Abstract

We had, in this research, the role of the United Nations and Arab Conventions to combat corruption in the private sector development (Iraq a model), where divided by the two sections: the first contains the definition of the concept of corruption and ways to be treated according to the Conventions and the United Arab Nations Convention against Corruption, and the second topic, handled the legal regulation to criminalize corruption in the private sector, through the criminalization of two conventions of the manifestations of the basic corruption in the private sector, namely: bribery, embezzlement of property and laundering of proceeds of crime, as well as the liability of legal persons as are involved in acts of corruption established according to these conventions. In conclusion, we explained the most important conclusions that we have mentioned in the subject of research, most notably: containment of the United Arab Nations Conventions against corruption, ways to combat this disease both before and be infected by the community (preventive means) or during his injury by (means punitive), as well as how to cure once and for non-injury him again (therapeutic avenues). As well as the criminalization of the conventions basic manifestations of corruption in the private sector. And the application of these conventions texts will lead to reducing the level of corruption in the private sector, their being included in their provisions, monitoring mechanism to create, if applied, great difficulties for people who want to theft, as it is easy to recover the stolen money and bring the perpetrators to justice and convicted. The most important recommendations that we have mentioned in the conclusion, is the codification of private texts criminalize basic manifestations of corruption in the private sector, and the tightening of sanctions on these crimes and what it represents the last of the key obstacles to the development of the role of the private sector in economic development and the overall economy of Iraq. As well as the development of a draft anti-corruption law responds to the requirements of the United Nations and the Arab Anti-Corruption Conventions, in general, and confirms them, and to promote and facilitate the dissemination of news about the culture of corruption and whistleblower protection, and to promote and facilitate the use of complaint mechanisms and follow-up.
