Abstract

The year 2012 has begun on a high note with the Indian judiciary saddled up to look thoroughly into the major problems surrounding international arbitration in India. The current work traces some very important judgments which have led the Supreme Court to establish a Constitutional bench early this year. The current work also discusses the probable outcome and other concerns that are likely to be addressed by this Constitutional bench. These concerns remain of utmost importance to the global arbitration community involved in dispute resolution.
