Abstract
The objective of this article is to describe the historical construction of the national guidelines for basic sanitation, in particular its universalization and its relationship with the right to health in Brazil, conceived by the Constitution in its entirety, considering its historical aspects and the contemporary challenges for the effectiveness of such rights. To this end, we review specialized bibliography, in addition to normative texts, especially the Federal Constitution, which enshrined the universalization of the right to health, and Federal Law No. 14,026/2020, which updated the legal framework for sanitation basic. In conclusive terms, it remains imperative to prioritize the universalization of basic sanitation, so that the right to health can be effectively guaranteed in a comprehensive manner.
