Romanian Abstract: Autorul expune soluțiile legislației italiene, jurisprudența care difera in parte de soluția din legislația româna din 2009. In primul rând, autorul se refera la infracțiunea recidivista (pentru care nu exista condiția unitații pasive subiectul legii penale din România), dupa care se abordeaza infracțiunea complexa (in acest caz, soluția adoptata de legiuitorul italian este similar cu cel adoptat de legiuitorul român) și apoi abaterea deviata. In aceasta ipoteza, Codul penal italian menționeaza in mod expres abaterea, o soluție care nu exista in Codul penal român. English Abstract: The author exposes the solutions of Italian legislation, jurisprudence which differ in part to the solution in Romanian 2009 legislature. First the author dwells on recurrent offence (for which the condition of passive subject unit as in the Romanian criminal law does not exist), after which complex offence is tackled (in this case, the solution adopted by the Italian legislature is similar to the one adopted by the Romanian legislature) and then the deviate offence. In this hypothesis, the Italian Criminal Code expressly mentions deviate offence, solution which does not exist in the Romanian Criminal Code.
