Abstract

Senior Costs Judge Peter T. Hurst examines the ‘American Rule,’ which generally does not allow fee recovery in the US litigation with some important exceptions. The Article critically assesses the American contingency fee regime as the UK Government weighs the Lord Justice Jackson’s Cost Review, which proposed, among other things, to allow the contingency arrangement on a limited basis.
