Um panorama geral da reforma da Lei de Arbitragem: o que mudou com a Lei Ordinária nº 13.129/2015

Abstract

ABSTRACT: The scope of the present paper is to analyze the modifications and amendments brought by the Law nº 13.129/2015 (New Arbitration Law), which modifies some of the provisions of Law nº 9.307/96 (Arbitration Law). With the New Arbitration Law, questions are raised regarding the feasibility of the amendments that are now part of the legislation that regulates arbitration in Brazil. There was a heated debate between those that defended the necessity of modernizing the Arbitration Law and those that pointed the adequacy of the existing law. Thus, this article tries to demonstrate which are the real changes brought by the New Arbitration Law and the possible impact that those changes bring for the enforcement of arbitration in Brazil.
