Abstract

.With increasing/ proliferation of international trade under the regional trading arrangement, many regional blocks has realized the establishment of the regional courts and tribunals for the interpretation, settlement of disputes and other legal opinions which assist in attainment of the regional objectives. With regards to East African Community (EAC) the presence of East African Court of Justice (EACJ) as one of the East African Community organs. Among other functions of the EACJ but the role of treaty interpretation has been seen as one of the dominant role of the EACJ in its daily undertakings. Many experts has noted and trends in international trade law indicates the increasing dominant role of treaty interpretation in dispute settlement than other roles in various international, regional courts and tribunals which is largely attributed by many factors including “the Lack of predictability in legal obligations, Uncertainty and possibility of divergent expectations and continuously erosion of rights negotiated treaties among parties.
