Abstract

The crime of falsification of the immigration documents, namely passports, is a crime that is detrimental to the state. Investigative actions to the decision to apply criminal sanctions are a series of results of immigration control activities. To maintain and ensure that all people who enter/leave from and to a country comply with all immigration provisions. The problems in this thesis are what are the forms and the modus operandi of the criminal act of passport forgery, how is the process of investigating of the perpetrators of the crime of passport forgery by the Regional Police of Sumatera Utara, how are the obstacles and the efforts to overcome the criminal act of passport forgery by the Regional Police of Sumatera Utara. What is the form and the modus operandi of the criminal act of passport forgery, How is the process of investigating the perpetrators of the criminal act of passport forgery by the Regional Police of Sumatera Utara, How are the obstacles and efforts to overcome the criminal act of counterfeiting passports by the Regional Police of Sumatera Utara. Based on the discussion, it can be concluded that the form and the modus operandi of the crime of passport forgery is by utilizing technological sophistication, namely the suspect uses Photoshop and Corel Draw programs to create images, which resemble the images in the original document. Criminal sanctions for perpetrators of the crime of passport counterfeiting are not only regulated in the Criminal Code. Criminal sanctions are also regulated in Article 126 of Law Number 6 of 2011 concerning Immigration. Efforts to overcome the crime of passport forgery are divided into two ways, namely preventive and repressive countermeasures. In terms of prevention, this is very closely related to the supervision of both tourists entering Indonesia or leaving the territory of Indonesia, and carrying out activities in the territory of Indonesia. Preventive countermeasures are countermeasures carried out in an effort to prevent or maintain the possibility of immigration crime in this case, namely the criminal act of misuse of immigration permits.
