Abstract
In NLRB v. FDRLST Media LLC, the U.S. Court of Appeals for the Third Circuit ruled in favor of the employer with respect to a controversial tweet but against the employer on the issue of whether an individual with no relation to the parties has standing to file a complaint with the National Labor Relations Board (NLRB). Both rulings may impact other employers.
