Abstract

The question concerning the validity of EU norms conflicting with international obligations is a complicated one and provokes a host of further questions. First, the question arises as to the validity of EU norms under which legal system: hypothetically, at any rate, it might be possible that EU norms are valid under EU law, but invalid under public international law. Second, there is the question of whose international obligations are actually at issue - those of the EU or rather, those of some of its Member States? A conflict between EU norms and the EU's own international obligations has a different dynamic from a conflict between EU norms and a treaty commitment by one or more Member States under international law. In this paper, the writer focuses on international law as the legal order with which conflicts may occur and on conflicts for individual Member States.
