Russian Abstract: В статье исследуется проблема недостаточной правовой урегулированности порядка избрания меры пресечения в виде заключения под стражу. Автор предлагает изменения, установление которых в уголовно-процессуальном законе гарантирует баланс интересов личности и общества. English Abstract: In the article investigates the problem of inadequate legal regulation of the procedure of the election of a preventive measure in the form of detention. The author offers a number of changes, the establishment of which in the Criminal Procedure law guarantees the balance of interests of the individual and society.
