Abstract

The relapsing of the tribal manners after the Prophet’s death prevented that political system supported with scientific criterions. This situation caused of the chaos to be lived in Islamic society. Abu Hanifa even was one of the men suffering annoyances of wrong politics. Racist Umayyad didn’t act with fairness towards Mavali new rightly guided in social, economic, and religious subjects. This situation caused Abu Hanifa to be directed towards defensing the political and the legal rights of Mavali. Abu Hanifa who regards the rights of Mavali as equal with the basics of Islamic religion pronounced the fatwas supporting the combats of Ali’s children towards the racist Umayyad and Abbasid. Traditionists (Muhaddisun) dominated in the religious understanding of Ahl al-Sunna coming nowdays. They prefered the reconciliation unsuitable with rules of the religion ans science, but Abu Hanifa didn’t identify himself with the political understanding isolated from the religious and scientific rules of justice, equality, and freedom, besides he insisted on the Caliphes of Umayyad and Abbasid going beyond the human rights.
