Abstract

This paper will examine the recovery of assets with a view to confiscation under UK law. It will consider both criminal and civil recovery of the proceeds of crime under the Proceeds of Crime Act 2002. It will also consider the Proceeds of Crime (External Requests and Orders) Order 2005 which provides the mechanism for recovery of the proceeds of crime in the UK believed to be necessary in the criminal investigation of cases from abroad.
