Abstract

The Act of 31 March 2020 changed the content of the provision of Article 190a of the Criminal Code, introduced two new features and changed the statutory threat. The description of the prohibited act has been enriched with new types of effects that are to be caused by the perpetrator’s behavior: inducing a feeling of humiliation or torment, justified by circumstances. The sanction was increased and the perpetrator can now be punished with a penalty from 6 months to 8 years in prison for this act. This provision already showed some connections with the so-called mobbing. This phenomenon was defined in Article 94 3 § 2 of the Labor Code. Some of the mobbing behaviors may constitute spontaneous prohibited acts. However, there is no type of offense that would reflect the entire content of the lawlessness of such behavior. Due to the high level of social harmfulness, as well as an affinity with harassment and bullying, which are crimes, the best option would be to create a new type of crime.
