Abstract

Parties approach disputes with rigid positions, invariably devoid of rational or commercial consideration. Parties in dispute seldom convince each other through logical argument. Psychological elements frequently obstruct the path to settlement. This paper offers mediators insights into the psychological drivers of human behaviour in conflict, providing a greater understanding of the diverse strategies adopted by parties in dispute.
