Abstract

Restrictive Business Practices Code, adopted by the General Assembly of the U.N. on 5 December 1980,2 the other the Infant Formula Code, adopted by the 34th World Health Assembly (the general assembly of the World Health Organization-WHO) on 21 May 1981.3 Both Codes take the form of recommendations.4 The former, the RBP-Code, contains far-reaching antitrust provisions of worldwide application; the latter seemingly covers only a subject of limited scope but poses the interesting question of tort law enforcement of non-binding U.N. codes and other guidelines.
