Abstract

The article characterizes the institution of suspension of an academic teacher from his duties currently functioning in domestic Polish law. It is divided into six parts. The study discusses the evolution of the suspension of an academic teacher from his duties since 1990, the forms of suspension, the formal and substantial prerequisites for the optional suspension and the legal consequences of the suspension of an academic teacher. The issue of the functioning of the institution in question as part of disciplinary proceedings has been presented both from the theoretical and legal aspect, as well as from the point of the regulations of criminal procedure and labor law. The article draws on the body of literature on the suspension of an academic teacher in the performance of his duties and the case law of common courts and the Supreme Administrative Court.
