Abstract

The key aim for the introduction of Insurance Act 2015 in UK was to modernise the insurance laws in line with recent changes brought in world wide. It mainly aimed to make the laws more proportionate in regards to the duty of full and accurate disclosure. The law has also purported to make the remedies more proportionate, reasonable to the insurer and insured specifically when an ensured found to be breached in his duty to make full disclosure. Thus, this article intends to explore the extent to which the new law has been successful in achieving its aim.
