Abstract
This chapter explores the idea of a human rights-based approach to adoption. It highlights the distinct features of this approach by comparing it with two other discrete approaches – a property/instrumentalist approach, and a welfare approach. It then seeks to identify and explain how adoption sits within the broad spectrum of rights concerning children and their families under the UNCRC and the impact of these rights if a child is subject to adoption. This discussion regarding the impact of a rights-based approach is broken into 3 parts: pre-adoption; adoption; and post-adoption.
