Abstract

Trust law as a unique legal regime in common law world has deeply influenced the legal and political practices in Anglo-American legal system. By contrast, the regime of legal person formed a series of distinctive legal theories and political practices in Continental jurisdictions. From the perspective of organizational law, this essay explores the different governance mechanisms of Anglo-American constitutionalism and Continental political traditions, and re-explains why historically the common law countries have advantages in democratic politics.
