US Court Cases regarding Warrantless Laptop Searches at the US Borders

Abstract

과학기술의 발전에 따라 새로운 디지털 저장매체와 과학적 수사기법이 등장하고 있으며, 입법과 법해석에도 이러한 과학기술의 발전이 반영되어야 할 것이다. 과거 미법원들은 영장주의의 예외인 국경수색이론을 국경에서 폭넓게 적용하여 왔으나, 최근의 판례는 국경에서 랩탑에 대한 포렌식 수사기법을 사용한 수색에 국경수색이론의 적용을 제한하려 한다. 랩탑은 많은 여행객들의 필수 소지품이며, 방대한 양의 사적인 정보를 담고 있다. 랩탑에 대한 포렌식 수사기법을 이용한 수색은 사생활 침해의 위험성이 크며, 적법성의 요건이 엄격히 해석될 필요가 있다는 면에서 최근 미법원 판례의 관점은 올바른 방향인 것으로 판단된다. 우리의 경우도 랩탑과 스마트폰을 위시한 디지털 저장매체를 압수하여 데이터를 분석하고 수집하는 디지털 포렌식(digital forensic) 기법을 이용한 수사기관의 조사 건수가 해마다 크게 늘고 있다. 그러나 포렌식 수사의 과정에서 침해될 수 있는 대상 범죄와 관련성이 없는 개인 정보의 보호를 위한 절차가 제대로 마련되어 있지 않고, 수집된 자료에 대한 적절한 관리가 이루어지지 않아 불법 수사의 우려가 크다. 이러한 우리의 상황에서 미법원 판례의 새로운 경향은 우리의 입법과 정책이 나아갈 방향에 많은 시사점을 준다. 이들 미법원의 판례는 과학 기술의 발전을 반영하여 법이론의 변화를 이끌어낸 의미 있는 판결들이다. 추후 우리의 경우도 과학기술의 발전에 따른 새로운 디지털 저장매체의 등장과 과학적 수사기법에 따라 영장주의에 관한 형사소송법 규정을 어떻게 해석해가야 할지 고민해야 할 것이다.This study discusses recent several US court cases regrading warrantless laptop searches at the US borders. The Fourth Amendment to the US Constitution guarantees freedom from government intrusion into individual privacy. Individual privacy concerns occurs when police use new methods of technology without warrant and collect information in which an individual has a reasonable expectation of privacy. Digital forensic is one of the new search methods, and this digital forensic technology may cause dangers to individual privacy. The US Appellate Courts recently reviewed the Fourth Amendment constitutionality of warrantless laptop searches at the US borders. According to the court opinion, border agents need ‘reasonable suspicion’ for through digital forensic search of electronics. An US federal appeals court held that agents can conduct an extensive warrantless search of an individuals’ electronic devices at the U.S. border only if they have ‘reasonable suspicion’ of criminal activity. The author of this paper argues that legislation and interpretation of law which reflect advances in science and technology is needed to protect individual privacy.
