Abstract

The division of criminal cases into three separate trials – conviction, sentencing, and procedural - is one of the important reforms in the field of Chinese criminal procedure. Each trial has its own form and structure, and each trial is associated with a relevant set of safeguards in procedure and judicial interpretations. This division is significantly different from the traditional litigation pattern, and has expanded the meaning public prosecution, enriched the basic forms of criminal defense and diversified the criminal evidence rules. It is of great theoretical significance to observe the objective laws of criminal procedures by studying the overall forms of judicial trial.
