Abstract

In this article the authors examine the Supreme Court’s recent decision in Arizona v. Gant and argue that the high court correctly clarified the law regarding what police may do when conducting a search incident to the arrest of someone in a vehicle. In the following article, friend and colleague Martin O’Connor argues the Supreme Court (and this article) are wrong and that the decision will negatively impact police investigation of criminal activity.
