ROMUALD HUBE – PIONEER IN THE TEACHING OF POLISH CRIMINAL LAW

The article presents the figure and the most important scientific achievements of Romuald Hube in the field of the science of criminal law, as well as the legislative work conducted on the criminal law of Russia and the Kingdom of Poland. Romuald Hube is undoubtedly an extremely significant figure in the Polish science of criminal law, although this branch of law was only a part of his scientific interests. It should be emphasized, however, that Romuald Hube significantly developed the science of criminal law, also in its global dimension. Moreover, through his work in the state administration, he actively participated in the creation of this branch of law. He lived and worked in an extremely complicated period due to social changes and an unfavourable geopolitical situation for Poland. Due to the fact that his life and work were associated with a foreign country, Romuald Hube was a scientist often criticized in Poland and ostracized in the community. Hube’s unquestionable contribution to the body of criminal law, with relatively little exploration of it in the doctrine, implies a need to remind the reader of the scholar’s profile.

Розглянуто особливості зародження нового нормативного масиву в системі національного права, яким є містобудівне право. На фоні розбіжності наукових підходів до визначення місця містобудівного права в системі права обґрунтовано авторське бачення останнього як самостійної комплексної галузі права. Охарактеризовано особливості нововиниклої галузі з боку співвідношення самостійності та комплексності. На основі порівняльного аналізу містобудівного законодавства країн пострадянської правової сім’ї та відповідних доктринальних положень визначено предмет містобудівного права, який становлять відносини будівельні, архітектурні та планування організації і розвитку територій і населених пунктів. A Escola do Constructivismo Lógico-Semântico e os Limites da Interpretação: Uma (Re) Conceituação do Tributo no Brasil

The question around the solid waste problem arising from the deleterious effects of a consumer society, post-industrial, postmodern, in which are evidenced unpredictab- le risks, exposes the complexity of current relationships and ultimately promote greater concatenation in the traditional divisions branches of law. At this point, it is seen that the combined study of Environmental Law with the Tax Law is now more than necessary, especially when comparing the solid waste management in reverse logistics. Thus was instituted the National Policy of Solid Waste (PNRS), by means of Law No. 12.305/10, listing a set of principles, objectives and instruments for an integrated solid waste mana- gement. Among the instruments within PNRS, we highlight the use of tax incentives in economic activities that are consistent with sustainable development, which is the subject of investigation of this scientific work. From a survey of literature, descriptive and explo- ratory nature, it appears that the design of tax incentives on PNRS should be as broad as possible, especially when taken as a paradigm of ICMS. This is the most important state tax and has revealed important biases, to be structured tax incentives that promote the implementation of reverse logistics systems. Starting a process in the state of Ceara expe- rience, it is concluded that this tax incentive discussion is to be taken under the CON- FAZ, aiming to engage other federal entities, with a view to achieve more fruitful results of stimulation in the management of waste solids by Brazilian companies.

Biocrime - A New Concept

In order to reflect the interest that human society showed to the evolution of biotechnology and biomedicine, were adopted a series of juridical instruments with universal vocation, national or international, within were consecrated principles and concepts of special importance and which are considered the base of a legal system of protection that will have to be in a continous improvement.The Convention on Human Rights and Biomedicine of 4 April 1997, also known as the “Oviedo Convention” represents the source of creative inspiration of the states internal legislation, which have adopted ratification laws on national level, based on the Convention's articles. Romania is among the states which have adopted a position of recognition of the Convention through the Ratification Law No.17 / 2001.Therefore, on national level were previously adopted many normative acts, having as result the harmonisation between the national and international legislation, both, the civilian and criminal law. We can mention as a very important event, the adoption of the new romanian Civil and Criminal Codes, organic laws, but also the special laws in compliance with the nature of the Oviedo's Convention articles.Among the special laws, we can remind Law No. 95/2006 on healthcare reform and Law No. 39/2003 on preventing and combating organized crime.The chapter Crimes from these special laws includes articles that incriminates human trafficking, the procurement of organs that compromise the results of forensic autopsy , organization and/or conducting removal of organs and/or tissues and/or cells of human origin for transplantation , that we can call, without any doubt, Biocrimes.In the Biocrimes article presentation, we will try to define and configurate this concept. In the same time, we strongly believe that the article in question is the initial start in using this new legal term and, why not, in trying to implement a new concept and to codify this type of crimes, which may be considered the subject of a deep study of the criminal law's branch, with great importance for the development of a poorly configurated legal field, of International Criminal Law.
