Abstract

This paper talks about the nature, idea and concept of uniform civil code. The basic question that whether uniform civil code is demand of time has been tried to answer in this research paper. In this paper the issues and challenges have also been discussed. Firstly this paper start off with an introduction to the uniform civil code, it’s origin and the basic nature of our country in respect of religion. Then this paper talks about how the problem of gender inequality has arose in the past and still going on in Hindu personal law as well as Muslim personal law. The Most important point how the implementation of uniform civil code will contribute in women empowerment and upliftment of the status of women in areas like family and marriage. No doubt uniform civil code can be a great source to secure gender equality. The need of the uniform civil code was understood back then also to avoid discrimination, hatred and partition. As we go ahead this paper discusses about the correlation between uniform civil code and secularism and also how implementation of UCC will decrease the dirty politics during elections and other disputes in the name of religion. After that as we mentioned earlier it discusses whether the UCC should be implemented in a country like India or not and its merits and demerits. This paper talks about the cases and it’s judgement by the court towards uniform civil code. In the end this paper winds up with conclusion and suggestions.
