Abstract

Municipal councils that initiate a project such as a development plan should have an influence on the implementation aspect, but implementation of land use reservation has largely been observed as unsatisfactory. Acquisition of land reserved for public purposes, due to poor financial position of municipal councils, is observed to be a main hurdle in the process of implementation. Maharashtra Regional and Town Planning Act 1966 provides Transferable Development Rights (TDR) as a tool to implement development plan proposals particularly for public purposes. However, the record of success with TDR programmes at municipal council level is observed to be a very poor.At present, except at metropolitan city level in India, the country is lagging in the use of the TDR tool particularly at municipal council level.
