Abstract

Abstract This chapter covers the past and future of the United Kingdom (UK) Supreme Court and its references to the European Union's Court of Justice (CJEU). It recognizes Lawrence Collins' contribution as the pioneer of what was to become EU law. Brexit, the UK's withdrawal from the EU, triggered an opportunity to reflect on the past and future relationships between the UK Supreme Court and the CJEU. Since the transition, UK courts and tribunals could only reference the CJEU under limited circumstances. No further guidance is provided in legislation regarding the departure, authority, or weight of CJEU case laws, but courts have broad powers on what could be a controversial area.
