Abstract

Trust and contracts: Are they mutually exclusive? I will begin my discussion of this question from the perspective of commercial trans actions in the United States. Mine might be described as a micro approach to the subject, in contrast to the macro view of someone like Francis Fukuyama in his recent book about trust.1 So, now to the question at hand. The answer is, in my opinion, so obviously negative that you might wonder what purpose is served by posing it. The purpose?I think?is that the question serves as a useful rhetorical device for exploring the nature of the relationship between trust and contract.
