Abstract
Abstract As exhibited in ongoing environmental fora, world attention is being focused on the marine environment with particular attention to the sustainable development of ocean resources. In this context it is equally important to ensure that emerging principles of environmental protection continue to reflect the deliberate balance between the preservation of navigational freedoms and protection of the marine environment as reflected in the 1982 United Nations Law of the Sea Convention. This article reviews how Part XII of the Convention provides a modern framework for environmental norms that are appropriate in light of the competing interests affecting ocean uses. The author concludes that strict adherence to the Part XII framework is in the best interests of the security, economic, and environmental interests of all nations.
