Abstract

Abstract:This article presents a comprehensive study of the offence oftrauma ek pronoias(intentional wounding) in Athenian law. Part I catalogues every occurrence of the words τραùμα and τιρώσκω in the Attic orators and concludes that the requisite physical element oftrauma ek pronoiaswas the use of a weapon. Part II analyses all attestedtraumalawsuits and concludes that the requisite mental element of the offence was a bare intent to wound. Part III addresses the procedural evidence fortrauma ek pronoiasand concludes that the action fortraumawas agraphê, not adikê. Two appendices discuss the use of the termstraumaandpronoiain Plato'sLawsand Aristotle'sRhetoric(Appendix A) and a reference totrauma ek pronoiasin Lucian'sTimon(Appendix B).
