Abstract

Abstract One of the questions most commonly asked to practitioners by trustees is if it is possible to request advice, or a binding order from a Judge, on the right course of action. Obviously, such possibility would preclude any further discussion of the responsibility of the trustee (that followed the judicial advice or instruction). This request is possible in most jurisdictions on tax issues, but is not possible on business or other issues. Argentina is no exception, and this case explains the applicable law.
