Abstract

This chapter looks at a number of key areas in which the core issue of religiously inspired clothing or attire has given rise to dispute, and at how this has been resolved. For all the reasons the primary focus is on the jurisprudence of the European Court of Human Rights, though illustrations from other international fora and domestic jurisdictions is also drawn. The first category of restrictions is in some ways the most difficult to pin down, seemingly the least controversial but in practice may be the source of the most serious restrictions upon the wearing of religious symbols. The context in which the wearing of religious symbols and clothing has received the most attention is that of public educational institutions.
