Abstract
The purpose of this article is to analyse the changes in agricultural land use for nonagricultural purposes in Russia and Poland. In the beginning the definition of agricultural land was given, which is in force in Poland and Russia. We analysed existing procedures related to land use change in both countries. It also provides specific cases and the rules by which in Russian Federation it is possible to change the destination of lands, as well as describes the administrative procedure which precedes an administrative decision in this matter. Celem niniejszego artykułu jest analiza zmiany przeznaczenia gruntów rolnych na cele nierolnicze w Rosji i Polsce. Na wstępie podano definicję gruntu rolnego obowiązującą w Polsce i Rosji. Przeanalizowano obowiązujące procedury związane ze zmianą przeznaczenia gruntów w obydwu państwach. Podano także szczególne przypadki i zasady, według których w Federacji Rosyjskiej możliwa jest zmiana przeznaczenia gruntów, oraz opisano procedurę administracyjną, która poprzedza wydanie decyzji administracyjnej w tej sprawie. W artykule wymieniono też przypadki, w których w Polsce na przeznaczenie gruntów rolnych na cele nierolnicze potrzebna jest zgoda ministra ds.
