Abstract

The article is devoted to the study of the concept of an agricultural plot of land. It was established that the specific current legislation has many references to such a category as agricultural land, but such legislation does not contain a definition of the concept of agricultural land.
 Issues related to the concept of an agricultural plot of land, the procedure for its use, restoration, establishment of responsibility for violations in the field of land relations are constantly becoming the subject of both scientific and practical interest.
 Taking into account the careful study of certain issues of the use of agricultural land plots, after the introduction of the land circulation mechanism and the changes in this mechanism that will take place in the near future (01.01.2024), the recently introduced changes in the relevant legislation regarding the possibility of withdrawing from the permanent use of state agricultural land plots property by decision of the Cabinet of Ministers of Ukraine without the consent of state enterprises, institutions, organizations and without the consent of the bodies (organizations) to which they belong, and transfer for permanent use to other state enterprises (July 27, 2023), there is a need to carry out study of the concept of agricultural land plot.
 It has been established that the concepts of agricultural plot and agricultural land are related as part and whole, and therefore it is impossible to equate agricultural plot with agricultural land. A land plot is considered formed from the moment it is assigned a cadastral number, and the formation of a land plot involves determining its area, boundaries and entering information about it into the State Land Cadastre. The legislation defines the list of persons who can acquire the right of ownership and use of agricultural land plots. The legislation has changed the regime for the use of agricultural land plots by state-owned entities. The author’s definition of the concept of agricultural land plot is given.
