent agenda of "civil renewal" holds out some promise for policies that recognize the role of citizens in the co-production of community safety, there are also dangers of reinforcing the insecurity of the disadvantaged, who have limited access to the social capital required for participation.

A strategic planning model for community safety and housing market renewal

The article proposes a schematic model of how community safety is related to changes in local housing markets ‐ particularly those characterised by low demand and market failure. The model is presented as an example of strategic planning for ‘joined‐up’ working in civil and neighbourhood renewal.

Taking Citizenship Seriously

This article examines the ideas of citizenship, social capital and community, and of personal and social responsibility, which have become prominent in Great Britain since the election of the Labour Government in 1997, and also in a number of other, mostly English-speaking, countries. They became especially prominent during the early summer of 2003 with the publication of the Prime Minister's Progress and Justice in the 21st Century (Blair, 2003), the Home Secretary's Civil Renewal: A New Agenda (Blunkett, 2003a), and Hazel Blears' Communities in Control: Public Services and Local Socialism (2003). The present paper reflects on the changing nature of the debate and applies the ideas of citizenship, social capital and community to the country's response to crime, to the current issues regarding the nature and purpose of criminal justice, and to the structure and accountability of the criminal justice services. It draws attention to the limitations of the criminal justice system, and of the state, in providing solutions to the range of problems connected with crime and the various forms of social disorder and unacceptable behaviour; and suggests how ideas of citizenship can help to inform social policy and professional practice, illuminate the reform of public services, and offer a sense of purpose and direction which will give vitality and legitimacy to developments in the future.
