Abstract

This “statement” of Professor Paust was made before the ABA International Section Hearing on Targeted Drone Issues and Due Process of Law, April 25, 2013. The statement addresses what process is constitutionally due a U.S. citizen who is lawfully targetable under either the laws of war or the law of self-defense; the constitutionally-based power of the President to target individuals abroad; and the propriety of targetings under international law regarding the law of war paradigm, the self-defense paradigm, and the human rights paradigm.
